CITY COUNCIL PROCEEDINGS
SPECIAL SESSION

The Dubuque City Council met in special session at 5:00 p.m. on May 19, 2021.
Due to the COVID-19 pandemic and mandates for social distancing, this meeting was
conducted virtually via GoToMeeting and aired live on CityChannel Dubuque (Mediacom
cable channels 8 and 117.2), streamed live on the City’s website at
www.cityofdubuque.org/media, and streamed live on the City’s Facebook page at
www.facebook.com/cityofdubuque.
Present: Mayor Buol; Council Members Cavanagh, Farber, Jones, Resnick, Roussell,
Sprank; City Manager Van Milligen, City Attorney Brumwell.
Mayor Buol read the call and stated this is a special session of the City Council called
for the purpose of adopting an ordinance replating the City’s Face Covering Requirement.
ACTION ITEMS
1. Repealing Code of Ordinances Section 6 -1-2 Face Covering Requirement: City
Attorney provided an ordinance that repeals City of Dubuque Code of Ordinances Section
6-1-2 Face Covering Requirement. Motion by Jones to receive and file the documents
and that the requirement that a proposed ordinance be considered and voted on for
passage at two Council meetings prior to the meeting at which it is to be passed be
suspended. Seconded by Farber. City Council expressed concern with the State’s recent
passage of legislation making it illegal for school districts to require face coverings in
schools but stated that the legislature’s decision will not change City Council’s decision
on the City’s Face Covering Ordinance. Motion carried 7 -0.
Motion by Jones for final consideration and passage of Ordinance No. 21-21 Amending
City of Dubuque Code of Ordinances Title 6 Health, Housing, Sanitation and Environment,
Chapter 1 Health and Safety Regulations, Section 2 Face Covering Requirement.
Seconded by Farber. Responding to a question from the City Council, City Clerk
Breitfelder stated that the ordinance will be published on May 20, 2021 and is therefore
the effective date of the ordinance. Motion carried 7-0.

ORDINANCE NO. 21-21
AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 6 HEALTH,
HOUSING, SANITATION AND ENVIRONMENT, CHAPTER 1 HEALTH AND SAFETY
REGULATIONS, SECTION 2 FACE COVERING REQUIREMENT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Title 6, Chapter 1 is amended by repealing Section 6 -1-2 Face Covering
Requirement.
Section 2. This ordinance shall take effect upon publication.
Passed, approved, and adopted this 19th day of May, 2021.
