NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,IOWA : Section 1 .That Appendix A (the Zoning Ordinance)of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter described property as shown on Exhibit 1,and to the center line of the adjoining public right-of -way,all in the City of Dubuque,Iowa from R -1 Single-Family Residential District to CS Commercial Service and Wholesale District. Section 2 .The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque,Iowa. The single-family residence is located on the 20 acre parcel directly adjacent to the one acre area proposed to be rezoned. Physical Characteristics:The property to be rezoned is an approximately one acre flag-shaped lot,335 feet deep with 60 feet of frontage along Roosevelt Road.The property slopes gently up and away from Roosevelt Road with a grade change of approximately 20 feet between Roosevelt Road and the east property line.The property is heavily wooded on the north and east sides ,abuts an open field to the south and adjoins the Roosevelt Road right-of-way and agricultural use to the west.There are several existing out buildings on the lot and a single-family residence directly adjacent to the lot on its south side. Concurrence with Comprehensive Plan:The 1995 Comprehensive Plan made no recommendations for this area. Impact of Request on : Utilities:Sanitary sewer,city water and storm sewer are not available to serve this site.The existing site relies on well water and a private septic system. Traffic Patterns/Counts:Roosevelt Road at this location has a 60-foot right-of-way with a 20-foot wide paved street.Roosevelt Road is designated as a Minor Arterial.Based on 1997 IDOT counts,there are approximately 2,700 vehicle trips per day south of the Amelia Drive intersection on Roosevelt,approximately 2,000 feet south of the subject property. REZONING STAFF REPORT Page 2 Public Services:The site is currently not served by City water or sanitary sewer. Environment:Staff does not anticipate any adverse impact to the environmentprovidedadequateerosioncontrolisprovidedduringallphasesofdevelopmentandadequatestormwatercontrolisprovidedasapprovedbytheCityEngineeringDivision.Some uses in a CS district may generate more sewage than canadequatelybehandledbyaprivatesepticsystem. Adjacent Properties:The subject parcel is bordered on three sides by primarilyvacantresidentially-zoned property.There are however two existing single-familyresidencesapproximately180feetsouthoftheproposedrezoning.The noise,activity and odors generated by some of the permitted uses in a CS district mayhaveanegativeimpactontheseresidentialproperties. Staff Analysis:The applicant is requesting to rezone an approximately one acre flag-shaped lot within an existing 20-acre parcel along Roosevelt Road.The flag-shaped lothas60feetoffrontageonRooseveltRoadandisapproximately325feetdeep.Theapplicantownsanexistingsingle-family residence that will be directly adjacent to thesubjectlot.The subject lot is bordered on three sides by vacant residentially-zonedpropertiesandactivelycultivatedagriculturalproperty.There are two single-familyresidencesonlotsthatsitapproximately180feetsouthoftheproposedrezoning. Access to this site will be from Roosevelt Road which is 20 feet of pavement and a 60-foot right-of-way at this location.If rezoned,the next step for the property owners willbetosubmitasiteplanforCitydepartmentalreview. Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of theZoningOrdinancethatestablishescriteriaforreviewofrezoningrequests.
