Assistant Chief of Police Jeremy Jensen recommends City Council approval of the
School Resource Officer (SRO) and DARE Contracts between the City of Dubuque and
the Dubuque Community School District (DCSD) for the CY 2021-2022 school year.
The contracts were part of the August 9, 2021 DCSD School Board's meeting and
passed by a 7-0 vote.
Additionally, the role of SRO's is being reviewed across the country as cities explore
equity concerns, and Dubuque is no different. The SRO role in the DCSD was brought
up as a topic during the summer of 2020 Black Live Matter presentations to City Council
and a committee has been meeting for these discussions. The committee is being
facilitated by the City's Human Rights Department's Kelly Larson and Collins Eboh. The
committee is made up of two representatives of the Dubuque Police Department's
(DPD) SRO program, two DCSD administrative staff, the DCSD's Equity Director, and
seven representatives from community advocacy groups. To date they have
established a set of shared values to "test" any final recommendations against,
reviewed and discussed national SRO studies, DCSD policy, DPD SRO job description,
and SRO training among other topics. The DPD reps have also provided the committee
with data from the last two school years and this data review will be the primary agenda
topic for the next few months. It is hoped that the committee will present any
recommendations in early CY2022.
Any recommendations from the committee would need review by both City and DCSD
officials and could potentially be part of contract changes in subsequent years. Until
that time, the DCSD and City's SRO contract will remain virtually the same as the most
recent contract.
The longstanding partnership between the City, Dubuque Police Department, and the
Dubuque Community School District remains strong for providing the safest learning
environment possible for Dubuque's children, and the district's staff. The current
contract provides for continuation of the existing levels of services for the current school
year. Subsequent years will hopefully show the continuation of the expansion plan as
well as any recommendations from the committee to improve equity.

INTRODUCTION
This memo will discuss the finalization of the School Resource Officer (SRO) and DARE
Contracts between the City of Dubuque and the Dubuque Community School District
(DCSD) for the CY2021-22 school year.

The City of Dubuque (City) and the Dubuque Community School District (DCSD) have
partnered for decades for Dubuque Police Department (DPD) SRO's in the district's
schools. In FY2019 and prior years, there were 4 SRO's and 1 DARE Officer. After
many years of discussions, the City and the DCSD agreed to expand the SRO program.
Beginning in FY2020, the parties agreed to expand the SRO program by adding three
additional SRO's between FY2020 and FY22. When the expansion is completed, the
DARE Officer would be known as an SRO, and there would be a total of 8 SRO's, with
one assigned to each middle school and each high school, a supervisor who splits
elementary school duties with another SRO, and an SRO whose primary function is the
DARE curriculum but also available for general SRO duties. A new agreement was also
created for reimbursement schedules, with the DCSD incrementally picking up a greater
share of the expenses with a final arrangement of a 50/50 split between the parties.
The first expansion SRO was put in place at the start of FY2020. At the start of FY2021,
the nation was in the midst of the Covid-19 pandemic and the DCSD fluctuated between
closed, virtual, and hybrid education. This combined with DPD personnel shortages
resulted in this second position not being filled. Because of the delay, it was also
decided to push back the third SRO to FY2023. The City has accordingly only sought

reimbursement for the actual expenses for the existing SRO's, and not for any unfilled
positions.
The City and DCSD enter into annual contracts for reimbursement based on previously
agreed upon rates based on the expansion. The annual contracts for SRO and DARE
for the FY2021-22 school year are up for renewal. Based on DCSD preference, even
though the former DARE Officer is now considered an SRO, the district prefers to keep
DARE as a separate contract.
Shirley Horstman, DCSD Executive Director of Student Services, reports that the two
contracts were presented at the August 2, 2021 DCSD School Board's
Facilities/Support Services subcommittee, which approved the contracts with minimal
discussion and passed them on to the full School Board for approval. The contracts
were part of the August 9, 2021 DCSD School Board's meeting Consent Agenda and
passed by a 7-0 vote.
With the DCSD in agreement on the contracts, the contracts now await the City's
agreement and signatures.

