Water Department Manager Bob Green is recommending acceptance of the Miller Road
Water Main Extension Project, as completed by McClain Excavating Company, Inc., in
the final contract amount of $129,834.43, which is an 18.5% increase from the original
contract in the amount of $109,505.50. This increase was due to the repair cost of the
existing asphalt pavement surface that had no sub base to sustain the adjacent water
main installation.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract for the
Miller Road Water Main Extension Project (1,675 lineal feet of 8" diameter water main
with accessories).
The Eagle Point Water Plant provides the City with its potable water through the City's
Water Distribution System. Public water main on Miller Road ended at 1301 Miller Road.
This project extended the public water main 1,675 lineal feet to the end of Miller Road.
Now all residences on Miller Road have public water access and water for fire protection.
The Miller Road Water Main Extension Project was completed by McClain Excavating
Company Inc. of Peosta, Iowa in the final contract amount of $129,834.43, which is
18.5 % increase from the original contract in the amount of $109,505.50. Amount
increase was due to the repair cost of the existing asphalt pavement surface that had
no sub base to sustain the adjacent water main installation.
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $129,834.43 to McClain Excavating Company Inc. of Peosta,
Iowa for the Miller Road Water Main Extension Project.

ACCEPTING THE MILLER ROAD WATER MAIN EXTENSION PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Miller Road Water Main
Extension Project (the project) has been completed and the City's Consultant Engineer,
Al[trans, Inc. (the engineer) of Cedar Rapids, Iowa has examined the work and filed a
certificate stating the Project has been completed according to the terms of the Public
Improvement Contract and that the Engineer recommends that the Project be accepted;
and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Miller Road Water Main Extension Project appropriations for the contract amount of
$129,834.43 Tess any retained percentage provided for therein as provided in Iowa
Code chapter 573, and to pay such retainage only in accordance with the provisions of
Iowa Code chapter 573.

11.2 Foundation shall defend, indemnify, and hold City, its officers, and employees,
harmless, from and against any claims brought against City, its officers and employees,
for Foundation's negligence in the performance of this Agreement.
11.3 Foundation's maximum liability, as a result of Foundation's negligence, for such
claims, including any legal fees or deductibles, shall be limited to the limits of
Foundation's insurance coverage.
SECTION 12. INSURANCE. Foundation shall provide insurance during the period of
its performance of this Agreement as set forth in the attached Insurance Schedule.
