Housing Commission
2 -5B -1: COMMISSION CREATED:
There is hereby created a housing commission. (2007 Code § 15 -21)
2 -5B -2: PURPOSE; APPROVAL OF PROPOSALS:
A. Duties And Responsibilities: The housing commission shall monitor and evaluate city
housing needs and shall make recommendations to the city council as to how those
needs can be met. In furtherance of this mission, the housing commission's duties
and responsibilities shall include, but not be limited to, the following:
1. To contribute as appropriate in the planning, coordinating and review of housing
development;
2. To conduct public hearings to ensure meaningful citizen input in the planning,
implementation and assessment of the city's housing programs;
3. To provide for and encourage the participation of low and moderate income persons in
the planning, implementation and assessment of housing programs;
4. To provide input into the community planning process and to assist in accomplishing a
coordinated and consistent housing development program of the city in accordance with
present and future housing needs;
5. To request and review ongoing surveys assessing housing needs and identifying future
community housing needs, particularly the needs of persons of low and moderate
income;
6. To support the efforts of the city council and other city commissions in the assessment
of the general housing needs of the community;
7. To undertake from time to time other specific ongoing housing planning which may be
referred to it by the city council;
8. To research and recommend to the city council policies and programs facilitating the
development of affordable housing;
9. To undertake public information efforts to educate citizens of the availability of federal,
state and locally funded housing assistance programs;
10. To assist in the preparation of the housing element of the city comprehensive plan and
the annual consolidated plan;
11. To offer comment, as appropriate, on the consistency of proposed housing
development with the comprehensive plan, consolidated plan and existing city - housing
strategies.
B. Project Approval: Any proposed low rent housing project shall be subject to specific
approval by the city council and any project requiring a referendum as provided in
the code of Iowa shall be submitted to the voters of the city in accordance with the
code of Iowa.
C. Monitor Housing Program; Conduct Hearings On Grievances: The housing
commission shall monitor the city's housing program and conduct hearings on
grievances which arise out of the operation of such program except in the area of
housing code enforcement.
D. Additional Duties: The housing commission shall undertake such additional duties,
with regard to the housing trust fund, as are specified in this code. (2007 Code § 15-
22)
2 -5B -3: MEMBERSHIP; VACANCIES; QUALIFICATIONS:
A. Membership: The housing commission shall be comprised of ten (10) members.
B. Term Of Office: Appointments shall be for a term of three (3) years.
C. Vacancies: Vacancy caused by death, resignation or otherwise on the commission
shall be promptly filled by the city council for the unexpired term of office.
D. Manner Of Selection: At least three (3) members of the commission shall be selected
specifically on the basis of experience in real estate development, banking, finance,
accounting, funds management or other related areas of expertise.
E. Member Receiving Rental Assistance: One member of the commission shall be a
person who is a recipient of tenant based rental assistance under section 8 of the
United States housing act of 1937 (42 USC 14370 whose name appears on a lease
of section 8 property and who is eighteen (18) years of age or older. If such member
ceases to be a recipient of rental assistance under section 8, the term of such
member shall be deemed terminated and a new member who meets the
requirements of this subsection shall be appointed for the remainder of the term.

2 -5B-4: MEETINGS:
A. Frequency Of Meetings: The housing commission shall meet not less than monthly.
B. Attendance Of Members: Members of the commission shall attend at least two- thirds
( of all regularly scheduled and held meetings within a twelve (12) month period. If
any member does not attend such prescribed number of meetings, it shall constitute
grounds for the commission to recommend to the city council that the member be
replaced. The attendance of all members shall be entered upon the minutes of all
meetings.
C. Minutes Filed With Clerk: The housing commission shall file with the city clerk a copy
of the minutes of each regular and special meeting of the commission within ten (10)
working days after each such meeting. (2007 Code § 15 -24) '
2 -5B -5: COMPENSATION:
All members of the commission shall serve without compensation except for
reimbursement of necessary expenses. (2007 Code § 15 -25)
2 -5B -6: INTERNAL ORGANIZATION AND RULES:
The commission may adopt rules and regulations to govern its organizational
procedures as it may deem necessary and which are not in conflict with this article.

2 -5B -7: PROCEDURES FOR OPERATIONS:
All administrative personnel, accounting, budgetary and procurement policies of the city
shall govern the commission in all of its operations. (2007 Code § 15 -27)

Airport Commission
A. Powers, Generally: The airport commission of the city shall have and exercise the
powers to manage and control the regional airport of the city, except that such
commission shall not have the power to sell such airport. (2007 Code § 4 -40)
B. Powers, Rule Making: The airport commission shall promulgate and put in force such
rules and regulations as shall be deemed necessary and appropriate for the order,
operation, management, control and supervision of the regional airport. (2007 Code
§ 4 -41)
C. Powers, Control Of Funds: All funds derived from taxation or otherwise for airport
purposes shall be under the control of the airport commission of the city for the
purposes of management, operation and control of the regional airport and shall be
deposited with the finance director -city treasurer to the credit of the airport
commission and shall be disbursed only on the written warrant or order of the airport
commission including the payment of all indebtedness arising from the acquisition
and construction of airports and the maintenance, operation and extension thereof.