DRUG ABUSE RESISTANCE EDUCATION COOPERATIVE PROGRAM
FOR
SCHOOL YEAR 2021-2022
This Agreement, executed in triplicate, is entered into this 9t" day of July 2021, by
and between the City of Dubuque, through its Police Department (City), and the
Dubuque Community School District (School District).
WHEREAS, City and School District have a strong desire and commitment to
reduce and prevent substance use among school children of the Dubuque community
through the continued implementation of the Drug Abuse Resistance Education
Cooperative Program (D.A.R.E. Program); and
WHEREAS, City presents D.A.R.E. Program to schools within the School District;
and
WHEREAS, School District desires to present D.A.R.E. Program at schools
within School District.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS
FOLLOWS:
1. Designated Schools. City will present the D.A.R.E. Program to Thomas
Jefferson, Eleanor Roosevelt, and George Washington Middle Schools.
2. Term. The term of this Agreement is from August 24, 2021 through June
15, 2022.
3. D.A.R.E. Program.
A. City will provide a ten (10) week D.A.R.E. Program that will teach
children at Thomas Jefferson, Eleanor Roosevelt, and George
Washington Middle Schools life skills and resistance techniques to better
prepare the children to resist the pressure to use drugs. The D.A.R.E.
Program will be taught by specially trained officers and the curriculum will
be designed to give students learning experiences through audio, visual,
and kinesthetic learning modalities, utilizing role playing and role modeling
as reinforcement tools.
B. City will spend informal time with the students during recess and
lunch to build rapport and encourage interaction.
C. City will provide a graduation program for those students
successfully completing the D.A.R.E. Program.
D. City will provide a Parent Training Program at least one (1) hour in
length. The Parent Training Program will provide an overview of the
D.A.R.E. Program, address parenting skills, identify some of the common
drugs used in Dubuque, and address gang concerns/prevention.
E. City will provide all D.A.R.E. Program materials and supplies,
including workbooks, graduation materials, and information packets, with
the exception of some art supplies used for some follow-up assignments.
4. Evaluation. City, in cooperation with School District, will provide evaluation
of the D.A.R.E. Program. Such evaluation will be available to School District and
City. City will provide feedback to the school staff and School District, and School
District will provide feedback to City.
5. D.A.R.E. Program Location.
A. School District will provide the premises and classroom time required for
the proper implementation of the D.A.R.E. Program. Premises will include the 6th
and 8th grade classrooms, other classrooms as agreed upon, the gym as
required, and other such premises as needed for student/parent education in
regard to the D.A.R.E. Program.
B. Classroom time. Classroom time (45-60 minutes) will be allotted for the
middle school curriculum class in each school. School District will further allow
City to use the furniture and equipment contained in the areas defined above and
other equipment such as audio visual equipment.
6. Consideration. School District will provide financial support to City for use
in implementing the D.A.R.E. Program in the amount of Six Thousand Three
Hundred Twenty Dollars ($6,320.00) as follows.
A. City will invoice School District by November 15, 2021.
School District will pay City by December 15, 2021.
Amount due is 50% ($3,160.00) of contract.
B. City will invoice School District by March 15, 2022.
School District will pay City by April 15, 2022.
Amount due is 50% ($3,160.00) of contract.
7. Termination. Any party may terminate this Agreement for any reason by
providing written notice of intent to terminate this Agreement to the other party

not less than ten (10) days prior to the beginning date of each semester of the
school year.
8. Compliance with applicable Laws. City and School District will not engage
in discriminatory hiring or any other employment practices that conflict with any
local, state, or federal laws.
9. Insurance and Indemnification.
A. City must maintain its membership in the Iowa Communities
Assurance Pool and add School District as an Additional Member. If City
discontinues its membership in ICAP, City will provide proof of a similar
policy of commercial general liability form coverage not less than
$2,000,000 naming School District as an additional insured on a primary
and non-contributory basis.
B. School District must provide proof of a policy of commercial general
liability form coverage not less than $2,000,000 naming City as an
additional insured on a primary and non-contributory basis.
C. City will indemnify and hold School District, its staff, and students
harmless from and against any and all claims, liability, and causes of
action arising from or related to the City's negligence in the performance
of this Agreement and the negligence of City's officers, agents, or
employees.
D. School District will indemnify and hold City harmless from and
against any and all claims, liability, and causes of action arising from or
related to the School District's negligence in the performance of this
Agreement and the negligence of School District's officers, agents, or
employees.

