the regular monthly meeting of the
City Council for the transaction of
such business as may regularly come
before it.

sessment to pay for the construction
of a sanitary sewer in Air Hill street
from Julien avenue to West 8th
street. Councilman Gabriel moved
that the notice be received and
filed seconded by Councilman
Schrempf. Carried by the following

A remonstrance was • filed by
James Walsh objecting to the assess-
ment against his property, Sub. 11,
Kelly's Sub. lot 1 for the construc-
tion of said sewer, presented and
heard. He stated that his property
is already connected with a sewer in
Julien avenue and that he derives
no benefit from this sewer in Air
Hill street. Councilman Melchior
entered and took his seat at 4:45 p.
m .
Councilman Schrempf moved that
the remonstrance be referred to the
City Manager and City Engineer to
investigate and report back to the
Council, Seconded by Councilman
Gabriel. Carried by the following
vote:

Petition of P. McInerny remon-
strating against the assessment as

and that when he went to the court
house he found the assessment to be

Petition of Mrs. Hannah Gelling, a
widow and owner of lot 11 in Yates
and Pickett's sub., fronting on Cor-
nell street, stating that she has been
notified by the sanitary inspector to
connect with the sewer and install
toilet and kitchen sink; that her lot
is high above the grade on Cornell
street and the expense to her of
making a sewer connection would
be very great, and much more than
her circumstances will justify at
this time. She asks that no order
for this work be made at this time,
or until she has had an opportunity
to try to arrange to connect with a
private sewer in the street adjoining
her property on the north. Council
man Brede moved that the petition
be referred to the City Manager for
investigation and to report back to
the Council. Seconded by Council-
man Gabriel. Carried by the follow
ing vote:

Report of the City Manager on the
petition of Emil Feigner et al, asking
'to have Fairview Place improved,
recommending that the petition be
granted. Councilman Brede moved
that the recommendation of the City
Manager be approved, the prayer of
the petition be granted and the peti-
tion made a matter of record. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote:

A Resolution.
Whereas a petition has been pre-
sented to the City Council of Du-
buque asking that Fairview Place
from the south line of 16th street
to the east line of Cornell street,
be repaired by the use of tarvia and
crushed stone, and
Whereas such petition contains
the signatures of the required num-
ber of property owners along the
proposed improvement and as it is
deemed necessary and advisable by
the City Council of Dubuque, that

said street be repaired as requested;
Now therefore, be it Resolved by
the City Council of the City of Du-
buque that Fairview Place from the
south line of 16th, street to the east
line of Cornell street be repaired by
the use of tarvia and crushed stone,
under the supervision and direction
of the City Engineer of such city;
and
Be it further Resolved that when
such improvements and repairs are
completed, the Engineer shall be
and is hereby directed to prepare a
schedule of the cost of such improve-
ment and repairs and report the
same to the City Council for its ap-
proval and thereupon a special as-
sessment shall be levied against the
property abutting and adjacent to
such improvement and repairs, as
provided by law,
Be it further Resolved that this
resolution being deemed urgent and
of immediate necessity shall be in
force and effect from and after its
passage and adoption by the City
Council.

Gentlemen: —In accordance with
your request, on May 31st, bids were
received for the drilling of one deep
well to add to the city's water sup-
ply. This well is figured to be drill-
ed to a depth of 1,500 feet. The
engineers prepared two sets of speci-
fications covering this well. The
specifications are a little hard to
make out inasmuch as there is con-
siderable ungerta.inty as to just the
nature of the ground to be encoun-
tered at that depth.
Under the first specifications the
following bids were received, the
total cost being based on the differ-
ent prices for casing and different
sizes of poles.

