TO
PUBLIC IMPROVEMENT CONTRACT
BETWEEN
THE CITY OF DUBUQUE, IOWA
AND
J.P. CULLEN & SONS, INC.
This First Amendment to Public Improvement Contract, dated for
reference purposes the 27 day of July, 2010, is made and entered into by and
between the City of Dubuque, Iowa, and J.P. Cullen & Sons, Inc.
Whereas, the City of Dubuque, Iowa ( "City ") and J.P. Cullen & Sons, Inc.
( "J.P. Cullen ") entered into a Public Improvement Contract dated for reference
purposes the 20 day of July, 2010 ( "the Contract ") for the construction of the
10 & Central Parking Ramp and Fire Headquarters Expansion Project ( "the
Project "); and
Whereas, the Contract includes all ordinances and resolutions adopted by
the City Council having to do with the Project; the Notice to Bidders; the
Contractor's Proposal; and the Plans, Specifications, and General Requirements
as adopted by the City Council for the Project ( "Contract Documents "); and
Whereas, the Contract and related Contract Documents provided for
certain dates for completion of the construction of the Project; and
Whereas, the City and J.P. Cullen mutually desire to clarify the completion
dates for the Project;
NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES
AS FOLLOWS:
1. Section 8 of the Contract shall be revised to read as follows:
"AII work herein provided for shall be commenced within ten (10) days
after the Notice To Proceed has been issued. For the 10th and Central
Parking Ramp the work shall be substantially completed in Two
Hundred Ninety Eight (298) Calendar Days from the start of
Mobilization. For the Fire Station Headquarters Expansion the work
shall be substantially complete by December 6, 2010. For purposes of
establishing a completion date, start of Mobilization will be July 28,
2010."
2. All references to substantial or full completion dates in the Contract or
the related Contract Documents that are in conflict with the terms set
forth in the amended Paragraph 8 herein shall be void.

3. Except as set forth herein, all other terms of the Contract are
unchanged and remain in full force and effect, as the same may have
been amended in writing by the parties.
