Masterpiece on the Mississippi To: Micha n Milligen, City Manager David Rohs Housing and Community Development Department a g y artment p p Subject: CDBG FY 2011 Annual Action Plan Amendment 1 Date: June 17, 2010 Dubuque bitZt *NM c y 1 2007 INTRODUCTION The purpose of this memorandum is to request the City Council's approval of the attached resolution approving an amendment to Fiscal Year 2011 Annual Action Plan for the City's Community Development Block Grant (CDBG) program. This amendment is needed to reflect the increase in the CDBG entitlement allocation for FY 2011. DISCUSSION The U.S. Department of Housing and Urban Development (HUD) regulations require that each year a city must prepare and file an Annual Plan prior to receipt of its CDBG entitlement. The Annual Plan is adopted following a public participation process that includes a published notice, a public comment period, and a public hearing. A city must follow its adopted plan as it expends entitlement funds. If its revenues or activities change, the city must amend. The City Council approved a FY 2011 Annual Action Plan for CDBG funds on March 9, 2010 as part the City budget. Subsequently we were notified by the U.S. Department of Housing and Urban Development (HUD) that the allocation for FY 2011 was $1,344,084, a $107,824 increase in anticipated funding over the approved FY 2011 Annual Plan. The following changes are being proposed to the FY 2011 Annual Plan: Fund Multicultural Family Center 2 Floor Expansion ($76,259): The MFC was completed in September 2009 with the assistance of $475,780 in CDBG funds. 720 adults and 350 youth are currently registered at the MFC and use the Center for numerous activities and programs. The $76,259 in CDBG funds would be used in conjunction with other undetermined funds to expand the center onto the second floor for additional meeting area for programming. Grants and other funds are being pursued to cover the anticipated $600,000 cost. - Increase Neighborhood Infrastructure Improvement Program by $10,000 ($50,000): The program currently is allocated $40,000 in FY 2011 for three activities- street overlays and step /wall repair in low /moderate income areas and sidewalk assistance for low /moderate income homeowners. $20,000 has been designated for street overlays and $20,000 for sidewalk assistance. The additional $10,000 is proposed for sidewalk assistance. In addition, the amendment would adjust the assistance provided based on the percentage of the homeowner's area median income (30 %, 50% or 80% AMI), with greater assistance being provided to those with less income. This would allow us to extend program benefits to more homeowners, while not increasing the costs of the program. Increase Planning Administration by $21,565 ($89,789) The Citizen Participation Plan requires a 30 -day comment period prior to the public hearing, which commences with the publication of a notice in the Telegraph Herald on May 13, 2010 and on the City website. The Community Development Advisory Commission held a public hearing on June 16, 2010. Tara Velez and Dana Livingston spoke about the need for additional program space at the Multicultural Family Center. The Commission reviewed and discussed the funding changes, voted to approve the attached amendment and recommended City Council approval. RECOMMENDATION I recommend that the City Council approve the above - described FY 2011 (Program Year 2010) Annual Action Plan- Amendment 1 for the use of CDBG funds. ACTION STEP The Action Step is for the City Council to adopt the attached resolution. Whereas, the City of Dubuque approved a Fiscal Year 2011 Annual Action Plan on March 9, 2010 by Resolution No. 72 -2010; and Whereas, the City now desires to amend said Fiscal Year 2011 Annual Plan to reflect the increased Fiscal Year 2011 CDBG allocation as per the attached Exhibit A; and Whereas, the City of Dubuque now proposes to amend the Neighborhood Infrastructure program to adjust the sidewalk assistance eligibility requirements as per the attached Exhibit B; and Whereas, said amendment is a substantial amendment as provided in the City's Citizen Participation Plan and therefore must be approved by resolution of the City Council after a public hearing by the Community Development Advisory Commission; and Whereas, the City advertised a 30 day public comment period beginning May 13, 2010; and Whereas, the Community Development Advisory Commission reviewed the proposed amendment at a public hearing on June 16, 2010, and has voted to approve said amendment and to recommend approval by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Fiscal Year 2011 Annual Action Plan (Program Year 2010) Amendment 1 for the Community Development Block Grant (CDBG) program hereto attached as Exhibits A and B is hereby approved. Section 2. That the City Manager is hereby authorized and directed to submit a copy of this resolution and Plan to the U.S. Department of Housing and Urban Development.