C. W. Varner of Dubuque, who
drilled two of the previous wells,
turned in an alternate bid based
upon his knowledge of the conditions
of the ground and based upon his
ideas of the proper specifications.
This bid totaled $12,555.00.
I have been talking with Mr.
Mead's office in Madison this after-
noon and am advised that Mr. Mead
recommends the contract to be
awarded to Mr. C. M. Varner of Du-
buque, provided he is willing to guar-
antee the completion of a satisfact-
ory well under the condition as giv-
en in his alternate bid, as this bid
is somewhat less than the bid sub-
mitted by Peterson of Madison, Wis-
consin, and Mr. Mead has not been
able to secure satisfactory assurance
of Peterson's ability to perform the
work.

Whereas C. W. Varner, contractor,
has submitted the lowest and best
bid for doing such work;
Be it therefore Resolved that the
contract for the drilling of an ar•
tesian well in connection with the
Eagle Point Pumping Station be
awarded to C. W. Varner, said con-
tractor to furnish the City of Du
buque with a surety bond in the sum
of $9,417.00 conditioned on the faith-
ful performance of said contract in

John Quinn addressed the Council
in behalf of the Dubuque Labor Con-
gress asking that action on letting
of the contracts for the pumping sta-
tions be deferred to give the Labor
Congress an opportunity to have a
delegation present, and state their
reasons therefore. He stated that
although James Gregory, who sub-
mitted the lowest bids, was con-
sidered fair to union labor, that one
of the contractors to whom Mr. Greg-
ory planned to sublet a portion of
the work, was unfair to union labor
in the eyes of organized labor
unions.
Councilman Brede moved that ac-
tion on the bids for the Pumping
Stations be postponed. Seconded
by Councilman Gabriel, Carried by

A communication from the Board
of Review to the City Council.
Dubuque, Iowa, March 29th, 1923.
To the Honorable O. E. Carr, City
Manager, and to the Honorable
Mayor and City Council.
Gentlemen: —The Board of Review
of the City of Dubuque for the year
1923, having completed our work as
equalizers of assessments for the
purpose of taxation, and having
viewed many sections of our city,
find that there is need of a revalua-
tion of the City lots and properties
in the City of Dubuque.
We and that it some sections the
established lot value is so high, that
the assessable valuation in some in
stances is even in excess of an
amount the property could not be
be sold for, while in other sections
the established lot value is so low
that almost the entire assessed val-
uation is placed upon the buildings.
We realize that since the Sommers
system was established in Dubuque,
many sections have been built up
and greatly improved, such localities
could stand an increase in lot values,
while other localities could stand a
reduction.
We believe that a re- establishment
of the values would mean a more
just and equitable taxation, giving
relief in some sections where needed
and increased in other sections
where values are too low.
Such a plan could be worked out
without increasing the general as-
sessment valuation of our city and
without increasing the amount of
money paid to the state.
We also believe that an appraisal
company with a scientific method of
appraisal would be perhaps best
qualified to superintend the work.
And they working in conjunction
with a representative committee
from Dubuque, could• formulate a
plan and establish lot values and
building values which would equalize
taxable properties and place the
properties of Dubuque en an equit-
able basis.
We therefore recommend that
your Honorable Body consider a re
appraisal of the City of Dubuque,
for the purpose of taxation.

station in accordance with plans and
specifications duly prepared and on

Whereas, C. W. Varner, contract-
or, has submitted the lowest and
best bid for the doing of said work:
Be it therefor resolved that the
contract for the drilling of an • ar-
tsian well in connection with the
Eagle Point Pumping station be
awarded to C. W. Varner, said con-
tractor to furnish the City of Du-
buque with a surety bond in the
sum of $9,417.00, conditioned on the
faithful perfomance of said contract
in compliance with the plans and
specifications and within the time
provided for therein:
Be it further resolved that the
Mayor be and he is hereby authoriz-
ed and directed to execute said cor.-
tract on behalf of said City of Du-
buque.
Be it further resolved that this
resolution and contract be placed on
file for public inspection for one
week before final action is taken

