Meeting called by order of Mayor
Alderson and Councilman Brede.
Council met at 4:40 P. M.
Mayor Alderson in the chair.
Present —City Manager Carr, May-
or Alderson; Councilmen Brede, Ga-
briel, Melchior, Rooney.
Mayor Alderson read the call and
stated that service thereof had been
duly made, and this meeting is called
for the purpose of levying a Special
Assessment to pay for making gas
connections on Grandview Avenue,
and acting on any other business
that might properly come before a
Regular meeting of the City Council.
Notice certified to by the publish-
ers of the City Council's intention to
levy a Special Assessment to pay for
making gas connections on Grand-
view Avenue. Presented. Council-
man Gabriel moved that the notice
be received and filed. Seconded by
Councilman Brede. Carried by the
following vote:
Yeas —Mayor Alderson, Council-
man Brede, Gabriel, Melchior, Roo-
ney.
Nays —None.
Resolved, by the City Council of
the City of Dubuque, that to pay for
making Gas Connections on Grand-

Sealed proposals will be received
at the office of the City Manager,

Dubuque, Iowa, until Thursday,. Feb-
ruary 24, 1921, for the cleannig, oil-
ing and winding of the Town Clock
and the making of such necessary
repairs as may be required to keep
this clock in running order for the
period of one year, from February
19, 1921.
Each proposal must be accompan-
ied by a certified check for Ten Dol-
lars (810) as an evidence of faith.
The City reserves the right to re-
ject any or all bids.

tion Bonds.
A part of these bonds mature each year from 1922 to
1930, and are dated February 21, 1921.
These bonds are exempt from taxation, bear 5% in-
terest, payable semi - annually.
All citizens who have any idle money have here an
opportunity to put it to work with absolute assurance of
the security of both principal and interest.
Call on the City Treasurer some time this week and
learn particulars.

A RESOLUTION
Whereas, the contract heretofore
entered into by the City of Dubuque
for making gas connections in
Grandview Avenue hereinafter de-
scribed has been completed and the
City Engineer has computed that the
cost and expense of said improve-
ment amounts to $993.89.
Therefore, be is resolved by the
City Council of the City of Dubuque,
that to provide for the cost of mak-
ing gas connections from the main
to the lot line on Grandview Avenue,
from the south property line of Delhi
Street, to the south line of Lot 11,
Block 5, Grandview Park Add.
There be issued bonds to the
amount of - $993.89. Said bonds shall
be issued under Chapter 6, Title V
of the Code of Iowa, and amend-
ments thereto, shall bear date as of
the 2nd day of April, 1921, shall be
of the denominations of $100.00 each,
except that there shall be one bond
of the amount of $93.89; they shall
be numbered from 6746 to 6755, both
inclusive, and shall be divided into
seven series, of which the bonds
numbered 6746 and 6747 shall consti-
tute the first series and shall be pay-
able on the first day of April, 1922;
the bonds numbered 6748 and 6749
shall constitute the second series and
shall be'payable on the first day of
April, 1923; the bonds numbered
6750 and 6751 shall constitute the
third series and shall be payable on
the first day of April, 1924; the bonds
numbered 6752 shall constitute the
fourth series and shall be payable
on the first day of April, 1925; the
bond numbered 6753 shall constitute
the fifth series and shall be payable
on the first day of April, 1926; ,the
bond numbered 6754 shall constitute
the sixth series and shall be payable
on the first day of April, 1927; the
bond numbered 6755 shall constitute
the seventh series and shall be pay-
able on the first day of April, 1928.
Said bonds shall bear interest at the
rate of five per cent per annum,
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be
payable out of the proceeds of the
special assessment levied for said
improvement. Both principal and
interest shall be payable at the office
of the City Treasurer in the City of
Dubuque. Said bonds shall be sub-
stantially in the following form:

IMPROVEMENT BOND.
The City of Dubuque, in the State
of Iowa, promises to pay as herein-
after mentioned, to the bearer here-
of, on the first day of April, 19 -,
or any time before that date at the
option of the City, the sum of
ONE HUNDRED DOLLARS
with interest thereon at the rate of
five per cent per annum, payable on
the presentation and surrender of
the Interest Coupon hereto attached.
Both principal and interest are
payable at the office of the City
Treasurer, in the City of Dubuquue,
in the State of Iowa. This bond is
issued by the City of Dubuque; pur-
suant to and by virtue of Chapter 8,
Title V of the Code of Iowa and
amendments thereto, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 2nd day of March, 1921; this
bond is one of a series of ten bonds,
nine for One Hundred Dollars each,
numbered from 6746 to 6754, inclus-
ive, and one for Ninety -three and
89 -100 Dollars, numbered 6755, all of
like tenor and date, and issued for
the purpose of defraying the cost of
making gas connections in Grand-
view Avenue, from the south prop-
erty of Delhi Street to the south line
of Lot 11, Block 5, Grandview Park
Add., in the City of Dubuque and
described in said resolution; which
cost is assessable to and levied
along said improvement, and is made
by law a lien on all abutting or ad-
jacent property, and payable in sev-
en annual installments, with interest
on all deferred payments at the rate
of five per cent per annum, and this
Bond is payable only out money de-
rived from the collection of said
special tax, and said money can be
used for no other purpose.
And it is hereby certified and re-
cited that all the acts, conditions
and things required to be done, pre-
dent to and the issuing of this ser-
l ies of bonds, have been done, hap-
pened and performed, in regular and
due form, as required by said law
and resolution and for the assess-
ments, collection and payment there-
on, of said special tax, the full faith
and diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.
In Witness whereof, the City of
Dubuque, by its City Council, has
caused this bond to be signed by its
Mayor and countersigned by its
Clerk, with the Seal of said City af-
fixed this 2nd day of April, 1921.

Be it further resolved that the

manner provided for in Sec. 845 of
the Code of Iowa, the proceeds of
said sale to be kept in a special fund
to be known as Improvement Fund.

Report of City Manager Carr, rec-
ommending that bids be secured at
once for the extension of Kneist
Street sewer, from its present out-
let to its intersection with the Bee
Branch sewer, presented. Council-
man Brede moved that the recom-
mendation of the Manager be com-
plied with and bids be secured at
once. Seconded by Councilman Gab-
riel. Carried by the following vote:

Report City Manager Carr, stating
that bids had been received for con-
structing the reinforced top cover
for the Third Street Reservoir, as
follows: Anton Zwack, City, light
construction, $29,989.00; heavy con-
struction, $31,958.00. Dubuque Boat
& Boiler Works, City, light construc-
tion, $35,500.00; heavy construction,
$37,500.00. Leonard Construction
Co., City, light construction, $38,-
$38,600.00; heavy construction, $41,-
800.00. Layton Construction Co.,
Muscatine, Ia., light construction,
$39,700.00; heavy construction, $41,-
900.00, recommending that the con-
tract be awarded to Anton Zwack
for heavy construction, presented.
Councilman Melchior moved that the
recommendation of the Manager he
approved and a contract be entered
into with Anton Zwack to construct
the top to the Third Street Reser-
voir, heavy construction. Seconded

From the above estimates there will be an apparent surplus in the
General Funds of $72,009.51. From this should be taken $20,000.00 to
cover the deficit in operating funds April 1, 1921.
Also $9,000.00 should be set aside to cover deficit in Park funds of
long standing. Also $18,000.00 is needed to meet current deficit in Gen-
eral Bonded Debt Fund on April 1, 1921.
This leaves an apparent balance in the General Funds for contin-
gencies of $25,009.51, or to be carried forward into 1922 and then to be
used, together with any other fund balances, in taking care of the gen-
eral indebtedness of the city.
In connection with the statement of the past year's expenditures,
$32,000.00 of old Loan Warrants are shown as having been redeemed.
These warrants are actually now carried as cash by the City Treasurer,
which makes it important to pass through the year with sufficient bal-
ance to pay them up and clear the city's books.
In these statements no attention • is paid to special improvements.
which are to be paid for through assessment of property benefited; neith-
er as to cost nor as to the retirement of Special Improvement Bonds. The
city's books show these funds to be in good shape for the ensuing year
with an anticipated balance of $30,319.86.
Following is a detailed statement covering expenditures March 1,
1920, to March 1, 1921, and an estimate of expenditures for, the next
fiscal year. It should be noted in comparison of these figures that the
current deficit of March 1, 1920, amounting to $60,743,66 is shown with
the expenditures for the past year.

Council met at 4:35 p. m.

