With the State law prohibiting smoking in public places, businesses are beginning to
place ash /trash cans outside their buildings.
City Engineer Gus Psihoyos is recommending City Council approval of the following
general standards for ash and trash cans placed on public right -of -way:
Samples of approved and recommended design would be the Smoker's Station
or Smoker's Post in black metal or polyethylene material. Any and all designs
and placements would have to be reviewed and approved by City staff prior to
placement.
Only one receptacle for trash /ash would be approved at each building, not each
entrance and exit.
Adding benches or other seating considerations would be prohibited at the
trash /ash receptacle location.
Receptacle must be placed at the building line and not encroach the public right -
of -way more than 1/3 the available width but no greater than 2' , and /or leave not
less than 5' of unobstructed pedestrian zone, or any other restrictions as
identified by the City.
It would be the responsibility of the owner to empty containers and keep the area
in a neat and clean condition.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
On February 8 and March 29, 2010 City Engineering and Planning Services presented
information regarding the issue of ash /trash cans that were starting to be placed on
public right -of -way and how the City might want to regulate their placement and styles.
DISCUSSION
While various areas of the City have streetscape design guidelines such as the
Downtown Design Guidelines, Port of Dubuque Master Plan, and the soon to be
Millwork District, which identify parameters that should be followed, a specific design
may not be indicated, especially for such things as trash and ash cans. The
departments of City Manager, Planning Services, Legal, Engineering and Dubuque
Main Street have arrived at some recommended styles, colors and placement
guidelines.
We would suggest starting with the following general standards if an encroachment of
the public right -of -way would be requested or location identified having ash receptacles.
General Standards:
Samples of approved and recommended design would be the Smoker's
Station or Smoker's Post in black metal or polyethylene material. Any and

City staff prior to placement.

each entrance and exit.

and /or leave not less than 5' of unobstructed pedestrian zone, or any other
restrictions as identified by the City.
It would be the responsibility of the owner to empty containers and keep
the area in a neat and clean condition.
As far as the City buildings, it is recommended that the Smoker's Post in black metal be
utilized and for such facilities as park pavilions that the wall mounted black metal units
could also be an option.
The receptacles for businesses, found through a random inquiry, range from $64 to
$150; and for City buildings /facilities, the range could be $100 - $150 +, depending upon
the style. More elaborate posts could be placed at city buildings if appropriate. Most
styles could be found or ordered through local companies.
It is recommended that the regulation be a simple process to include a letter of request
from the owner /business for such placement and include the design, indemnification
agreement and a photograph or image of the proposed receptacle for staff review.
There would not be a charge but would be an agreement that if they do not comply with
the rules and standards, the City could remove the encroachment. With the simpler
method City Engineering could address the encroachments as they are identified and
work with the individual property owners and businesses.
We request your concurrence of the design and color recommendations, process for
regulating placements and permission to begin contacting businesses and owners
regarding this new policy. If you wish to discuss any of the above standards or the
