City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Dillon Street Drain Tile Project 2021, as completed by Drew Cook & Sons
Excavating Company, Inc., in the final contract amount of $59,756.48, which is an
increase of 11.9% over the original contract amount of $53,377.50. The increase was
due to additional topsoil, concrete and stone base required to complete the work..
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Dillon Street Drain Tile Project 2021.
BACKGROUND
The Dillon Street Drain Tile Project 2021 provided for the installation of approximately
945 linear feet of 6-inch solid drain tile and 4-inch perforated drain tile, two single grate
stormwater intakes were also replaced, approximately 665 linear feet of curb and gutter,
driveway approaches and sidewalk replacement in impacted areas. This project allowed
for private property tie-ins to the drain tile to prevent future icing and storm water issues.
The asphalt street patching was done by the Public Works Department.
DISCUSSION
The Dillon Street Drain Tile Project 2021 was completed by Drew Cook & Sons
Excavating Company, Inc. of Dubuque, IA in the final contract amount of $59,756.48.
This is a 11.9% increase over the original contract amount of $53,377.50. The increase
was due to additional topsoil, concrete and stone base required to complete the work.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $59,756.48 to Drew Cook & Sons Excavating Company, Inc.
of Dubuque, IA for the Dillon Street Drain Tile Project 2021.

REQUESTED ACTION
I recommend that the City Council adopt the attached resolution to accept the
improvements and authorize the final payment of the contract amount of $59,756.48 to
Drew Cook & Sons Excavating Company, Inc. for the Dillon Street Drain Tile Project
2021.

RESOLUTION NO. 353-21
ACCEPTING THE DILLON STREET DRAIN TILE PROJECT 2021 AND AUTHORIZING
THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Dillon Street Drain Tile Project
2021, (the Project) has been completed by the Contractor, Drew Cook & Sons Excavating
Company, Inc. (Contractor), the City Engineer has examined the work and recommends
that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $59,756.48; and
WHEREAS, the Contractor has previously been paid $56,768.66, leaving a
balance of $2,987.82; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $2,987.82 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code
chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the Dillon Street Drain Tile Project 2021 has been performed in
compliance with the terms of the Public Improvement Contract, and that the total cost of
the completed work is $68,719.95.