A Resolution
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sewer in
Air Hill street from Julien avenue
to West Eighth street, hereinafter
described has been completed and
the City Engineer has computed the
cost and expense of said improve-
ment amounts to $855.44;
Therefore be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of con-
structing a sewer in Air Hill street
from Julien avenue to West Eighth
street there be issued sewer bonds
to the amount of $855.44. Said bonds
shall be issued under the provisions
of Chapter 8, Title V of the Code of
Iowa and the amendments thereto,
shall bear date as of the 12th day of
July A. D. 1923, shall be in the de-
nominations of $100.00 each, except
that there shall be one bond to the
amount of $55.44; they shall be num-
bered from 8110 to 8118 inclusive,
and shall be divided into ten series
of which the bonds numbered 8110
shall constitute the first series; and
shall be payable on the first day of
April A. D. 1924; the bonds number-
ed 8111 shall constitute the second
series and shall be payable on the
first day of April A. D. 1925; the
bonds numbered 8112 shall constitute
the third series and shall be payable
on the first day of April A. D. 1926;
the bonds numbered 8113 shall con-
stitute the fourth series and shall
be payable on the first day of April
A. D. 1927; the bonds numbered
from 8114 shall constitute the fifth
series and shall be payable on the
first day of April A. D. 1928; the
bonds numbered 8115 shall consti-
tute the sixth series and shall be
payable on the first day of April A.
D. 1929; the bonds numbered 8116
shall constitute the seventh series
and shall be payable on the first day
of April A. D. 1930; the bonds num-
bered 8117 shall constitute the
eighth series and shall be payable
on the first day of April A. D. 1931;
the bonds numbered shall
constitue the ninth series and shall
be payable on the first day of April
A. D 19..; and the bonds numbered
8118 shall constitute the tenth se-
ries and shall be payable on the first
day of April A. D. 1932.
Said bonds shall bear interest at
the rate of 5 percent per annum
which interest shall be payable semi
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement. Both principal and in-
terest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

The City of Dubuque in the State

date at the option of the City the
sum of One Hundred Dollars with in-
terest thereon at the rate of 5 per-
cent per annum, payable on the pre-
sentation and surrender of the in-
terest coupons hereto attached.
Both principal and interest are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 8, Title V
of the Code of Iowa and amendments
thereto, and in accordance with a
resolution of the City Council of
said city, duly passed on the 12th
day of June A. D. 1923. This bond
is one of a series of nine bonds,
eight bonds in the sum of One Hun-
dred dollars numbered from 8110 to
8117 inclusive, and one bond in the
sum of Fifty -five dollars and forty -
four cents ($55.44) all of like tenor
and date, and issued for the Purpose
of defraying the cost of construct
ing a sewer in Air Hill street from
Julien avenue to West Eighth street
numbered 8118, and described in
said resolution, which cost is assess-
able and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five percent
per annum, and this bond is payable
only out of the money derived from
the collection of said special tag,
and said money can be used for no
other purpose.
And it is hereby certified and re-
cited that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque
are hereby irrevocably pledged.

struction of a building at Eagle
Point in connection with the Water-
works, said building to be known as
"Eagle Point Station Building," and
constructed In accordance with the
plans and specifications duly pre-
pared and on file, as amended, and,
Whereas, J. A. Gregory, contractor,
has submitted the lowest and best
bid for the doing of said work,
Be it therefore resolved that the
contract for the construction of
"Eagle Point Station Building," be
awarded to J. A. Gregory, said con-
tractor to furnish the City of Du-
buque with a surety bond in the
sum of $21,095.25, the same being
75 percent of the total contract
price, namely, to wit $28,127.00,
said bond to be conditioned on the
faithful performance of said con-
tract in compliance with the plans
and specifications as amended, and

