City staff has received correspondence from a majority of property owners on Sunset
Ridge rescinding their opposition to the sidewalk installation and requesting City Council
approval of the Sunset Ridge Reconstruction Project. Attached is a memo from City
Engineer Gus Psihoyos indicating the revised timetable for this project subject to City
Council approval of the bids and specifications at the August 2, 2010 City Council
meeting.
I respectfully recommend Mayor and City Council approval of the project.

Based on the possible reconsideration of the Sunset Ridge Reconstruction Project
(Project) at the August 2, 2010 Council meeting, the following timeline is provided:
— Publish Notice to Bidders, Advertise for Bids August 5, 2010
— Pre -Bid Construction Conference August 17, 2010
— Receipt of Bid Proposals (Bid- Letting) August 26, 2010
— Award Construction September 7, 2010
— Project Completion Dates: Phase I (Underground Utilities) November 30, 2010
Phase II (Remaining Work) July 15, 2011
The completion dates are based on such factors as the late bid - letting and limited
construction activity during the winter and inclement weather.

RE: Sunset Ridge Reconstruction Project
Dear Honorable Mayor and City Council:
Based on the July 19, 2010 City Council meeting, -i contacted City Engineer, Gus Psihoyos, to
further discuss options that may be available to the residents of Sunset Ridge based on the
Council decision not to continue with this project.
Subsequently, we had many phone conversations and a neighborhood meeting on Tuesday
evening, July 27, to discuss the available options with Sunset Ridge residents. Of the 22
property owners on Sunset Ridge, the following responded: 12 of the 15 property owners
represented by Attorney at Law Doug Henry (Henry); and 4 property owners not represented by
Mr. Henry.
- 11.5 property owners represented by Henry voted to include sidewalk installation, (although
there is strong opposition to the 1990 ADA law interpretation) with the intent to begin
construction this year and complete the work by July, 2011.
- 0.5 property owners represented by Henry voted against the sidewalk installation. (Note: A
jointly -held property had a split vote between the owners.)
- 6.0 property owners - 3 represented by Henry and 3 not represented by Henry - did not
provide their formal vote at the meeting or during the telephone solicitation. These property
owners were given the opportunity to submit their formal vote to the City Engineering
office. It is my understanding that those formal votes have not been received by the
Engineering Department.
- 4.0 property owners not represented by Henry voted in favor of the sidewalk installation
and subsequent project commencement.
Of the 22 property owners on Sunset Ridge: 11.5 property owners represented by Henry are in
favor of the project, 0.5 property owner represented by Henry are against the project; and 6.0
property owners have not voted; and 4.0 property owners not represented by Henry are in favor
of the project. Therefore, based on property owner vote, the majority of Sunset Ridge residents
would like to rescind its opposition to sidewalk installation and request that the City Council
approve the Sunset Ridge Reconstruction Project.

ESTIMATED COST FOR THE SUNSET RIDGE RECONSTRUCTION PROJECT
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the proposed plans, specifications, form of contract and estimated cost for
the Sunset Ridge Reconstruction Project, in the estimated amount $1,548,102.82, are
hereby approved.

RESOLUTION WITH RESPECT TO THE ADOPTION OF THE RESOLUTION OF
NECESSITY PROPOSED FOR THE SUNSET RIDGE RECONSTRUCTION PROJECT
Whereas, the City Council has proposed a Resolution of Necessity for the Sunset
Ridge Reconstruction Project and has given notice of the public hearing thereon as
required by law; and
Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
