INTRODUCTION
The purpose of this memorandum is to establish the date for the public hearing of
October 18, 2021 for the establishment of the Final Schedule of Assessments for 1951
W. 32nd Street for a water service connection charge.
DISCUSSION
The property owner of 1951 W. 32nd Street contacted the Water Department to make
connection to the city water system. The property is currently on a well that is failing.
The property owner would like the City to assess him for the water connection fee. The
water connection fee is calculated by taking the front footage of the lot and multiplying it
by the per foot connection charge. The charge is calculated as follows:

The property owner will work with a local plumber to make connection to the water
main. Assessing the property owner allows the property owner to get off of a failing well
and for the City to start receiving water revenues from this property.
The property owner has signed a voluntary assessment agreement and waived
publication and mailed notice. However, a public hearing is required by state code.
SPECIAL ASSESSMENTS
Special assessments may be paid in full or in part without interest at the City of
Dubuque, Office of the City Treasurer. After approximately 30 days, any unpaid
assessment will be levied against said benefited property with the Dubuque County
Treasurer and any balance over $500 will be payable in 15 annual installments at the
County Treasurer's Office, and will draw annual interest at three percent (3%).
REQUEST
I respectfully request that the City Council establish October 18, 2021 as the date of the
public hearing for the establishment of the Final Schedule of Assessments for 1951 W.
32nd Street for a water service connection charge.

SETTING A PUBLIC HEARING ON THE VOLUNTARY ASSESSMENT
AGREEMENT FOR WATER CONNECTION FEE FOR 1951 W. 32ND STREET
WHEREAS, Terry and Connie Hackbarth (Hackbarths'), the owners of 1951
W. 32nd Street, approached the City about connecting to the City of Dubuque water
system; and
WHEREAS, the Hackbarths' home is currently on a well which is failing; and
WHEREAS, the Hackbarths' requested to do a voluntary assessment to
cover the water connection fee associated with the connection of their property to
the City water system; and
WHEREAS, a connection can be made to the City water system by the
Hackbarths' to provide their property with a safe and reliable source of water; and
WHEREAS, the City is agreeable to connecting the Hackbarths' to the City
water system; and
WHEREAS, the City is agreeable to doing a Voluntary Assessment
Agreement for the Water Connection Fee; and
WHEREAS, the Hackbarths' have waived the requirements for published
and mailed notice of the public hearing; and
WHEREAS, the proposed Voluntary Assessment Agreement, are hereby
preliminarily approved and ordered filed in the office of the City Clerk for public
inspection, and
WHEREAS, a public hearing is required by state code on the assessment.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City Council shall conduct a public hearing on the
proposed Voluntary Assessment Agreement in the City Council Chambers at the
Historic Federal Building, 350 W. 6th Street, Dubuque, Iowa on the 18th day of
October 2021 beginning at 6:30 p.m. at which time the owners of property subject
to assessment or any other person having an interest in the matter may appear
and be heard for or against entering into the Voluntary Assessment Agreement.
A property owner will be deemed to have waived all objections unless at the
time of hearing the property owner has filed objections with the City Clerk.

Dear Resident:
This letter is in response to your recent request to get
connected to the City's public water system. Currently, the
City of Dubuque collects a water connection fee for any city -
funded water main installations, past and present. The water
main along W. 32nd St. was funded, installed or maintained by
the City Water Department to function as a transmission main from the Eagle Point Water Plant to serve the
Water Department

citizens of Dubuque. However, a portion of the cost must be paid by property owners who wish to be served by
the municipal water supply.
As per City Ordinance, this cost or connection fee is calculated by multiplying the property footage that is
adjacent to the water main by the current front footage fee. Your Property footage along W. 32nd St. and
adjacent to the water main is 249.62 feet. The prevailing front footage fee is currently $28.00/lineal foot.
Therefore, your total connection fee equals 249.62 feet X $28.00/lineal foot or $6,989.36. This amount can be
assessed to your property taxes. City approval for a voluntary assessment charge will be required before
completion of a water connection can be made on the public water main.
This water connection fee is 100% assessable to the property being served. This means, if you choose to make
a connection to the public water system, the water connection fee will be 100% your responsibility. Enclosed is a
Preliminary Voluntary Assessment Form that authorizes the City to enter into contracts for the improvements to
benefit your property. Please note, this a preliminary assessment only. The Final Notice of Voluntary
Assessment will be mailed after the project is complete.
Assessments may be paid in full or in part without interest within 30 days of receiving the Final Notice of
Voluntary Assessment. After 30 days, the remaining balance will be transferred to the County Treasurer's office
to be collected in the same manner as the owner's property taxes. In cases where the remaining balance is
$500 or more, the remaining balance may be financed over a period of 15 years at 3% interest.
