SUBJECT: Acceptance of Public Improvements for South Heacock Road Cul-De-Sac
from Walter Development, LLC
DATE: October 8, 2021
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Walter Development, LLC, has recently completed on South
Heacock Road in Dubuque Industrial Center West.
As part of a recent Development Agreement by and among the City, Walter
Development LLC, and Duluth Holdings, Inc., Walter Development, LLC, was required
to construct a short public street and cul-de-sac which intersects with Chavenelle Road
in the Dubuque Industrial Center West. The street will provide access from the
Walter/Duluth building site to Chavenelle Road and in the future provide a connection
from Chavenelle Road to Pennsylvania Avenue/Middle Road.
As a condition of agreement, the developer was required to install certain public
improvements including street paving with longitudinal subdrain and concrete curb and
gutter, accessible sidewalk ramps, concrete sidewalks, a paved cul-de-sac, storm
sewers and catch basins, street lighting, and fiber optic conduit and to dedicate said
improvements to the City upon completion.
Per the development agreement, after inspection and approval, the improvements will
be owned and maintained by the City.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
that the developers, Walter Development, LLC, have recently completed on South
Heacock Road in Dubuque Industrial Center West.
BACKGROUND

DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the developer shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On October 5, 2021, the owners requested City's acceptance of the public
improvements on South Heacock Road. Upon inspection by the City, it has been
determined that the public improvements required by the development agreement have
been completed in accordance with plans approved by the City and in conformance with
City specifications.
Per the development agreement, after inspection and approval, the improvements will
be owned and maintained by the City.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
described above.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements on South Heacock Road.

RESOLUTION NO. 352-21
ACCEPTING PUBLIC IMPROVEMENTS ON SOUTH HEACOCK ROAD, IN THE CITY
OF DUBUQUE, IOWA
Whereas, pursuant to a development agreement with Walter Development, LLC
dated April 6, 2020, certain public improvements including street paving with longitudinal
subdrain and concrete curb and gutter, accessible sidewalk ramps, concrete sidewalks,
a paved cul-de-sac, storm sewers and catch basins, street lighting, and fiber optic conduit
were installed by the Walter Development, LLC on South Heacock Road; and
Whereas, the public improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City and in conformance with
City specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public improvements on South Heacock Road, be and the same is hereby accepted.
Section 2. Per the development agreement, the City assumes ownership and
maintenance of the public improvements.
