Civil Engineer II Jon Dienst is recommending acceptance of the Montrose Terrace
Stairs Reconstruction Project, as completed by Max Smith Construction, in the final
contract amount of $46,880.80, which is a 6.9% increase from the original contract
amount of $43,871.00. This increase was due to slope stability concerns, the concrete
walk was installed at a 6 -inch depth versus the originally planned 4 -inch depth.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract for the
Montrose Terrace Stairs Reconstruction Project.
The Montrose Terrace Stairs Reconstruction Project was completed by Max Smith
Construction of Dubuque, Iowa, in the final contract amount of $46,880.80, which is a
6.9% increase from the original contract amount of $43,871.00. Due to slope stability
concerns, the concrete walk was installed at a 6 -inch depth versus the originally
planned 4 -inch depth.
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $46,880.80 to Max Smith Construction, Inc. for the Montrose
Terrace Stairs Reconstruction Project.

RESOLUTION NO. 361-10
ACCEPTING THE MONTROSE TERRACE STAIRS RECONSTRUCTION PROJECT
AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Montrose Terrace Stairs
Reconstruction Project (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Montrose Steps Reconstruction Project, Steps, Railing, Fencing, and Sidewalk
Program, City -Owned appropriations for the contract amount of $46,880.80 less any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
Passed, approved and adopted this 20 day of September, 2010.
