BACKGROUND The City's Storm Water Detention Policy, most recently amended in 2001, allows the City to accept the ownership and maintenance of detention basins constructed as part of a subdivision. The City has accepted ownership and the responsibility to maintain detention basins if the City's costs for said maintenance can be assessed against the lots within the subdivision. The City does not take over the maintenance responsibility until eighty percent (80 %) of the lots have been developed. In 1997, the City Council adopted Resolution 201 -97 establishing that "maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot B) shall be assessed against Lots 2 through 12 (Elmwood Green Subdivision) in equal amounts, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. In 1998, the City Council adopted Resolution 232 -98 establishing that "maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot 6) shall be assessed against Lots 1 through 20 (Woodland Ridge Subdivision) in equal amounts, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. In 2001, the City Council adopted Resolution 349 -01 establishing that "the maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot A) shall be assessed against the lot owners of Harvest View Estates, in equal amounts, Dubuque hfrig AI- media ly 1I 1 1 IJ 2007 and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law." In 2001, the City Council adopted Resolution 546 -01 establishing that "the maintenance expense incurred by the City of Dubuque for the storm water detention facility on Lot D of Block 6 shall be assessed against the lot owners of Jaeger Heights Subdivision No.2 in equal amounts, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law." DISCUSSION In FY2010, the City performed maintenance on the Elmwood Green Subdivision, Harvest View Subdivision, Jaeger heights Subdivision #2, and Woodland Ridge Subdivision #2 detention basins. At a minimum, maintenance includes mowing the facility. Maintenance can also include repairing outlet structures, removing silt to reestablish the storage capacity, adding drain tile to eliminate standing water, reworking riprap and other erosion control measures, etc. Per the resolutions, the lot owners are to be assessed "in equal amounts." Assessments are determined by dividing the total cost to maintain the detention basin by the total number of Tots in the subdivision. Assessments range from $5.45 for lots in Jaeger Heights to $23.64 for lots in Elmwood Green Subdivision. Letters were mailed to the 238 residents within the four subdivisions. All but fifty eight (58) have paid the assessment. The Final Schedule of Assessments includes those properties that have not yet paid. RECOMMENDATION I recommend establishing the final assessments for the FY2010 Detention Basin Maintenance Program. ACTION TO BE TAKEN I respectfully request adoption of the attached resolution approving the final assessments for the FY2010 Detention Basin Maintenance Program, authorizing the City Clerk to certify the Final Schedule of Assessments to the County Treasurer of Dubuque County and to publish notice of certification once each week for two consecutive weeks in the manner provided in Iowa Code § 384.63. Storm water detention facilities in residential subdivisions may be accepted for ownership and maintenance by the City. Facilities in commercial, office, institutional, mixed use or Industrial planned unit developments and subdivisions may also be accepted by the City, except where ownership of fifty percent or more of the development or subdivision is held by the same entity or is otherwise under common ownership. Acceptance of stormwater detention facilities is subject to the following requirements: An owner of property of one acre or more must construct the storm water detention facility in accordance with the subdivision plans approved by the City and must dedicate the facility to the City as a condition of final plat approval. The owner must continue to own and maintain the facility until (1) the facility has been fully completed, (2) 80% of the platted lots have been fully developed, and (3) adequate erosion control measures, as approved by the City, have been installed on the remaining 20% of the lots. Acceptance of the facility must be by the City Council as required by the Subdivision Ordinance. The owner must agree that once the City accepts the facility, periodic inspection, administrative and maintenance expenses for the facility will be assessed against the lots in the subdivision in proportion to the acreage of each lot as a percentage of the acreage in the subdivision or planned unit development, and that the costs will be collected in the same manner as general property taxes. Such costs will be dependent upon the condition of the facility. Acceptance of the facility for a non - residential subdivision or planned unit development will be based on the preliminary plat approved by the Zoning Advisory Commission for a subdivision, or the conceptual development plan approved by the City.