Mayor Alderson read the call and
stated that service thereof had been
duly made and that the meeting was
called for the purpose of acting on
'he recommendations of the Consult-
ing Engineer on the purchase of wa-
ter works equipment and machinery
and on any other business that may
come before the meeting.
City Solicitor Czizek presented a
bill from the Clerk of the District
Court for costs and attorney fees in
the case of J. C. Scully et al vs the
City in the sum of $907.95, and re-
commended that the same be paid.
He also recommended that the award
of the District Court to J. C. Scully
et al in the sum of $4,750.00 and in-
terest of $203.60 be paid.
Councilman Brede moved that a
warrant be drawn in favor of M. J.
Grace, Clerk of the District Court,
for $907.95 covering the court costs
and attorney fees and that a warrant
in the sum of $2453.60, the difference
between the amount of the tlamages
as set by the Court and the amount
of the previous award, be drawn in
favor of Franzen, Bonson & Gilloon,
attorneys for J. C. Scully et al, sec-
onded by Councilman Gabriel, car-
ried by the following vote:

these pumps,

A Resolution
Whereas, the contract heretofore
entered into by the City of Dubuque,
for the improvement. of Glen Oak
street from the north line of West
5th street to the South line of .'ulien
avenue, hereinafter described has
been completed and the City Engi-
neer has computed the cost and ex-
pense of said improvement amounts
to 53,740.91;
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of improv-
ing Glen Oak street from the north
line of West 5th street to tho south
line of Julien avenue there be issu-
ed improvement bonds to the amount
of $3,740.91. Said bonds shall be is-
sued under the provisions of Chap-
ter 8, Title V of the Code of Iowa
and the amendments thereto, shall
bear date as of the 2Oth day of Ju-
ly A. D. 1923, shall be in the denom-
ination of $200.00 each, except that
there shall bo one bond to the
amount of $140.91; they shall be
numbered from 8119 to 8137 incl.,
and shall be divided into ten series
of which the bonds numbered 8119
to 8120 shall constitute the first ser-
ies; and shall be payable on the first
day of April A. D, 1924; the bonds
numbered 8121 to 8122 shall consti-
tute the second series and shall be
payable on the first day of April A.
D. 1925; the bonds numbered 8123 to
8124 shall constitue the third series
and shall be payable on the first day
of April A. D. 1926; the bonds num-

the 'tenth series and shall be pay-

Said bonds shall bear interest at
the rate of 5 percent per annum
which interest shall be payable semi-
. annually, in accordance w-th the
tonne of the coupons thereto attach-
ed; and said bonds shall be payable

ing the cost of improving Glen Oak
street from the North property line
of West 5th street to the south line
of Julien avenue. and described in
said resolution; which cost is asses-
sable and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install -
ments, with interest on all deferred
payments at the rate of five per cent
er annum, and this bond is payable
only out of the money derived from
the collection of said special tax,
and said money can be used for no
other purpose.
And it is hereby certified and recit-
ed that all the acts and condition
and things required to be done pre-
cedent to and in the issuing of this
series of bonds, have been done hap-
pened and performed in regular and
due form as required by said law
and resolution; and for the assess-
ments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
bugs a are hereby irrevocably pledg-
ed.
In witnecs whereof the City of
Dubuque by its City Council, has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-

said property is situated within the
boundary of the two additions or
sub - divisions known respectively as
Grandview Park and Grandview
Place. That the St. Joseph street
mentioned in this petition was origi-
nally a part of what was called Alt-
man avenue and its name changed
by the Ordinance changing the
names of various streets, adopted by
the City Council and officially pub-
lished on April 18, 1921. That all of
the various streets named in this pe-
tition as streets except St. Joseph
street were designated on the origin-
al plat as avenues but wore changed
from avenues to streets by the Ord-
inance above referred to.
Your petitioners further shows
that it owns all of tke property abut-
ting on either side of any and all of
said streets and alleys so asked to
be vacated. That the property so
owned by this petitioner and within
which said streets are situated is oc-
cupied and used by the Dubuque Golf
Club as a golf and Country Club and
was acquired and is hold tor that pur-
pose by your petitioner. That none
of said streets or alleys which it is
asked to have vacated have ever
been open for pt blic use or in any
way improved and they are not now
an never has a been used by the
public but constitute a part of the
golf course and Country Club prop-
erty above referred to. That none of
said streets and alleys so asked to
be vacated are necessary for the ac-
commodation of the public as streets
or thoroughfares and the various im-
provements of said golf and Country
Club extend over and across them
and they have for many years been
used for that purpose.
Your petitioners further request
for an exchange of property between
your petitioners and the City, and
the vacation of additional streets as
follows:
That Bradley street from the
westerly or northwesterly line of lot
20 in Grandview Place to the wester-
ly or northwesterly terminus, and
that part of St. Joseph street from
the northerly or northeasterly line
of Bradley street to a point 30 feet
southwesterly of the line of the alley
between Grandview avenue and
Bradley street, be vacated to your
petitioners, and that in exchange
therefore, your petitioners convey to
the City, lot 20 and the northerly or
northeasterly 30 feet of lots 21 and
22 in Grandview Place.

