(2007 Code § 15 -21) 2 -5B -2: PURPOSE; APPROVAL OF PROPOSALS: A. Duties And Responsibilities: The housing commission shall monitor and evaluate city housing needs and shall make recommendations to the city council as to how those needs can be met. In furtherance of this mission, the housing commission's duties and responsibilities shall include, but not be limited to, the following: 1. To contribute as appropriate in the planning, coordinating and review of housing development; 2. To conduct public hearings to ensure meaningful citizen input in the planning, implementation and assessment of the city's housing programs; 3. To provide for and encourage the participation of low and moderate income persons in the planning, implementation and assessment of housing programs; 4. To provide input into the community planning process and to assist in accomplishing a coordinated and consistent housing development program of the city in accordance with present and future housing needs; 5. To request and review ongoing surveys assessing housing needs and identifying future community housing needs, particularly the needs of persons of low and moderate income; 6. To support the efforts of the city council and other city commissions in the assessment of the general housing needs of the community; 7. To undertake from time to time other specific ongoing housing planning which may be referred to it by the city council; 8. To research and recommend to the city council policies and programs facilitating the development of affordable housing; 9. To undertake public information efforts to educate citizens of the availability of federal, state and locally funded housing assistance programs; 10. To assist in the preparation of the housing element of the city comprehensive plan and the annual consolidated plan; 11. To offer comment, as appropriate, on the consistency of proposed housing development with the comprehensive plan, consolidated plan and existing city - housing strategies. B. Project Approval: Any proposed low rent housing project shall be subject to specific approval by the city council and any project requiring a referendum as provided in the code of Iowa shall be submitted to the voters of the city in accordance with the code of Iowa. C. Monitor Housing Program; Conduct Hearings On Grievances: The housing commission shall monitor the city's housing program and conduct hearings on grievances which arise out of the operation of such program except in the area of housing code enforcement. D. Additional Duties: The housing commission shall undertake such additional duties, with regard to the housing trust fund, as are specified in this code. (2007 Code § 15- 22) 2 -5B -3: MEMBERSHIP; VACANCIES; QUALIFICATIONS: A. Membership: The housing commission shall be comprised of ten (10) members. B. Term Of Office: Appointments shall be for a term of three (3) years. C. Vacancies: Vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. D. Manner Of Selection: At least three (3) members of the commission shall be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds management or other related areas of expertise. E. Member Receiving Rental Assistance: One member of the commission shall be a person who is a recipient of tenant based rental assistance under section 8 of the United States housing act of 1937 (42 USC 14370 whose name appears on a lease of section 8 property and who is eighteen (18) years of age or older. If such member ceases to be a recipient of rental assistance under section 8, the term of such member shall be deemed terminated and a new member who meets the requirements of this subsection shall be appointed for the remainder of the term. (2007 Code § 15 -23) 2 -5B-4: MEETINGS: A. Frequency Of Meetings: The housing commission shall meet not less than monthly. B. Attendance Of Members: Members of the commission shall attend at least two- thirds ( of all regularly scheduled and held meetings within a twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the city council that the member be replaced. The attendance of all members shall be entered upon the minutes of all meetings. C. Minutes Filed With Clerk: The housing commission shall file with the city clerk a copy of the minutes of each regular and special meeting of the commission within ten (10) working days after each such meeting. (2007 Code § 15 -24) ' 2 -5B -5: COMPENSATION: All members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 15 -25) 2 -5B -6: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as it may deem necessary and which are not in conflict with this article. (2007 Code § 15 -26) 2 -5B -7: PROCEDURES FOR OPERATIONS: All administrative personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all of its operations. Powers, Generally: The airport commission of the city shall have and exercise the powers to manage and control the regional airport of the city, except that such commission shall not have the power to sell such airport. (2007 Code § 4 -40) B. Powers, Rule Making: The airport commission shall promulgate and put in force such rules and regulations as shall be deemed necessary and appropriate for the order, operation, management, control and supervision of the regional airport. Powers, Control Of Funds: All funds derived from taxation or otherwise for airport purposes shall be under the control of the airport commission of the city for the purposes of management, operation and control of the regional airport and shall be deposited with the finance director -city treasurer to the credit of the airport commission and shall be disbursed only on the written warrant or order of the airport commission including the payment of all indebtedness arising from the acquisition and construction of airports and the maintenance, operation and extension thereof. Certification Of Annual Tax Levy: The airport commission of the city shall annually, certify the amount of tax within the limitations of law to be levied for airport purposes and upon such certification, the city council may include such amount in its budget. Annual Report: The airport is audited as part of the annual external city audit and such report is available for review at the Carnegie -Stout Free Public Library and city clerk's office. (2007 Code § 4 -45) G. Appointment; Terms; Compensation: 1. The airport commission shall have a membership of five (5) persons appointed by the city council for four (4) year terms. Appointment; Term: The transit advisory board shall comprise five (5) trustees appointed by the city council. Appointments; Qualifications: The commission shall consist of five (5) members appointed by the city council. In its appointments, the council shall endeavor to develop a commission versed and competent in telecommunication administration, finances and regulation. The council shall appoint only residents of the city and shall attempt to give preference to applicants who possess professional or experiential backgrounds in law, finances, administration, public relations, or telecommunication technologies. The cable franchise administrator and anyone who is an owner, shareholder, employee, or agent of the city's cable franchise holder shall be ineligible to serve as a member of the commission. B. Terms Of Office; Attendance At Meetings: The term for each member shall be three (3) years. If a vacancy occurs before the expiration of a term, the appointment shall be for the unexpired portion of that term. If the council fails to make an appointment upon the expiration of a term, the incumbent shall continue to serve until an appointment shall be made. If any member fails to attend at least two- thirds ( of the regularly scheduled commission meetings in a twelve (12) month period, the commission may request the council to declare that member's seat vacant.
