The enclosed resolutions request preliminary approval to the Resolution of Necessity,
approve the Preliminary Schedule of Assessments, and establish the date of the public
hearing for the 2022 John F. Kennedy Road Sidewalk Installation Project between Asbury
Road and the NW Arterial.
BACKGROUND
Since 1999 there have been discussions in the community concerning sidewalks along
John F. Kennedy Road between Asbury Road and the NW Arterial. Numerous petitions
were received both for and against the installation of sidewalks. At the July 2, 2018, City
Council meeting, the city council voted 5-2 to proceed with the installation of sidewalks with
City staff directed to proceed with the development of a sidewalk installation project and
use special assessments to fund the project. In October 2018, the project failed to get the
required unanimous support from the City Council, failing on a 5-2 vote.
At their May 17, 2021, meeting the City Council unanimously agreed City staff provide the
council with an updated John F. Kennedy Road sidewalk project. This is the fourth time the
John F. Kennedy sidewalk installation issue has been presented to the City Council for
consideration. The other times that the City Council considered JFK sidewalks was July of
1999, December of 2007, and October of 2018.
The project was brought to the City Council for consideration on June 7, 2021. The project
was approved to have plans developed and go to bidding. At the July 6, 2021 City Council
meeting, city staff requested the bidding process stop in order to pursue a Transportation
Alternatives Program (TAP) grant. The grant can be used for Safe Routes to School
projects, of which this project qualifies.
In July 2021 the City of Dubuque was notified it will receive a $190,000 grant to be used
toward a Safe Routes to School project on John F. Kennedy Road.
Additionally, Community Development Block Grant funds will be used to provide financial
assistance to owner occupied homes that meet income guidelines for low/moderate
income.
DISCUSSION
The John F. Kennedy Road Sidewalk Installation Project would provide installation of 4-
foot-wide sidewalks along John F. Kennedy Road on both sides of the street from Asbury
Road to the NW Arterial adjacent to abutting properties that do not currently have sidewalks
and would include the following elements:
— Excavation to allow for the installation of the sidewalk
— Installation of base stone for the sidewalk
— Installation of 4" thick public sidewalk in most areas
— Installation of 6" thick sidewalk at driveway crossings
— Installation of retaining walls where needed due to topography to accommodate the
sidewalk.
— Restoration of disturbed area with topsoil and seed.
As a result of going through the federal aid process, engineering costs and construction
costs are expected to increase. This increase in construction costs is due to federal auditing
requirements, required paperwork and Davis -Bacon wages. The higher engineering costs
are due to the increased workload to provide federal aid plans, administer the project and
the auditing process afterwards.
This project will have special assessments and the project construction documents will
follow the Statewide Urban Design and Specifications (SUDAS). The $190,000 TAP grant
is proposed to offset all costs on the project and thus reduce the special assessments
applied to abutting property owners.
The estimate for the costs includes the sidewalk costs, retaining wall costs, ADA ramps
costs, engineering costs and contingency costs. These costs are estimated as follows:

SIDEWALKS
Based on the sidewalk costs, and respective engineering and contingency costs after the
grant is applied, sidewalk assessments total $80,526.54. The sidewalk portion of the
assessment to property owners is reduced 54% from the previous calculated assessments

due to the TAP grant. Those assessments were calculated from earlier in 2021. The TAP
grant provides a significant savings to the abutting property owners.
The sidewalk ordinance has been revised over the years and requires that sidewalks be
installed when development of a subdivision or as part of a site plan. The new policy states
assessments over $500, may be paid in fifteen (15) annual installments. Sidewalks are also
required when the footprint of a building or dwelling has changed when curb and gutter are
present. The City manager has the right to waive this requirement on a case -by -case basis.

RETAINING WALLS
This project includes the City of Dubuque assuming all costs for the construction of the
retaining walls. Abutting property owners will pay 0% of the retaining wall costs. Previously,
the retaining walls were to be assessed to the abutting property owner. This is a savings of
$75,450.04 to the abutting property owners requiring retaining walls.
SCHEDULE
Due to the TAP funding, the project will need to be bid and let through the Iowa DOT in
Ames. We anticipate the bid letting would occur 6/21/2022 based on the project
development critical paths for the Iowa DOT.
MAINTENANCE OF SIDEWALKS
In 2018, the motion included, that the property owners on Gordon Drive that have a
sidewalk on John F. Kennedy Road would not have to maintain their sidewalks for snow
and ice removal. City staff does not recommend this since no other private sidewalks are
maintained by the City. Many private sidewalks abut more than one street, and the City
does not maintain those sidewalks. Some areas, much like Gordon Drive that illustrate this
are Glenwood Court, Cora Drive, Amy Court, Kimberly Drive, Council Hill Drive, Arrowhead
Lane, LaVista Court, Wartburg Place, Pego Court, Autumn Ridge, Aspen Drive, Aspen
Court and Clarke Drive.
RECOMMENDATION
I recommend that the City Council approve the Resolution of Necessity, approve the
Preliminary Schedule of Assessments, establish December 6, 2021, as the date of the
public hearing, and hereby authorize the City Clerk to advertise for bid proposals for the
John F. Kennedy Road Sidewalk Installation Project.