D. Oath: Each member of the airport commission of the city shall qualify by taking the
oath of office. (2007 Code § 4 -43)
E. Certification Of Annual Tax Levy: The airport commission of the city shall annually,
certify the amount of tax within the limitations of law to be levied for airport purposes
and upon such certification, the city council may include such amount in its budget.

F. Annual Report: The airport is audited as part of the annual external city audit and
such report is available for review at the Carnegie -Stout Free Public Library and city
clerk's office. (2007 Code § 4 -45)
G. Appointment; Terms; Compensation:
1. The airport commission shall have a membership of five (5) persons appointed by the
city council for four (4) year terms. Such members shall serve without compensation.

2. The commission shall elect from its own members, a chairperson, vice chair and a
secretary who shall serve for such terms as the commission shall determine. (2007

Environmental Stewardship Advisory Commission
Sec. 18.5 -21. Created; Composition:
There is hereby created an Environmental Stewardship Advisory Commission, which
shall consist of seven (7) members, who shall all be residents of the City, and shall
include a member representing those who will inherit the environment (a person
between the ages of 16 and 20 at time of appointment), and six (6) members who shall
include representation from diverse segments of the City's population. It is desirable to
select some members who may have helpful backgrounds with environmental /biological
science, health care, business /industry, and environmental /civic groups. (Ord. 64 -93, §
1, 12 -6 -1993; Ord. 93 -95, § 1, 12 -18 -1995, eff. 1 -1 -1996)
Sec. 18.5 -22. Application and Appointment Process:
The appointment process to the Commission by the City Council shall include at least
the following:
(1) An application form requesting basic information on the education, training,
experience, expectations and other qualifications of the applicant;
(2) Notice to and an opportunity for the general public to comment in writing on the
qualifications of each applicant; and
(3) A formal interview by the City Council to determine the applicant's qualifications
and ability to effectively serve on the Commission. (Ord. 64 -93, § 1, 12 -6 -1993)
Sec. 18.5 -24. Duties:
The duties of the Commission shall be as follows:
(1) To develop, articulate and propose goals, objectives and policies for the
stewardship of the City's environment and its ecological systems for present and
future generations. An initial report to City Council should be completed within a year
and thenceforth periodically. It shall also include sections on the current condition of
the City's natural environments and on the progress being made in achieving the
City's environmental quality goals.
(2) To advise and inform the City Council on environmental stewardship issues,
including the implementation of and compliance with, legislation, regulations and
policies.
(3) To hold public forums on specific issues at the direction of the City Council.
(4) To provide, upon request, to other boards, commissions and City departments
information for environmental educational programs, educational materials, and
environmental volunteer opportunities.
(5) To provide input to the Long -Range Planning Advisory Commission regarding
environmental stewardship issues in the Comprehensive Plan. (Ord. 64 -93, § 1, 12-
6 -1993; Ord. 88 -95, § 2, 12 -18 -1995)

TRANSIT ADVISORY BOARD
5 -1 -1: BOARD APPOINTMENT; TERM; OFFICERS:
A. Appointment; Term: The transit advisory board shall comprise five (5) trustees
appointed by the city council. All appointments shall be for a term of three (3) years
or until a successor has been appointed and qualified.
B. Officers: The transit advisory board shall elect from its own number a chairperson
and a secretary who shall serve for such terms as the board shall determine. (2007
Code § 46 -68)
5 -1 -2: QUORUM; VOTING REQUIREMENT:
Three (3) members of the board shall constitute a quorum for the transaction of
business. All action of the board shall be by resolution and the affirmative vote of at
least three (3) members shall be necessary for the adoption of any resolution. (2007
Code § 46 -69)
5 -1 -3: POWERS AND DUTIES OF BOARD:
The board shall:
A. Advise the city council on executing agreements and grants relating to the transit
system operation and the purchase of new equipment.
B. Advise the city council on rates, fares or charges for the transportation of passengers
and any incidental services and the rates or charges to be made for advertising in
buses or any other facility. (2007 Code § 46 -71)
5 -1 -4: MEETINGS:
A. Regular Meetings: The board shall meet not less than bimonthly on a regularly
scheduled day.
B. Attendance Requirement: Members of the board shall attend at least two- thirds (
of all regularly scheduled meetings within any twelve (12) month period. If any
member does not attend such prescribed number of meetings, it shall constitute
grounds for the board to recommend to the city council that said member be
replaced. Attendance of all members shall be entered on the minutes.
C. Copies Of Minutes Filed With Clerk: The board shall file with the city clerk a copy of
the minutes of each regular and special meeting of the board within ten (10) working
days after each such meeting. (2007 Code § 46 -74)
5 -1 -5: PROCEDURES FOR OPERATIONS:
All administrative, personnel, accounting, budgetary and procurement policies of the city
shall govern the board in all of its operations. (2007 Code § 46 -75)
5 -1 -6: FARE INCREASE OR REDUCTION IN SERVICE, PROCEDURE:
A. Public Hearing; Notice: Prior to the adoption of any fare increase or a substantial
reduction in service by the city council, the city council shall set a time and place for
public hearing on such proposed fare increase or reduction in service, and shall
cause a notice of the time and place of such hearing to be published in a newspaper
of general circulation in the city at least ten (10) and not more than thirty (30) days
prior to such hearing.
B. Contents Of Notice: The notice shall state the time and place of hearing, shall include
a summary of the proposed fare increase or reduction in service level, shall indicate
who the increase or reduction will affect, shall indicate the date the increase or
reduction will take effect, and shall request that interested persons comment, in
writing filed with the city clerk prior to the time of the public hearing or in person at
the public hearing, on the proposed increase or reduction. The notice shall also state
that any comments submitted will be considered by the city council, and that
following the public hearing, the city council will act to adopt or reject the proposed
fare increase or reduction in service. (2007 Code § 46 -76)

