The Dubuque City Council met in regular session at 6:30 p.m. on April 4, 2022, in the second-
floor Council Chambers of the Historic Federal Building, 350 W. 6 th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank,
Wethal; City Manager Van Milligen, City Attorney Brumwell.
City Clerk Breitfelder announced the voting order for the meeting as: Farber, Cavanagh,
Sprank, Jones, Roussell, Wethal, Resnick.

3. Disposition of Claims: City Attorney advised that the following claims have been referred
to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool:
BNK Properties/ Dubuque Dental Associates PC for property damage; Frank O'Connor for
vehicle damage; Ron Vaughn for property damage. Upon motion the documents were received,
filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and
Resolution No. 104-22 Authorizing the Director of Finance and Budget/City Treasurer to ma ke
certain payments of bills that must be paid and approved for payment in accordance with City
procedures was adopted.

AUTHORIZING THE DIRCTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE
CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT
IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the
Finance Director-City Treasurer shall keep an accurate account of all disbursements, money, or
property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods and
services have been pre-audited by Finance Department personnel in accordance with generally
accepted internal control procedures and have been determined to have been requisitioned for
a lawful municipal purpose; and
Whereas, the Finance Director-City Treasurer has provided a list of Expenditures attached
hereto, and by this reference made a part hereof, to be drawn to pay for goods and services
provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -18
adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks in
payment of certain expenditures known as Exception Expenditures prior to City Council approval
and such list is attached hereto.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The Finance Director-City Treasurer is hereby authorized to issue payment for
goods and services provided for City purposes in response to the purchase orders and contracts
issued in compliance with state and municipal code requirements as requested by designated
requisitioning authorities in accordance with approved budget appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance
Director are hereby authorized and directed to provide the statement of receipts and
disbursements to the City Council, and to publish a summary thereof.

5. First Amendment to Grant Agreement between the City of Dubuque, Iowa and Dub Jones
Real Estate, LLC for the Redevelopment of 2900 Central Avenue: Upon motion the documents
were received and filed, and Resolution No. 105-22 Approving the First Amendment to Grant
Agreement between the City of Dubuque, Iowa and Dub Jones Real Estate, LLC was adopted.

APPROVING THE FIRST AMENDMENT TO GRANT AGREEMENT BETWEEN THE CITY OF
DUBUQUE, IOWA AND DUB JONES REAL ESTATE, LLC
Whereas, the City of Dubuque (City) and Dub Jones Real Estate , LLC (Grant Recipient)
previously entered into a Grant Agreement dated September 21, 2021 for the redevelopment of
2900 Central Avenue in the City of Dubuque, Iowa (the Project); and
Whereas, City and Grant Recipient desire to amend the Grant Agreement as set forth in the
attached First Amendment to Grant Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the First Amendment to Grant Agreement between the City of Dubuque, Iowa
and Dub Jones Real Estate, LLC, a copy of which is attached hereto, is hereby approved.
Section 2. That the Mayor is hereby authorized and directed to execute the First Amendment
to Grant Agreement on behalf of the City of Dubuque and the City Clerk is authorized and
directed to attest to his signature.
Section 3. That the City Manager is authorized to take such actions as are necessary to
comply with the terms of the First Amendment to Grant Agreement as herein approved.

to Dubuque. Upon motion the documents were received and filed.
13. Application, Notice of Award and Receipt of SBA Shuttered Venue Operators Grant and
Expenditure Recommendations: Upon motion the documents were received and filed, and
Resolution No. 106-22 Authorizing the Mayor to execute an application for the SBA Shuttered
Venue Operators Grant and authorizing the Leisure Services Manager and the City Manager to
approve the application was adopted.

AUTHORIZING THE MAYOR TO EXECUTE AN APPLICATION FOR THE SBA SHUTTERED
VENUE OPERATORS GRANT AND AUTHORIZING THE LEISURE SERVICES MANAGER
AND THE CITY MANAGER TO APPROVE THE APPLICATION
Whereas, the City of Dubuque applied for a SBA Shuttered Venue Operators Grant; and
Whereas, the City of Dubuque will administer the SBA Shuttered Venue Operators Grant.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA, THAT:
Section 1. That the Mayor hereby is authorized and directed to submit an application for the
SBA Shuttered Venue Operators Grant on behalf of the City of Dubuque.
Section 2. That the Leisure Services Manager and the City Manager are hereby authorized
to approve the application that is submitted to Small Business Adminstration.
Section 3. That the City Manager is hereby authorized and directed to forward said application
and resulting standard executed contract to the respective agencies in a timely fashion and as
required by the Small Business Administration.

14. Community Development Block Grant (CDBG) Subrecipient Agreement – Affordable
Housing Network, Inc. 90 Main Street HVAC Replacement : Upon motion the documents were
received and filed, and Resolution No. 107-22 Authorizing execution of CDBG Subrecipient
Agreement with Affordable Housing Network, Inc. was adopted.

AUTHORIZING EXECUTION OF CDBG SUBRECIPIENT AGREEMENT WITH
AFFORDABLE HOUSING NETWORK, INC.
Whereas, the Affordable Housing Network, Inc. prepared a request to improve the quali ty of
existing affordable rental housing at 90 Main Street utilizing Community Development Block

Grant funds; and
Whereas, the City Council approved the CDBG Fiscal Year 2022/Program Year 2021
Amendment #2 budget that included an increased budget for AHNI Agreements to
accommodate this request; and
Whereas, a Categorically Excluded Subject to Review with 24 CFR Part 58.5 Environmental
Review has been completed, and no compliance or consultation with regulatory authorities were
found to be required; therefore converting the project to exempt; and
Whereas, all services provided will be to a minimum of 51% low/moderate income residents,
meeting the CDBG National Objective of Low/Mod-Income Housing benefit, and eligible activity
of 14B: Rehab, Multi-Unit Residential.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the subrecipient agreement with Affordable Housing Network, Inc., beginning
no sooner than April 5, 2022 be approved.
Section 2. That the Mayor of the City of Dubuque is hereby authorized and directed to execute
said Agreement and related documents on behalf of the City of Dubuque, Iowa.

15. Community Development Block Grant (CDBG) Subrecipient Agreement – Four Mounds
Foundation Build Dubuque Vocational Training: Upon motion the documents were received and
filed, and Resolution No. 108-22 Authorizing execution of CDBG Subrecipient Agreement with
Four Mounds Foundation was adopted.

Whereas, the Four Mounds Foundation program expansion proposes to provide a public
service utilizing Community Development Block Grant funds; and
Whereas, the City Council approved the CDBG Fiscal Year 2022/Program Year 2021
Amendment #2 budget that included funding available for eligible programming and public
services; and
Whereas, a Categorically Excluded Not Subject to Review with 24 CFR Part 58.5
Environmental Review has been completed, and no compliance or consultation with regulatory

Whereas, all services provided will be to a minimum of 51% low/moderate income residents,

FIXING THE DATE FOR A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA ON THE PROPOSED DEVELOPMENT AGREEMENT BY AND AMONG

THE CITY OF DUBUQUE, SCHERR REAL ESTATE, LLC, AND DUBUQUE SCREW
PRODUCTS, INC., INCLUDING THE PROPOSED ISSUANCE OF URBAN RENEWAL TAX
INCREMENT REVENUE GRANT OBLIGATIONS TO DUBUQUE SCREW PRODUCTS, INC.,
AND PROVIDING FOR THE PUBLICATION OF NOTICE THEREOF
Whereas, Scherr Real Estate, LLC, as Developer, is the owner of the following described real
property:
Lot One (1) of Lot Five (5) of Dubuque Industrial Center West 5th Addition in the City of
Dubuque, Iowa, according to the recorded plat thereof, subject to ea sements of record,
locally known as 6500 Chavenelle Drive Dubuque, Iowa (the Property); and
Whereas, Dubuque Screw Products, Inc., as Employer, leases the Property from Scherr Real
Estate, LLC; and
Whereas, Developer and Employer have determined that they require a new industrial
building/facility (the Facility) to maintain and expand their operations and employment in the
project area; and
Whereas, Developer and Employer have entered into an agreement for the construction of
the Facility; and
Whereas, City of Dubuque, Iowa (City), Scherr Real Estate, LLC, and Dubuque Screw
Products, Inc. have entered into a Development Agreement, subject to the approval of the City
Council, pursuant to which Scherr Real Estate, LLC will construct on the Property certain Minimum
Improvements described in the Development Agreement; and
Whereas, the City Council has tentatively determined that it would be in the best interests of
City to approve the Development Agreement; and
Whereas, the Development Agreement provides for the issuance by City of economic
development grants to Dubuque Screw Products, Inc., referred to therein as Urban Renewal
Tax Increment Revenue Grant Obligations, payable from the tax increment revenues collected
in respect of the Improvements to be constructe d by Scherr Real Estate, LLC in accordance
with the Development Agreement, for the purpose of carrying out the objectives of an Urban
Renewal Plan as hereinafter described; and
Whereas, before said obligations may be approved, Chapter 403 of the Code of Io wa requires
that the City Clerk publish a notice of the proposal and of the time and place of the meeting at
which the City Council proposes to take action thereon and at which meeting the City Council
shall receive oral and/or written objections from any resident or property owner of said City to
such proposed action.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Clerk is hereby authorized and directed to cause this Resolution and a
Notice to be published as prescribed by Iowa Code Section 364.7 of a public hearing on the City
Council’s intent to approve the proposed Development Agreement, to be held on the 18th day of
April, 2022 at 6:30 p.m.
Section 2. The City Council will also meet at said time and place for the purpose of taking action
on the matter of authorizing Urban Renewal Tax Increment Revenue obligations, the proceeds of
which obligations will be used to carry out certain of the special financing activities described in the
Urban Renewal Plan for the Greater Downtown Urban Renewal Area Economic Development
District, consisting of the funding of economic development grants to Dubuque Screw Products,
Inc., pursuant to the Development Agreement under the terms and conditions of said Urban
Renewal Plan. It is expected that the aggregate amount of the Tax Increment Revenue obligations
will be approximately $327,978.
Section 3. The City Clerk is hereby directed to cause at least one publication to be made of

a notice of said meeting, in a newspaper, printed wholly in the English language, published at
least once weekly, and having general circulation in said City, said publicatio n to be not less
than four days nor more than twenty days before the date of said meeting on the disposal of the
City’s interest in the Property and the issuance of said obligations.
Section 4. That the Notice of the proposed action shall be in substantia lly the form attached
hereto.

2. Set Public Hearing for Radford Road Amended Urban Revitalization Area Plan: Upon
motion the documents were received and filed and Resolution No. 111-22 Setting a public
hearing for the proposed amendment to the Radford Road Urban Revitalization District Area
Plan was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on April 18,
2022 in the Historic Federal Building.

SETTING A PUBLIC HEARING FOR THE PROPOSED AMENDMENT TO THE RADFORD
ROAD URBAN REVITALIZATION DISTRICT AREA PLAN
Whereas, the City Council of the City of Dubuque approved the Radford Road Urban
Revitalization District on January 7, 2019; and
Whereas, Horizon Development Inc. has proposed to construct a 66-unit residential housing
development for low-income residents and requests an amendment of the Radford Road Urban
Revitalization District Area Plan; and
Whereas, the area proposed for designation under the Urban Revitalization Act there is need
for public improvements related to housing; and the encouragement of housing and residentia l
development as defined by Section 404.1(5) of the Iowa Code; and
Whereas, Chapter 404 of the Code of Iowa provides that a public hearing shall be held on
any proposed Amended Urban Revitalization Area Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Radford Road Urban Revitalization Plan as proposed meets the eligibility
criteria of Chapter 404.1(5) of the Code of Iowa.
Section 2. That the proposed Amended Radford Road Urban Revitalization Area Plan
attached hereto, shall be a matter of record and shall be available for public inspection in the
office of the City Clerk at City Hall, 50 West 13th Street, Dubuque, Iowa.
Section 3. That the City Clerk is directed to publish notice of a public hearing on the Amended
Radford Road Urban Revitalization Area Plan to be held on April 18th, 2022 at 6:30 p.m. in the
City Council Chambers, 350 West 6th Street, Dubuque, Iowa 52001.

approved and ordered filed in the office of the City Clerk for public inspection.
A public hearing will be held on the 18th day of April, 2022, at 6:30 p.m. in the Historic Federal
Building Council Chambers, 350 W. 6th Street, Dubuque, Iowa, at which time interested persons
may appear and be heard for or against the proposed plans and specifications, form of contract

The City Engineer is hereby directed to advertise for bids for the construction of the
improvements herein provided, by publishing the Notice to Bidders to be published on the City
of Dubuque website and a contractor plan room service with statewide circulation, which notice
shall be published not less than thirteen but not more than forty -five days before the date for
filing bids before 2:00 p.m. on the 21st day of April 2022. Bids shall be opened and read by the

URBAN RENEWAL DISTRICT AND SETTING THE DATE FOR A PUBLIC HEARING AND
CONSULTATION ON THE PROPOSED AMENDED AND RESTATED URBAN RENEWAL
PLAN, VERSION 2022.3 FOR SAID DISTRICT
Whereas, the City Council of the City of Dubuque has heretofore approved the Amended and
Restated Urban Renewal Plan (the “Plan” of “Urban Renewal Plan”) for the Greater Downtown
Urban Renewal District (the “District”) in order to provide redevelopment opportunities which will
further the purposes and objectives of the Urban Renewal Plan; and
Whereas, City staff has recommended that the Urban Renewal Plan be further amended and
restated to add a project to the public purpose activities in the District; and
Whereas, Iowa Code Chapter 403 requires that before an Urban Renewal Plan may be
modified, the City Council must follow the notification, consultation, and public hearing process
set forth herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Manager is authorized and directed to prepare an Amended and
Restated Urban Renewal Plan, Version 2022.3 for the Greater Downtown Urban Renewal
District to accomplish the foregoing purposes and objectives, to include in such Amended and
Restated Urban Renewal Plan, Version 2022.3 any appropriate project activities and details, to
determine an appropriate date for and conduct the consultation process required by law with
affected taxing entities concerning the proposed Amended and Restated Plan, Version 2022.3.
Section 2. That the City Clerk is directed to publish notice of a public hearing on the adoption
of an Amended and Restated Urban Renewal Plan, Version 2022.3 for the Greater Downtown
Urban Renewal District to be held on the 2nd day of May, 2022, at 6:30 p.m. in the form attached
hereto. The notice of said hearing shall generally identify the areas covered by the proposed
Amended and Restated Urban Renewal Plan, Version 2022.3 and the general scope of the
urban renewal activities planned for such areas and said notice shall be published in a
newspaper having general circulation within the City not less than four days nor more than
twenty days before the date of said meeting. A copy of the notice of public hearing shall be sent
by ordinary mail to the affected taxing entities.

Section 3. That the Economic Development Director is directed to send by ordinary mail a
copy of the proposed Amended and Restated Urban Renewal Plan, Version 2022.3, the notice
of public hearing, a notice of consultation, and, to the extent the Amended and Restated Urban
Renewal Plan, Version 2022.3 includes the use of tax increment revenues for a public buildin g,
an analysis of alternative development and funding options for such public buildings, to the
Dubuque Community School District Board of Education and Dubuque County Board of
Supervisors, as the affected taxing entities.

9. Resolution of Necessity for the Amendment of the Dubuque Industrial Center Economic
Development District Urban Renewal Plan, Version 2022.1 : Upon motion the documents were
received and filed and Resolution No. 122-22 Authorizing and directing the City Manager to
prepare an Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center
Economic Development District and setting dates for the public hearing and consultation
process was adopted setting a public hearing for a meeting to commence at 6:30 p.m. on May
16, 2022 in the Historic Federal Building.

AUTHORIZING AND DIRECTING THE CITY MANAGER TO PREPARE AN AMENDED AND
RESTATED URBAN RENEWAL PLAN FOR THE DUBUQUE INDUSTRIAL CENTER
ECONOMIC DEVELOPMENT DISTRICT AND SETTING DATES FOR THE PUBLIC
HEARING AND CONSULTATION PROCESS ON THE PROPOSED AMENDED AND
RESTATED URBAN RENEWAL PLAN FOR SAID DISTRICT

Applications were reviewed for the following Boards and Commissions. Applicants were
invited to address the City Council regarding their desire to serve on the following
Boards/Commissions.
i. Housing Appeals and Mediation Board: One, 3-Year term through January 1, 2024 (Vacant
term of Lenhart). Applicants: Carroll Schuety, 2435 Roosevelt St.; Marrichelle Glover, 1635
Catherine St.
ii. Housing Commission: One, 3-Year term through August 17, 2023 (Vacant term of
Craddieth). Applicant: Yindra Dixon, 251 Hidden Oaks Ct .
Appointments were made to the following boards/commissions.
i. Civil Service Commission: One, 4-Year term through April 6, 2026 (Expiring term of
Baskerville). Applicant: Phil Baskerville, 2945 Van Buren St. This commission is subject to the
State of Iowa Gender Balance Law. 3 Commissioners total; currently 1 male/1 female/1 opening.
Upon City Council concurrence, Mayor Cavanagh appointed Mr. Baskerville to the four-year
term through April 6, 2026.
PUBLIC HEARINGS
1. 2022 Asphalt Overlay Ramp Project 2: Motion by Resnick to receive and file the documents
and adopt Resolution No. 123-22 Approval of plans, specifications, form of contract, and
estimated cost for the 2022 Asphalt Overlay Ramp Project 2 . Seconded by Sprank. Motion
carried 7-0.

Asphalt Overlay Ramp Project 2, in the estimated amount $177,750.40, are hereby approved.

2. Wilbricht Lane Detention Basin Project: Motion by Roussell to receive and file the
documents and adopt Resolution No. 124-22 Approval of plans, specifications, form of contract,
and estimated cost for the Wilbricht Lane Detention Basin Project. Seconded by Farber.
Responding to a question from the City Council regarding the funding source of the project, City
Engineer Gus Psihoyos stated that stormwater utility balances will fund the project. City Council
Members stated that residents of Glendale Ct. expressed appreciation for the project, hoping
that it will reduce flooding issues. Motion carried 7-0.
RESOLUTION NO. 124-22
APPROVAL OF PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED
COST FOR THE WILBRICHT LANE DETENTION BASIN PROJECT
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the proposed plans, specifications, form of contract and estimated cost for the Wilbricht
Lane Detention Basin Project, in the estimated amount $448,323.50, are hereby approved.

City Clerk Breitfelder stated that written public input was received by Stephanie Kramer, 2721
Balboa Dr.; Eric Lucy 2736 Tiffany Ct.; and Marvin Cocayne, 2297 Graham Circle.
ACTION ITEMS
1. Request for Proposal for Historic Millwork District Master Plan Update: Motion by Farber
to receive and file the documents and approve the request for proposal (RFP). Seconded by
Jones. Responding to a question from the City Council, Economic Development Director Jill
Connors stated that the updated RFP includes additional verbiage on the city’s expectations for
the master plan and that the selection panel for the RFP will include city staff, private sector
partners and non-profit partners. Motion carried 7-0.
2. Police Department Recruitment Video: Motion by Roussell to receive and file the
information and view the video. Seconded by Jones. Media Services showed a Police
Department recruitment video featuring Police Officer Nicole Salazar. Link to video:

COUNCIL MEMBER REPORTS
Council Member Jones congratulated Council Member Farber and City Attorney Brumwell on
their nominations for the Women’s Leadership Network Women of Achievement Awards.
Council Member Farber reported on her and Council Member Roussell’s visit to 4 th grade
classes at St. Columbkille Elementary School.
Mayor Cavanagh reported on volunteering with Meals on Wheels. Mayor Cavanagh also
commended the first-time occasion of having more women seated at the dais than men.

CLOSED SESSION
Motion by Jones to convene in closed session at 7:33 p.m. to discuss Purchase or Sale of
Real Estate – Chapter 21.5(1)(j) Code of Iowa. Seconded by Roussell. Mayor Cavanagh stated
for the record that the attorney who will consult with City Council on the issues to be discussed
in the closed session is City Attorney Brumwell. Motion carried 7-0.
The City Council reconvened in open session at 8:45 p.m. stating that staff had been given
proper direction.
There being no further business, Mayor Cavanagh declared the meeting adjourned at 8:46
p.m.
