INTRODUCTION
The purpose of this memo is to provide information for your review and approval of a
change in the project completion date change for the Phase-2 Water Main Extension
project within Tamarack Park located on HWY 151/61.
BACKGROUND
In 2016, the City installed water and sanitary sewer lines to the Dubuque Regional
Airport. The 2016 project plans included the installation of water main to Tamarack
Park Development.
However, solid rock was encountered at the proposed crossing to Tamarack Park and
the water line was not constructed at that time. In 2018 with the Tamarack Park
Development (Jon Luckstead) signed agreement for City Water Service, the first phase
of the water main extension to the subdivision was fulfilled in January of 2019.
As per the signed agreement, within (2) years of the Owner's written request, the City
would implement Phase-2 which would consist of installing a standard water distribution
system located in the frontage road of the Real Estate as shown in the attached Exhibit
C (black color lines are 12" and 16" water main).
DISCUSSION
A request was received from Mr. Jon Luckstead in September of 2019 to initiate Phase-
2 of the water main installation south along the Tamarack Business Park frontage road.
Engineering work on the construction plans began in the Spring of 2021, however they
were experiencing delays obtaining the easements necessary to carry out the work
contemplated under the Agreement.
Discussions were held with Jon Luckstead regarding easement delays and Jon agreed
with revising the project completion date to be set for on or before May 31, 2023.
REQUEST
I respectfully request approval and execution of the Amendment to Pre -Annexation
Agreement between The City of Dubuque, Iowa and Joh D. Luckstead to revise the project
completion date to be set for on or before May 31, 2023

This AMENDMENT TO THE PRE -ANNEXATION AGREEMENT BETWEEN THE
CITY OF DUBUQUE, IOWA AND JON D. LUCKSTEAD is dated for reference purposes
this 5th day of con+�beF 2021.

WHEREAS, the City of Dubuque (City) and Jon D. Luckstead (Luckstead) are
parties to a Pre -Annexation Agreement (the Agreement) dated for reference purposes the
171" day of October 2016; and
WHEREAS, the parties are experiencing delays obtaining the easements
necessary to carry out the work contemplated under the Agreement; and
WHEREAS, the parties desire to amend the Agreement as set forth herein:
Section 6.2 is amended to read as follows:
On or before May 31, 2023, City will implement a standard water distribution
system (System) located in the frontage road of the Real Estate as shown in the
attached Exhibit C (black color lines are 12" and 16" water main). This System is
capable of providing standard fire protection with future domestic and fire sprinkler
service. City will install and pay for this water main on Tamarack Park Drive (future
front road). Owner will provide and dedicate to City a twenty (20) feet public utility
easement centered on this water main for the installation and future maintenance
of the water main. City will own and maintain the Tamarack Park Drive water main.
2. All other provisions of the Agreement shall remain in full force and effect.