The effect of this would be to
change Bradley street so. that it
would turn at lot 20 in Grandview
Place and come out. into St. ,Joseph
street by way of the alley first,

which. is the. same width as the bal-
ance of the street.
Your petitioners own all of th
lots and land lying southerly or
southwesterly of the part of Brad-
ley street herein proposed to be va-
cated, and the lots on both sides of
th..t: part of St. Joseph street, herein
proposed to be vacated, and all of the
lots lying on the northerly or north-
easterly side of that part of Bradley
street proposed to be vacated, except

Said bonds shall be issued under
the provisions of Chapter 8, Title
V of the Code of Iowa and the
amendments thereto, shall bear date

be one bond to the amount of
$231.64; they shall be numbered
from 8138 to 8168 incl., and shall be
divided into ten series of which the

be payable on the first day of April

to 8143 shall constitute the second
series and shall be payable on the
first day of April A. D. 1925; the
bonds numbered 8144 to 8146 shall
constitute the third series and shall

ed 8159 to 8161 shall constitute the
eighth series and shall be payable on
the first day of April A. D. 1931; the
bonds numbered 8162 to 8164 shall
constitute the ninth series and shall
be payable on the first day of April
A. D. 1932, and the bonds numbered
8165 to 8168 shall constitute the
tenth series and shall be payable on
the first day of April A. D., 1933.
Said bonds shall bear interest at
the rate of 5 per cent per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment. Both principal and interest
shall be payable at the office of the
City Treasurer in the City of Du-
buque. Said bonds shall be sustan-
tially in the following form:

are hereby irrevocably pledged.

ed this bond to be signed by its May-

City Solicitor Czizek reported
verbally on the assessments of Josh.
L. Hird and Bertha Hird levied for
the improvements of Delhi street
and O'Hagan street, and recommend-
ed that the City accept from Jos. L.
Hird, assessment on lot 2 of Min-
eral lot 170 and lot 3 of Mineral lot
170 the sum of $200.00, and from
Bertha Hird on lot 4 of Mineral lot
170 the sum of $150.00, and on lots
38, 39, 40, 51, 52 and 53 Finley; Ma-
ples and Finley's add., $200.00, a
total of $550.00.
Councilman Gabriel moved that
the recommendation of the City So-
licitor be approved and the City
Treasurer be instructed to accept
the foregoing amounts in full of pay-
ment for the special assessments
levied against said property; second
ed by Councilman Schrempf. Car-
ried by the following vote:
Yeas — Councilmen Brede, Gabriel,
Melchior, Schrempf.
Nays —None.

City Solicitor Czizek reported
verbally and recommended that the
City pay Emmett Kirk the sum of
$150.00 claim for personal injuries
received by him in a fall upon an ice
covered sidewalk.
Councilman Gabriel moved that
the recommendation of the City So-
licitor be approved and the Auditor
be instructed to draw a warrant for
the sum of $150.00 in favor of Em-
mett Kirk, settlement in full for the
aforesaid claim; seconded by Cowl'
cilman Schrempf. Carried by the fo1-
lowing vote:
