The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative, Davin Curtis, spoke in favor of the request, reviewing the
location and access to the subject parcel
Staff reviewed the submitted Plat of Survey, noting that the property is in Dubuque County
adjacent to Timber -Hyrst Subdivision on the south side of Dubuque. The submitted Plat of
Survey facilitates the sale of the parcel.
There were no public comments.

The Zoning Advisory Commission discussed the request, noting that the subject parcel
does not have frontage on a public or private street, but that the only feasible access is
through Lot 5 of Timber -Hyrst Estates which is owned by the same person purchasing Lot
1.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving lot frontage for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1 of the NE'
SW 1 /4 Section 2, T88N, R2E of the 5 P.M.in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 1 of the NE 1 /4 SW' Section 2, T88NB, R2E, of the 5 P.M.
Section 2. That the Plat of Survey of Lot 1 of the NE % SW' Section 2, T88N, R2E
of the 5 P.M. is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said final plat.

SUBJECT: Plat of Survey of Lot 1 of the NE'/ SW 1 /4 Section 2, T88N, R2E, of the 5th
P.M. in Dubuque County, Iowa
INTRODUCTION
The submitted Plat of Survey subdivides a 2.79 acre parcel from an existing farm
adjacent to the City of Dubuque corporate limits. The submitted Plat of Survey is being
reviewed by the both the City and County of Dubuque as it is within two miles of the
City's corporate limits.
DISCUSSION
The subject property is being subdivided to facilitate the sale of the parcel to the owner
of Lot 5 Timber -Hyrst Estates No. 2. On the plat, it is noted that access for the new lot
will be across Lot 5 Timber -Hyrst Estates No. 2. The proposed lot will not have frontage
on a public or private street; thus, will need a waiver from the City of Dubuque.
Planning staff does not object to the platting of this lot without any frontage, as there is
no ability to have access to it other than through Lot 5 of Timber -Hyrst Estates No. 2
because of the severe topography of the parcel. Lot 5 Timber -Hyrst Estates No. 2 is a
large lot that will require a waiver in front yard setback in order to build a house as it will
surely exceed the maximum 50 -foot setback. At that time, the City Fire Marshall will
also review access to the property to insure adequate emergency service.
RECOMMENDATION
Planning staff recommends that the Plat of Survey of Lot 1 of the NE 1 /4 SW'/ Section
2, T88N, R2E, of the 5 P.M. be approved subject to waiving lot frontage requirements.
The submitted plat is in all other respects compliant with the City of Dubuque Unified
Development Code.