11 -3C -1: INTENT:
TV CABLE REGULATORY COMMISSION
The city council desires to assure full compliance with its cable franchise, that the
franchise be interpreted and applied to the benefit of the city and its residents, that
quality and updated services be delivered throughout the city, and that the public
interest be protected in all matters related to the cable services delivery system. (2007
Code § 44 -231)
11 -3C -2: COMMISSION ESTABLISHED; PURPOSES AND DUTIES:
A. Established: The city council hereby establishes a commission to be known as the
cable regulatory commission, and which shall exist throughout the term of the cable
franchise.
B. Purposes And Duties: The commission shall have the following purposes and duties:
1. To keep abreast of developments in cable technologies, services and programming.
2. To become competent in cable regulation, finances and standards of operation.
3. To act through the cable franchise administrator as the local regulatory agent of the
cable franchise.
4. To develop policies for the day to day regulation and administration of the cable
franchise.
5. To encourage cordial relations between cable subscribers and the local cable manager
and the local cable manager's staff.
6. To develop policies for handling and resolving subscriber complaints which could not be
resolved satisfactorily by the cable manager.
7. To monitor the operation of the cable system.
8. To counsel the city council regarding rates and possible revocation procedures.
9. To advise the city council on any matter relating to the cable franchise or system.
10. To consult with the cable franchise administrator and the local cable manager on the
best updating of the cable system, services and programming, and to advise the city
council on expending the updating funds.
11. To advise the city manager on the duties, qualification, selection, and evaluation of the
cable franchise administrator.
12. To advise the cable franchise administrator in all matters relating to the regulation of
the cable system including the cable budget.
13. To evaluate its own proceedings and actions and all cable related activities.
14. To submit an annual report to the city council regarding:
a. The state of cable regulation;
b. The state of cable services and technologies; and
c. Any recommendations it may have for the future of cable in Dubuque. (2007 Code
§ 44 -232)
11 -3C -3: MEMBERSHIP; TERMS; OFFICERS:
A. Appointments; Qualifications: The commission shall consist of five (5) members
appointed by the city council. In its appointments, the council shall endeavor to
develop a commission versed and competent in telecommunication administration,
finances and regulation. The council shall appoint only residents of the city and shall
attempt to give preference to applicants who possess professional or experiential
backgrounds in law, finances, administration, public relations, or telecommunication
technologies. The cable franchise administrator and anyone who is an owner,
shareholder, employee, or agent of the city's cable franchise holder shall be
ineligible to serve as a member of the commission.
B. Terms Of Office; Attendance At Meetings: The term for each member shall be three
(3) years. If a vacancy occurs before the expiration of a term, the appointment shall
be for the unexpired portion of that term. If the council fails to make an appointment
upon the expiration of a term, the incumbent shall continue to serve until an
appointment shall be made. If any member fails to attend at least two- thirds ( of
the regularly scheduled commission meetings in a twelve (12) month period, the
commission may request the council to declare that member's seat vacant.
Attendance of all members shall be entered in the minutes.
C. Officers: In odd numbered years, the members shall elect a presiding officer from
among themselves and an official secretary. The city's cable franchise administrator
shall be adviser to the commission, and city staff shall perform secretarial and
administrative duties for the commission as requested by the commission. (2007
Code § 44 -233)
11 -3C -4: MEETINGS; PROCEDURES:
A. Conduct Of Meetings; Quorum: The members shall meet as needed to conduct the
business of the commission, but not less frequently than once each calendar
quarter. A quorum of three (3) members shall be required for members to conduct
their business. All meetings and proceedings of the commission shall conform with
applicable open meeting requirements.
B. Minutes Filed With Council: The commission shall file with the city council a copy of
the minutes of each regular and special meeting within ten (10) days after such
meeting.
C. Governing Of Commission Operations: All administrative, personnel, accounting,
budgetary, and procurement policies of the city shall govern the commission in all of
