INTRODUCTION
The purpose of this memorandum is to request City Council approval of the Final Plat of
Wingate Place No. 4. A resolution, plat and staff report are attached to this
memorandum.
DISCUSSION
The Final Plat of Wingate Place No. 4 is being platted to create two additional lots for a
three -story senior housing development and to provide for the extension of Wingate
Drive. The Final Plat encompasses 10.8 acres and continues the development of the
Wingate Place Subdivision. The Preliminary Plat for Wingate Place Subdivision was
originally approved by the Zoning Advisory Commission in April 1991. The first phase
of Wingate Place was approved in June 1991 and platted eight lots along Wingate
Drive. In 2003, the second phase of Wingate Place was submitted to the City staff for
review; however, the final plat was never submitted by the owners to City Council for
approval. In May 2010, the City Council approved the Final Plat of Wingate Place No.
3, which provided for the development of 35 multi - family dwellings on three lots.
The submitted Final Plat of Wingate Place No. 4 has been reviewed by the City's Water,
Engineering and Fire Departments, and found to be in substantial compliance with the
City of Dubuque Subdivision Regulations.
RECOMMENDATION
I recommend approval of the attached resolution for the Final Plat of Wingate Place No.
4 as the submitted plat is in substantial compliance with the City of Dubuque
Subdivision requirements.

Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns: The subject site will be served by extension of Wingate Drive.
Wingate Drive currently connects with Pennsylvania Avenue, and with this plat will
connect with Sylvan Drive.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all stages of construction and
adequate stormwater control is provided as part of development of this subdivision.
Adjacent Properties: Staff does not anticipate any adverse impacts to adjacent
properties.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Wingate Place No. 4 facilitates the
development of a three -story 64 -unit senior housing development on the property
located on Lot 1 east of the Sylvan Drive and Century Drive intersection.
The submitted Final Plat of Wingate Place No. 4 provides for the extension of Wingate
Drive. Wingate Drive is a 31 -foot wide public street with a 50 -foot right -of -way. The
submitted Final Plat proposes extending Wingate Drive approximately 434 feet to the
east .
Wingate Place was originally approved as a preliminary plat in April 1991. The first
phase of the development was approved as part of the Final Plat approved in June
1991 and encompasses eight lots. A Final Plat was submitted for the second phase of
Wingate Place in 2003; however, the applicant never proceeded with having the Final
Plat submitted to the City Council for review and approval.
The submitted Final Plat of Wingate Place No. 4 is in substantial compliance with the
approved preliminary plat and in compliance with the City of Dubuque Subdivision
Regulations. Planning staff recommends that the Final Plat of Wingate Place No. 4 be
approved.

RESOLUTION NO. 360-10
A RESOLUTION AUTHORIZING APPROVING FINAL PLAT OF WINGATE PLACE
NO. 4 IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of Wingate Place
No. 4 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears a street to be known as Wingate Drive
(Lot A) together with certain public utility, storm sewer and water main easements,
which the owner by said final plat has dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; subject to the owner's agreeing to the conditions noted in
Section 3 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that streets and
public utilities have not yet been completely constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Wingate Drive (Lot A) and the easements for
public utilities, storm sewer and water mains, as they appear on said final plat, be and
the same are hereby accepted; and
Section 2. That the Final Plat of Wingate Place No. 4 is hereby approved by
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of
Final Plat — Wingate Place No. 4

the City of Dubuque, Iowa, upon said final plat, provided the owners of said property
herein named, execute their written acceptance hereto attached agreeing:
(a) To reduce Wingate Drive (Lot A) to grade and to construct
longitudinal sub - drain, concrete curb and gutter and to hard surface
with asphaltic concrete, or with concrete paving with integral curb,
all in accordance with the City of Dubuque standard specifications,
all in a manner acceptable to the City Engineer, in conformance
with construction improvement plans approved by the City
Engineer, and inspected by the City Engineer.
(b) To install sanitary sewer mains and sewer service laterals into each
individual lot, water mains and water service laterals into each
individual lot, storm sewers and catch basins, boulevard street
lighting and erosion control devices all in accordance with the City
of Dubuque standard specifications, all in a manner acceptable to
the City Engineer, and in accordance with construction
improvement plans approved by the City Engineer, and inspected
by the City Engineer.
(c) To construct said improvements, prior to the two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner.
(d)
To maintain the public improvements, for a period of two (2)
years from the date of the acceptance of those improvements by
the City Council of the City of Dubuque, Iowa, at the sole final
expense of the owners, or future owner;
And, further provided that said GNZ Properties, Inc., L. Wingate Properties, LLC,
D. Wingate Real Estate, LLC, as owners of said property, shall secure the performance
of the foregoing conditions provided in this Section by providing guarantees in such
form and with such sureties as may be acceptable to the City Manager of the City of
Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights -of -way, including lots with multiple frontages, as required by
City Code 10 -1 -2 (Sidewalk Installation and Repair).
Section 4. The owner must continue to own and maintain Lot B of Wingate
Place No. 3 and stormwater detention facility until (1) the facility has been fully
completed, (2) 80% of the platted lots on Wingate Place, Wingate Place No. 2, Wingate
Place No. 3, Wingate Place No. 4 and subdivisions thereof have been fully developed,
and (3) adequate erosion control measures, as approved by the City have been
installed on the remaining 20% of the lots. Acceptance of said Lot B and the detention
facility must be by the City Council as required by the Unified Development Code.

Upon the City's acceptance of the detention facility, the inspection, administrative and
maintenance expenses incurred by the City of Dubuque for the storm water detention
facility (Lot B of Wingate Place No. 3) shall be assessed against the lot owners of all
phases of Wingate Place as indicated above and on the preliminary plat, in proportion
to the acreage of each lot, and the City Manager shall certify such costs to the City
Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer,
and such costs shall then be collected with and in the same manner as general
property taxes in accordance with provisions of law.
Section 5. That the final acceptance of the public improvements shall occur
upon certification of the City Engineer to the City Council that the public improvements
have been completed in accordance with the approved improvement plans and City
standards and specifications and accepted by City Council Resolution.
Section 6. That in the event GNZ Properties, Inc., L. Wingate Properties, LLC,
D. Wingate Real Estate, LLC, fail to execute the acceptance and furnish the guarantees
provided in Section 2 hereof within 180 days after the date of this Resolution, the
provisions hereof shall be null and void and the acceptance of the dedication and
approval the plat shall not be effective.