Mayor Alderson read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of acting on
bids for the construction of a sewer
in Kneist Street from the end of the
present finished sewer to the Bee
Branch sewer, and acting on any
other business that might properly
come before a regular meeting of
the City Council.
Councilman Brede moved that the
rules be suspended for the purpose
of allowing any . one present to ad-
dress the Council. Seconded by
Councilman Melchior. Carried by
the following vote:

A committee representing the Alli-
son- Henderson Memorial Fund rela-
tive to property fronting on the river
bounded on the south by the rail-
road bridge, on the west by Bell

paid $9,000.00 on said property, leav-
ing a balance of $2,500.00 plus some
interest remaining to be paid, and
asking the City to assume the bal-
ance of the debt, they to turn prop-

City Council, Dubuque, Iowa.
Gentlemen: In accordance with
your instruction, bids were received
for the construction of a reinforced
concrete section of Kniest Street
sewer, same to extend from the
present end of the finished sewer to
the Bee Branch Sewer, approximate-
ly one hundred and fifty feet long.
The sectoon is to be semi - circular,
about siv feet nine inches in height
and nine feet six inched in width.
The following bids were received:
Even - Uhlrich & Staner, $27.90 per
lineal foot; James Saul, $4,617.50 for
the job, which is approximately the
equivalent of $30.78 per foot; Leon-
ard Construction Co., $42.40 per
foot; R. F. Conlon, Cuba City, Wis.,
$7.900.00 for the job, which is ap-
proximately the equivalent of $52.67
per foot; J. A. Parsons, Dyersville,
Ia., $7,925.00 for the job, which is
approximately the equivalent of
$52.83 per foot. I would respectful-
ly recommend the acceptance of the
proposal of the Even- Uhlrich &
Staner Co., and that the execution of
the contract be authorized between
the City of Dubuque and this com-
pany for the performaice of this
work.

Resolution of Necessity.
Be it resolved by the City Coun-
cil of the City of Dubuque that, upon
recommendation of the City Man-
ager, it be deemed necessary and
advisable to improve Dodge Street
from the west property line of Bluff
street to the west property line of
South Dodge street by curbing with
new cement curb where necessary,
resetting old stone curb where nec-
essary and by paving said portion of
said street with bituminus- macadam,
penetration method, that part of the
street lying between the street car
tracks and one foot outside thereof
to be paved with the same material.
• Said work to be done in accord-
ance with the plans and specifica-
tions to be prepared by the City En-
gineer.
The cost and expense of said im-
provement will be assessed against
all of the property subject to assess-
ment for the improvement as is pro-
vided by law.
Be it further resolved, that the
above and foregoing improvement is
hereby proposed to be made and con-
structed as hereinbefore set forth
and that this proposed resolution
(except this paragraph) be and the
same is hereby set down for further
and final hearing, consideration and
determination at a meeting of the
City Council to be held the 4th day
of April, 1921, at 4:30 p. m. in the
Council Chamber and that the City
Clerk be and he is hereby instructed
to cause notice of the pendency of
the above resolution and the time
and place, when and where said res-
olution will be considered for pas-
sage and objections heard, to be
given by publication in the official
newspapers of the city. in manner
and for the time provided by law.
The above resolution was an-
proved and ordered placed on file
for final action and the notice of the
pendency ordered given this 15th
day of March, 1921.

memorial to William B. Allison and
David B. Henderson, honored citi-
zens of Dubuque; with the further
qualifications that the city shall have
the right to divert the use of said
property to other than park pur-
poses; but, in the event that said
city should desire to divert the use
of the said property to other than
park purposes and devote the same
to purposes wholly municipal in
character, then said property shall
first be appraised and Four - Fifths
(4-5) of the appraised value shall be
used for a memorial, preferably a
park, in honor of said citizens; if,
also said property be sold by said
city for commercial purposes then
Four - Fifths (4 -5) of the selling price
received thereof shall be devoted to
such a memorial.
And we, as trustees of the Allison -
Henderson Memorial Association, do
hereby covenant with the said City
of Dubuque to warrant and defend
the said premises only against the
lawful claims of all persons whom-
soever claiming by,. through, or un-
der, or any of us, the intention be-
ing to convey our interest in said
property to the said City of Dubuque.
This deed is given to correct a
deed executed by the grantors here-
in to the City of Dubuque on August
26, 1916, and filed for record with the
County Recorder on November 24,
1916.

