Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's land surveyor, Dave Schneider, spoke in favor of the request, describing
the parcel and land and its agricultural use. He explained that the property owner of Lot
2 has negotiated purchase of a portion of Lot 1, and the subsequent plat is coming
before the commission because it is within the City's two-mile extraterritorial jurisdiction.
He also noted the new Lot 1 will no longer have the require 50' of street frontage along
Lake Eleanor Road. He explained access to the lot will remain the same and continue
to be over the adjoining property to the north.
Staff reviewed the staff report, noting the submitted Plat of Survey of Rolling Hills Farm
No. 2 would transfer lot area from Lot 1 to Lot 2. Prior to subdividing the property, both
properties have frontage along Lake Eleanor Road, however with approval of the plat,
Lot 1 would lose frontage.
There were no public comments.
The Zoning Advisory Commission discussed the request finding it appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE FINAL PLAT OF ROLLING HILLS FARM
SUBDIVISION PLAT 2, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Rolling Hills Farm
Subdivision Plat 2, Dubuque County, Iowa that is within the City's 2-mile extraterritorial
jurisdiction; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Final Plat of Rolling Hills Farm Subdivision Plat 2, Dubuque
County, Iowa is hereby approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat of
Survey.

INTRODUCTION
The submitted Rolling Hills Farm No. 2 Final Plat is located in Dubuque County off of
Lake Eleanor Road, within the City's extraterritorial jurisdiction boundary. The proposed
subdivision is a reconfiguration of two existing parcels. Lot 1 is currently a total of
approximately 11.16 acres and Lot 2 is currently a total of approximately 26.98 acres, and
both lots currently have frontage along Lake Eleanor Road. The existing configuration is
shown in the image directly below.

The proposed reconfiguration would reduce Lot 1 to 6.53 acres and increase Lot 2 to
31.61 acres. The proposed reconfiguration would create a non -conforming condition for
Lot 1 in that the lot will no longer have street frontage on Lake Eleanor Road. The
proposed plat indicates the reconfigured Lot 1 will take access to Lake Eleanor Road over
and across Lot 36 and Lot 2 of Lot 37 of Wilson's Subdivision of Foley's Grove which is
located to the north of the Lot 1 and is under the same ownership as Lot 1.

DISCUSSION
The property owner of Lot 2 proposes to purchase approximately 4.63 acres of land from
the neighboring Lot 1 and consolidate it with their existing lot. Currently both Lot 1 and
Lot 2 take access directly from Lake Eleanor Road. The proposed subdivision will
eliminate the direct access for Lot 1 which would create a non -conforming lot with regards
to street frontage on a platted street. The plat does indicate Lot 1 will have access to
Lake Eleanor Road through neighboring lots to the north which are under the same
ownership.
Both lots are located in the Dubuque County R-2 Single -Family Residential District. Lot
1 is not improved with any structures but appears to have some agricultural fields, and
Lot 2 is improved with a single-family home and accessory structures and a portion of the
site also appears to be utilized for agriculture. If approved, the zoning district for both lots
would remain as -is.
As requested, the proposed lot line adjustment will have little effect on the status of the
