Van Milligen, City Manager TO: FROM: Jonathan Brown, WPCP Manager b DATE: July 16, 2010 SUBJECT: Iowa Jobs (I -JOBS II) Application, Water Pollution Control Plant Modifications INTRODUCTION Dubuque kattlil AI- America City I 2007 The purpose of this memo is to request City Council approval to submit an application for I -JOBS II funding for the excess flow management portion of the Water Pollution Control Plant modifications. BACKGROUND In 2010, the Iowa Legislature appropriated $30 million from FY 11 revenue bonds to the I -JOBS Board for a Disaster Prevention Grant Program for grants to cities and counties. The money is intended to assist in the development and completion of public construction projects relating to disaster prevention, including construction, replacement or reconstruction of, local public buildings in a manner that mitigates damages from future disasters, including environmental incidents. DISCUSSION As much as $14,000,000 of the Water Pollution Control Plant (WPCP) modification project is directly and indirectly related to providing the tools to successfully handle wet weather events at the WPCP which may lead to violations of the City of Dubuque's discharge permit. One of the criteria for the I -Jobs II program is to help prevent disasters of which one of the definitions is "Environmental Accidents ". The excess flow management portion of the WPCP project may qualify as a method to prevent an environmental issue caused by heavy rain events. On July 19, 2010 the City will file a 'Notice of Intent' in order to be considered for an !- Jobs II Grant. If the 'Notice of Intent' is approved we will then proceed with filling the application. One of the requirements of the application is an `official resolution from the applicant authorizing the submission of (the I -JOBS II) application ". Since the application deadline is August 2, 2010 it is necessary to ask for authorization at the July 19, 2010 council meeting in order to meet the August 2 application date. RECOMMENDATION I recommend that the City Council adopt the attached resolution authorizing the submission of an application for I -JOBS II funding for the excess flow management portion of the Water Pollution Control Plant Modifications Project once the Notice of Intent is approved. ACTION TO BE TAKEN I respectfully request that the City Council pass the attached resolution authorizing the submission of an application for I -JOBS II funding for the excess flow management portion of the Water Pollution Control Plant Modifications Project. cc: Teri Goodman, Assistant City Manager Jenny Larson, Budget Director RESOLUTION NO. 263 -10 AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE STATE OF IOWA I-JOBS II DISASTER PREVENTION GRANT PROGRAM FOR FUNDING FOR THE EXCESS FLOW MANAGEMENT PORTION OF THE WATER POLLUTION CONTROL PLANT MODIFICATION PROJECT Whereas, the City of Dubuque Water Pollution Control Plant has had violations of its NPDES permit caused directly by excess flow due to heavy rain events, and Whereas, The City of Dubuque has identified the Water Pollution Control Plant Modifications as a high priority, and Whereas a significant portion of the Water Pollution Control Plant Modifications Project is directly related to excess flow management to prevent environmental incidents incurred during heavy rain events, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the City Manager or his designee is hereby authorized to submit an application for I -JOBS II Disaster Prevention Grant Program for funding of the excess flow management portion of the Water Pollution Control Plant Modification Project.
