Amendment to the Agreement Between the Dubuque Professional
Firefighter's Association, Local #353 and the City of Dubuque, Iowa
Personnel Manager Randy Peck is recommending City Council approval of an
Amendment to the Agreement Between the Dubuque Professional Firefighter's
Association, Local #353 and the City of Dubuque that would allow an employee to be
able to trade compensatory days with another employee and, if an employee is unable
to use their compensatory time during the calendar year, due to unforeseen
circumstances, at our option, we could either pay the employee for the compensatory
time at half their rate of pay or allow them to carry the compensatory time over to the
next calendar year.
This is for implementation of the recent contract amendment. Personnel Manager
Randy Peck and Fire Chief Dan Brown do not consider this a substantive change to the
previous amendment.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Amendment to the Agreement Between the Dubuque Professional
Firefighter's Association, Local #353 and the City of Dubuque, Iowa
On July 28, 2003, the City Council approved an Amendment to the Agreement
amending Article 16, Overtime and Callback to provide for compensatory time off in lieu
of Fair Labor Standards Act - Overtime and amending Article 18, Group Insurance to
discontinue payment by the City of the single premium for dental insurance. The
Amendment was reviewed by one of the officers of the Firefighter's Association prior to
presenting it to the City Council. Since then and prior to the ratification vote by the
Firefighter's Association, they have added language relating to being able to trade
compensatory days with another employee. They also added language that would
permit an employee to carryover unused compensatory time from calendar year to
calendar year in the event the employee was unable to use the compensatory time due
to an illness, injury or other unforeseen cimumstance. If an employee is unable to use
their compensatory time during the calendar year, due to unforeseen circumstances, at
our option, we could either pay the employee for the compensatory time at half their rate
of pay or allow them to carry the compensatory time over to the next calendar year.
These are not substitutive changes to the previous Amendment. All of the other
language of the Amendment remains the same as approved on July 28, 2003. Fire
Chief Dan Brown supports the changes. I recommend that the Amendment be
approved. The requested action is for the City Council to approve a motion authorizing
you to sign the Amendment.

AMENDMENT TO THE AGREEMENT BETWEEN
THE DUBUQUE PROFESSIONAL FIREFIGHTER'S ASSOCATION, LOCAL #353
AND
THE CITY OF DUBUQUE, IOWA
Article 16, Overtime and Callback, Section 6
When an employee is present for duty for all of his/her assigned shifts
within the twenty-seven day work period, as defined by the Fair Labor
Standards Act, he/she shall earn twelve (12) hours of compensatory time.
The compensatory time shall be accumulated throughout the calendar year
and after vacations are selected for the upcoming calendar year, employees
will take compensatory time off in twenty-four hour periods for the remaining
vacation days available on their respective shifts. Selection of compensatory
time off shall be made in the same manner as vacation selection. Upon
approval of the Fire Chief or his/her designee, after selections are made,
employees will be allowed to move a "compensatory day" to another open
vacation slot or trade compensatory days with another employee.
Upon termination, retirement, or separation from employment for any
other reason, unused compensatory time shall be paid at one-half the regular
rate of pay. Carryover of compensatory time from calendar year to calendar
year shall be limited to twenty-four (24) hours of compensatory time. If an
employee is unable to use any or all of his/her compensatory time because of
illness, injury, or other unforeseen cimumstance, the City shall have the option
of paying off the employee's earned compensatory time at half the employee's
rate of pay or allowing the employee to carry over the unused balance to the
next calendar year. The use of compensatory time in lieu of payment of
overtime shall be mandatory and the definition of compensable hours of work
shall be the definition contained in the Fair Labor Standards Act, which means
that an employee must be present for duty for over 204 hours in the twenty-
seven day work period to be eligible for compensatory time.
