Van Milligen, City Manager SUBJECT: Confidential Security Procedures and Emergency Preparedness Information DATE: August 31, 2010 Dubuque krail All- AmmicaCity r 1 f 2007 City Attorney Barry Lindahl recommends City Council approval of a resolution designating security procedures and emergency preparedness information developed and maintained for the protection of government employees, visitors to the government body, persons in the care, custody or under the control of the government body that could reasonably be expected to jeopardize such employees, visitors, persons or property, as confidential, which will allow those matters to be discussed in closed session. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen City Manager August 24, 2010 MEMORANDUM Confidential Security Procedures and Emergency Preparedness Information A recently adopted amendment to the Public Records Law provides for confidentiality of security procedures and emergency preparedness information. However, in order to take advantage of that section, the City Council is required to adopt a rule or policy designating the information as confidential. Once such a rule or policy is in place, the Iowa Open Meetings Law also allows the City Council to meet in closed session to discuss those confidential documents. Attached is a draft of a resolution designating security procedures and emergency preparedness information as confidential. I recommend that the resolution be submitted to the City Council for consideration and approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA, AS FOLLOWS: 1. The following information held by the city or any department, board, commission, committee, official, or officer of the city or any city employee delegated the responsibility for implementing the requirements of the Public Records Law, is hereby declared confidential information under Iowa Code § 22.7(50): Attest: (1) Information directly related to vulnerability assessments; (2) Information contained in records relating to security measures such as security and response plans, security codes and combinations, passwords, restricted area passes, keys, and security or response procedures; (3) Emergency response protocols; and (4) Information contained in records that if disclosed would significantly increase the vulnerability of critical physical systems or infrastructures of a government body to attack.
