Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
Jason Rauen, the applicant, spoke in favor of the request and noted the request would
allow for the purchase of additional land area to facilitate the grading for additional
parking area. There was no public input.
Planning staff detailed the staff report, noting the submitted plat is a simple subdivision,
but the lots are non -conforming due to not having street frontage on a platted street and
therefore required Commission review and approval. Staff noted in early 2021 the
Commission reviewed and recommended approval of the Final Plat of Cedar Ridge
Place No. 17 which transferred approximate 1.5 acres from Lot 1 to Lot 2. The proposed
plat No. 19 would transfer approximately .84 acres from Lot 1 to Lot 2. Staff noted no
new non -conformities or uses would be created by this subdivision.
Commissioners discussed the request and felt it was appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Final Plat of Cedar Ridge Farm Place No. 19 subject to waiving the lot
frontage requirement for Lot 1 and Lot 2.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE FINAL PLAT OF: CEDAR RIDGE FARM PLACE
NO. 19, CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Cedar Ridge
Farm Place No. 19, City of Dubuque, Dubuque County, Iowa;
Whereas, said Final Plat provides 0 feet of frontage for Lot 1 and Lot 2 on a
public or approved private street, where street frontage is required by Section 11-14 of
Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage on a public
street or an approved private street.
Section 2. That the Final Plat of Cedar Ridge Farm Place No. 19, City of
Dubuque, Dubuque County, Iowa is hereby approved, and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa
upon said Final Plat.

The submitted Final Plat of Cedar Ridge Farm Place No. 19 is a reconfiguration of Lot 1
and Lot 2, which are abutting lots. Lot 1 takes access at 3160 Cedar Cross Court and
Lot 2 takes access at 3197 Hughes Court. Both lots are legally non -conforming as neither
have street frontage on a platted street. With the proposed reconfiguration, this legally
non -conforming condition will remain unchanged for both properties.
Lot 1 and 2 were previously subdivided under the Final Plat of Cedar Ridge Farm Place
No. 17 which was reviewed by the Zoning Advisory Commission on September 9, 2020
and was approved by City Council on September 21, 2020. In that subdivision, 1.5 acres
of land was transferred from Lot 1 to Lot 2. The plat for that subdivision was recorded on
August 11, 2021. The image below shows the previously approved reconfiguration of Lot
1 and Lot 2.

DISCUSSION
The property owner of Lot 2 proposes to purchase approximately .84 acres of land from
the neighboring Lot 1 and consolidate it with their existing lot. Neither lot has the required
street frontage on a platted street and the proposed subdivision will not change this
condition. Lot 1 takes access from the property at 3160 Cedar Cross Court for which an
access easement is not necessary because that property and Lot 1 are under common
ownership. Lot 2 takes street access from a 24' wide easement across the property at
3195 Hughes Court.
Both lots are located across multiple zoning districts. Lot 1 is zoned LI Light Industrial
and R-1 Single -Family Residential. Lot 2 is zoned LI Light Industrial, R-1 Single -Family
Residential, and AG Agricultural District. If the subdivision is approved, the zoning
districts on each property will remain as -is. If any expansion of existing uses of the lots
were to expand outside the permissible zone in which they are currently located, a
rezoning request would be required.

Portions of the northern property line of both Lot 1 and Lot 2 are positioned at the base of
the bluff above and are in zone AE of the Catfish Creek floodplain. Any fill or development
of this portion of either lot will require that a flood plain permit be approved by the Iowa
Department of Natural Resources.
As requested, the proposed lot line adjustment will have little effect on the status of the
subject lots or surrounding properties. Except for the required lot street frontage, which
is an existing condition, the submitted Final Plat of Cedar Ridge Farm Place No. 19
complies in all other respects with the City of Dubuque's subdivision regulations contained
in the Unified Development Code.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Cedar Ridge Farm Place No. 19 and recommends approval as submitted subject to
waiving the lot frontage requirement for Lot 1 and Lot 2.