A Resolution
Be it resolved by the City Council
of the City of Dubuque, that pursuant
to a resolution of necessity, proposed
at a lneetin,? of this Council on the
7th day of March, 1921, and duly
passed and approved on the 25th day
of March, 1921, it is hereby ordered
that the improvement described in
said resolution of necessity provid-
ing for the improving of Eleventh
Street, from the east property line of
Clay Street to the railroad tracks in
the alley between Elm Street and
Pine Street, by curbing with new ce-
ment curb whore necessary, resetting
old stone curb where necessary, by
guttering with brick block on a con-
crete foundation, grout filler to be
used, and by paying said portion of
said street with either sheet asphalt,
bitulithic or willite paving on the
present foundation, be and the same
is hereby ordered constructed.
Be it further resolved that the City
Clerk be and he is hereby instructed
to advertise for proposals for the
construction of the improvement
above described, the said improve-
ment to be constructed in strict ac-
cordance with the plans and specifi-
cations thereof, prepared by the City
Engineer, and approved by the City
Manager and now on file in the office
of the City Clerk, the work to be
completed on or before the 1st day
of September, 1921.
The cost and expense of said work
as is by law assessable against the
property abutting upon or adjacent
to said improvement will be assess-
ed, and payment will be made to the
contractor to the amount of the as-
sessment out of funds to be created
by the sale of Improvement Bonds,
to be issued in anticipation of the
collection of said special assessment
under the provisions of Chapter 8,
Title V, of the Code of Iowa, and
amendments thereto; and any defi-
ciency between the amount of the
contract price and the amount of
said bonds will be paid from the pro-
ceeds of a special tax to be levied
under the provisions of Section 831
of the Code of Iowa, in anticipation
of which bonds will be issued under
the provisions of Section 912 of the
code of Iowa and Section 912 -A of
the Code Supplement.
This resolution being deemed urg-
ent and of immediate importance
shall be in force and effect from and
after its adoption by the City Council.

56 Special Session, March 30th, 1921
In connection with delinquent
special assessments, I find a rather
involved proposition involving prop-
erty now owned by the Sisters of
the Holy Ghost. On account of the
improvement of St. Ambrose Street
there was levied on September 4,
1913, special assessments against Lot
21, Finley's Addition, of $421.28;
against Lot 38, Finley's Addition, of
$469.59.
Also, there was levied on January
15, 1914, on account of the improve-
ment of Arch Street, special assess-
ments against Lots 34, 35, 36, 37 and
38, Finley's Addition, all belonging
to the Sisters of the Holy Ghost, of
$127.84 each, giving a total of
$639.20.
There was also levied on Septem-
ber 7, 1916, on account of the sewer
in St. Ambrose Street, special assess-
ments against Lot 21, Finley's Addi-
tion, of $155.79; Lot 38, Finley's Ad-
dition, of $158.98, making a total of
these assessments without interest,
of $1,835.94.
On November 11, 1914, the City
condemned a portion of Lots 37 and
38, Finley's Addition, for street pur-
poses. The jury awarded to the Sis-
ters of the Holy Ghost the sum of
$900.00 on account of the property -in
this way appropriated for street pur-
poses. This amount remained un-
paid.
On November 21, 1918, the Sisters
petitioned the City Council in con-
nection with Lots 37 and 38, asking
that the amount of the award of the
appraisal be used to pay delinquent
and general taxes against these lota.
On December 5, 1918, a motion was
made by Alderman Hird that war-
rants be drawn in favor of the Sis-
ters in the amount of $900.00, and
that the City Treasurer be instruct-
ed to accept the sum of $525 in full
payment of all taxes, both general
and special, due and owing from said
Sisters, the same to be without in-
terest.
The Council Proceedings do not
indicate that this motion was ever
voted upon, and yet a warrant was
issued for Seventy -Five Dollars to
pay the attorney employed by the
Sisters, but no warrant was ever is-
sued in favor of the Sisters. Furth -
ern..,re, I am inclined to think that
the City Council was never advised
fully as to the amount of delinquent
outstanding special assessments
against this property, as it would
hardly seem reasonable that delin-
quent taxes to the amount of
$1,835.94 would be ordered cancelled
on the strength of an obligation ow-
ing to the Sisters" of the Holy
Ghost, of Nine Hundred Dollars, and
at the same time a further payment
of Five Hundred Dollars authorized.
In view of all these complications,
however, I would recommend that
the City Council cancel all delin-
quent special assessments above re-
ferred to on account of the property
belonging to the Sisters and acquir-
ed by the City November 19, 1914,
for street purposes.
Councilman Melchior moved that
the recommendation of the City Man-
ager be accepted and the Treasurer
so instructed. Seconded by Council-
man Rooney. Carried by the follow-