PROPERTY ASSESSMENTS
The estimated assessment, including contingency and engineering for a 100-foot lot would
be $2,219 or $22.19 per lineal foot.
If the property owners choose to have the City install their sidewalk for them with this
assessment project, they would have 15 years to pay for the improvement at 3% interest
on their property tax bill. For every $1,000 of assessment the property owner could expect
to pay approximately $83.77 a year or $7/month for principal and interest cost for their
sidewalk.
According to State Code Section 384.62, the assessment shall not exceed twenty-five
percent of the value of the lot as shown by the plat and schedule approved by the council.
There is no assessment for this project that meets these criteria.
Low- to moderate -income property owners subject to street assessment will be eligible for
financial assistance of the street assessment for the owner -occupied resident property
depending on family size and income level. This financial assistance program is made
available through the Community Development Block Grant Funds. City staff will review
and process financial assistance applications for owner occupied properties once final
costs are developed for the project. See attachment B.

OPPOSITION TO ASSESSMENTS
A resolution of necessity requires passage by three -fourths (3/4) of all members of the City
Council unless written opposition to the assessment has been filed with the City Clerk prior
to the public hearing, signed by individuals representing 75% of the amount of the proposed
assessments for the entire public improvement. In the event a protest/petition is received
representing 75% of the amount of the proposed assessments for the entire public
improvement the City Council vote must be unanimous.
See Iowa Code 384.51.
In 2018, property owners representing over 90% of the proposed assessments were
opposed to the project assessment, triggering the requirement for a unanimous vote. The
determination of whether a three -fourths (3/4) vote or unanimous vote will be made at the
time of the vote following the public hearing in consultation with the City Clerk and the City
Attorney.
REQUESTED ACTION
The City Council is requested to give preliminary approval to the Resolution of Necessity,
approve the Preliminary Schedule of Assessments, and establish the date of the public
hearing through the adoption of the enclosed resolutions for the 2022 John F. Kennedy
Road Sidewalk Installation Project.

RESOLUTION OF NECESSITY FOR THE 2022 JOHN F. KENNEDY ROAD SIDEWALK
INSTALLATION PROJECT
Whereas, the plat, preliminary schedule of assessments, and estimate of total cost
for the 2022 John F. Kennedy Road Sidewalk Installation Project have been duly
prepared and approved by the City Council of the City of Dubuque and ordered placed
on file in the office of City Clerk.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The 2022 John F. Kennedy Road Sidewalk Installation Project will provide:
Installation of sidewalks along John F. Kennedy Road from Asbury Road to the
NW Arterial in areas sidewalks do not exist.
— Installation of 3884 LF of 4' wide concrete sidewalk
— Installation of 1164 SF of retaining wall at 7 locations
— Installation of new ADA pedestrian access ramps at street intersections
— Restoration of disturbed areas with seed, fertilizer and mulch
There is on file in the office of the City Clerk an estimated total cost of the work,
and a preliminary plat and schedule showing the amount proposed to be assessed to
each lot for the improvement.
The Council will hear property owners subject to the assessment and interested
parties for or against the improvement, its cost, the assessment, or the boundaries of the
district on the 6th of December, 2021 at 6:30 p.m. at the Historic Federal Building Council
Chambers, 350 West 6th Street, Dubuque, Iowa.
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing
on the resolution of necessity, the property owner is deemed to have waived all objections
pertaining to the regularity of the proceeding and the legality of using the special
assessment procedure. .
Said improvements shall be constructed in accordance with the plans and
specifications which have been approved by the City Council and are now on file in the
Office of the City Clerk. The cost of making such improvement will be assessed against
property lying with the assessment limits.
The above resolution was introduced, approved and ordered placed on file with

2022 JOHN F. KENNEDY ROAD SIDEWALK INSTALLATION PROJECT
Notice is given that there is now on file for public inspection in the office of
the clerk of the City of Dubuque, Iowa, a proposed resolution of necessity, an estimate of
cost and a plat and schedule showing the amounts proposed to be assessed against
each lot and the valuation of each lot within a district approved by the council of Dubuque,
Iowa for a public improvement of the type(s) and in the location(s) as follows:
Installation of public sidewalk of the following Street:
2022 John F. Kennedy Road Sidewalk Installation Project
— Installation of 3884 LF of 4' wide concrete sidewalk
— Installation of 1164 SF of retaining wall at 7 locations
— Installation of new ADA pedestrian access ramps at street intersections
— Restoration of disturbed areas with seed, fertilizer and mulch
The proposed district to be benefited and subject to assessment for the cost of
such improvements is described as follows:
All properties abutting or served by utilities in the following street:
• John F. Kennedy Road from Asbury Road to the NW Arterial
The council will meet at 6:30 p.m. on the 6t" day of December 2021, at the Historic Federal
Building Council Chambers (and/or by virtual means), 350 West V Street, Dubuque,
Iowa, at which time the owners of property subject to assessment for the proposed
improvement or any other person having an interest in the matter may appear and be
heard for or against the making of the improvement, the boundaries of the district, the
cost, the assessment against any lot, or the final adoption of a resolution of necessity. A
property owner will be deemed to have waived all objections unless at the time of hearing
the property owner has filed objections with the clerk.
Any visual or hearing -impaired persons needing special assistance or persons with
special accessibility needs should contact the City Clerk's office at (563) 589-4120 or
TDD at (563) 690-6678 at least 48 hours prior to the meeting.

p.m. in the Historic Federal Building Council Chambers (and/or by virtual means), 350
West 6th Street, Dubuque, Iowa, at which time the owners of property subject to
assessment for the proposed improvement or any other person having an interest in the
matter may appear and be heard for or against the making of the improvement, said
proposed plans, specifications, form of contract, estimated cost, the boundaries of the
district, the assessment against any lot, or the final adoption of a resolution of necessity.
A property owner will be deemed to have waived all objections unless at the time of