This Agreement, dated for reference purposes the 9th day of July, 2021, is made
and entered into by and between the City of Dubuque, through its Police Department
(City) and the Dubuque Community School District (School District).
WHEREAS, School District and City have a strong desire and commitment to
continue the services of the School Resource Officers (SRO); and
WHEREAS, it is necessary to define the roles of the parties in providing such
services to the elementary, middle, and senior high schools.
NOW, THEREFORE, it is agreed by and between the parties as follows:
SECTION 1. ROLE OF SRO.
1.1 Five (5) SRO will be assigned by City to School District. SRO will, at the sole
direction of the Chief of Police:
(a) Act as liaison between the law enforcement community and the School
District;
(b) Maintain campus awareness, identify imminent problems, and serve as
safety consultants for the School District;
(c) Visit classrooms;
(d) Make presentations and answer questions;
(e) Instruct D.A.R.E. (Drug Abuse Resistance Education Cooperative
Program) curriculum;
(f) Inform school officials and staff of current police involvement with students
and/or student's families;
(g) Investigate appropriate cases involving students as victims or suspects
except those cases handled by a specialized unit;

(h) Assist with prevention patrol for students en route to and from school;
(i) Take appropriate action with respect to on -site occurrences, including but
not limited to, fights, vandalism, theft, accidents, traffic violations, disorderly
conduct, narcotics offenses, weapons, unauthorized persons on school property,
and other occurrences as appropriate;
0) Assist with in -servicing other School District security staff;
(k) Interact with patrol and investigative divisions on matters of mutual
concern, including but not limited to, indecent exposure, gang activity, traffic
hazards, sex offenses, suspicious persons, and other matters as appropriate;
(1) Attend School District staff and faculty meetings and training sessions
when requested;
(m) Act as a resource person to School District staff;
(n) Attend School District sponsored extra -curricular activities when
requested;
(o) Interact with students to promote and reinforce basic life skills, self-control,
and accountability;
(p) Maintain confidential records on student contacts;
(q) Maintain working knowledge of Dubuque Community School Board
policies, School District Administrative Regulations and Student Handbooks; and
(r) Conduct other duties as approved or assigned by the Chief of Police.
1.2 The hours and work day of SRO will be determined by the Chief of Police based
on School District building schedules and extra -curricular activities. Uniforms will be
worn at the discretion of SRO and the Chief of Police.

Personnel and Support costs reflect the same staffing levels as 2020-2021. A planned
expansion of the School Resource Officer program, SRO #7 and Initial Training funding
and support of the next SRO position may occur in the 2021-2022 school year but will
depend on other departmental staffing. SRO#8 will be delayed until at least City of
Dubuque Fiscal Year 2023. SRO#5 and SRO#6 are existing positions which will
eventually be funded at 50%. Position equipment is specific to the SRO position, and
support costs includes personal equipment and transportation costs, all of which are
suspended for this year due to the City of Dubuque freezing hiring due to COVID. The
Ongoing Training funds supports training for all existing SRO positions; however,
training is frozen by the City of Dubuque for this fiscal year due to COVID.
School District will pay to City fifty percent (50%) of the salary of four (4) SRO's,
seventy-five percent (75%) of fifty percent (50%) of the SRO Supervisor and seventy-
five percent (75%) of fifty percent (50%) of the DARE SRO Officer, in the total amount
of Three Hundred Thousand, Six Hundred Thirty -Six dollars ($300,636), payable as
follows:
(a) City will invoice to School District by November 15, 2021.
School District payment to City by December 15, 2021.
Amount due is 50% of the Agreement ($150,318.00)
(b) City will invoice to School District by March 15, 2022.
School District payment to City by April 15, 2022.

SECTION 3. TERMINATION. School District or City may cancel this Agreement by
giving the other party not less than thirty (30) days written notice of intent to cancel.

However, under emergency or exigent circumstances, either party may cancel this
Agreement by giving the other party not less than ten (10) days written notice.
SECTION 4. TERM. The term of this Agreement is from August 24, 2020, through
June 15, 2021.
SECTION 5. APPLICABLE LAWS. City and School District will not engage in
discriminatory hiring or any other employment practices that conflict with any local,
state, or federal laws.
SECTION 6. INSURANCE AND INDEMNIFICATION.
6.1 City must maintain its membership in the Iowa Communities Assurance Pool and
add School District as an Additional Member. If City discontinues its membership in
ICAP, City must provide proof of a policy of commercial general liability form coverage