Report City Manager Carr as fol-
lows:
Mrs. Fischer, the owner of the
property needed by the city for the
extension of Rhomberg Avenue, is de-
sirous of completing the. transaction
along the line as negotiated last
fall, namely, that she will deed to
the City that part of Lots 356, 366,
367 and 368 which are needed for
street purposes in making the exten-
sion of Rhomberg Avenue. She will
pay all outstanding special assess-
ments and general taxes on this
property and let the City have this
property for the sum of $5,000.00, it
being stipulated in the deed that no
further expense will be assessed to
her abutting property in connection
with the laying of first sidewalks or
in the making of the original im-
provement of the street through this
block.
Mrs. Fischer is also desirous of a
little ready money to take care of
this property. I would, therefore,
recommend that a warrant be drawn
in favor of Mrs. Fischer to the
amount of $1,000.00, the same to be
the first payment on the purchase
price. The balance of the $5,000.00
less any outstanding special assess-
ments or taxes to be paid on the fur-
nishing to the City of a satisfactory
deed and abstract, presented. Coun-
cilman Gabriel moved that the rec-
ommendation of the City Manager
be approved. Seconded by Council-

From the above estimates there will be an apparent surplus in the
General Funds of $72,009.51. From this should be taken $20,000.00 to
cover_ the deficit in operating funds April 1, 1921.
Also $9,000.00 should be set aside to cover deficit in Park funds of
long standing. Also $18,000.00 is needed to meet current deficit in Gen-
eral Bonded Debt Fund on April 1, 1921.
This leaves an apparent balance in the General Funds for contina
gencies of $25,009.51, or to be carried forward into 1922 and then to be
used, together with any other fund balances, in taking care of the gen-
eral indebtedness of the city.
In connection with the statement of the past year's expenditures,
$32,000.00 of old Loan Warrants are shown as having been redeemed.
These warrants are actually now carried as cash by the City Treasurer,
which makes it important to pass through the year with sufficient bal-
ance to pay them up and clear the city's books.
In these statements no attention is paid to special improvements.
which are to be paid for through assessment of property ,benefited; neith-
er as to cost nor as to the retirement of Special Improvement Bonds: The
city's books show these funds to 'be in good shape for the ensuing year
with an anticipated balance of $30,319.86.

The plans provide for a three foot
brick gutter and sheet pavement to
be laid on the present macadam
foundation.
Bids are requested on sheet as-
phalt, Willite and bithulithic pave-
ments. Approximate quantities as
follows:
653 sq. yds. brick gutter.
5,276 sq. yds. sheet pavement.
800 lineal feet new concrete curb.
300 lineal feet stone curb reset.
Bidders are to quote unit prices
for completed work covering the var-
ious types of pavement.
Certified check for $900.00 must be
furnished in a separate envelope
with the proposal, same as a guaran-
tee for the execution of the contract,
in case the same is awarded.
Monthly estimates as prepared by

be received and filed. Seconded by
Councilman Gabriel. Carried by the

A Resolution of Necessity
Be it resolved by the City Council
of the City of Dubuque that, upon
recommendation of the City Manag-
er, it be deemed necessary and ad-
visable to improve Dodge Street,
from the west property line of Bluff
Street to the west property line of
South Dodge Street, by curbing with
new cement curb where necessary,
resetting old stone curb where neces-
sary and by paving said portion of
said street with bituminous-maca-
dam, penetration method, that part
of the street lying between the street
car tracks and one foot outside there-
of to be paved with same material.
Said work to be done in accord-
ance with the plans and specifica-
tions to be prepared by the City En-
gineer.
The cost and expense of said im-
provement will be assessed against
all of the property subject to assess-
ment for the improvement as it pro-
vided by law.
Be it further resolved that the
above and foregoing improvement is
hereby proposed to be made and
constructed as hereinbefore set
forth and that this proposed resolu-
tion (except this paragraph) be and
the same is hereby set down for fur-
ther and final hearing, consideration
and determination at a meeting of
the City Council to be held on the
4th day of April, 1921, at 4:30 p. m.,
in the Council Chamber and that the
