Kemler, asking the City Council to reduce the assesment i ;a,gainst Lot 1 of McCoy's Sub, for the paving of Hill street and West Third street as the city took about 47 square feet of same in order to widen the streets and should not be assessed for paving. Presented and read. On motion of Ald. McLaughlin the petition was referred to the Committee of the Whole. Petition of Michael O'Meara asking City Council to remit the taxes against Lot 66. Union Add. and allow the same to remain as a lein, claim- ing he is unable to pay same. Pre- sented and read. On motion of Ald. Andresen the petition was referred to the Committee of the Whole. Petition of the City Fire Fighters Union asking the City Council to amend the rules of the fire department in regard to the annual vacation of the fire department so as to give the firemen an annual vacation of fifteen days with pay as has always been the custom. Presented and raid. Ald. Leist moved to grant the prayer of the petition. Ald. Andresen amended Ald. Leist's motion to refer the petition to the Committee of the Whole. Ald. Leist moved to suspend the rules for the purpose of allowing any fireman presen to address the Council. Carried by the following vote: Yeas —Aids. Notice of claim for damages of Mike Spies in the sum of $5,000.00 for injuries sustained by falling from his wagon which he claims was over- turned by striking a rock which had been left in the street near 181 West Locust street. Communication of Frank Beutin proposing that if the City Council see fit, he will unload his material on North First street and fill said street for 25c per yard, and if the City of Dubuque sees fit to use said street later on they are to reimburse him at said rate. McLaughlin offered the follow- ing: That whereas, Section 1370 Supple- ment to the Code, 1913, relating to equalization of taxes by township trustees, was amended by an Act of the 38th General Assembly of the State of Iowa, providing that in town- ships having a population of 20,000 or more, and situated entirely within the limits of a city under special charter, and in cities under special - charter having a population of 20,000 or over, the City Council of said city shall be the board of review, except that the township trustees of said townships may, in the event the city council does not act as such board of review for such townships, be the board of re- view, the same as township trustees would be in townships in which the township lines are coterminus with city limits. And the City Council of the City of Dubuque has not heretofore acted as a board of review for taxa- tion except for city purposes, now, therefore, Be It Resolved, that it is not the purpose or intention of this Council to act as a board of review for Julien Township, Dubuque County, Iowa, in the equalization of taxes for the year 1919. Strobel offered the following: Be it Resolved by the City Council of the City of Dubuque, That Third street from the west property line of Main street to the east property line of Locust street be improved by grad- ing, curbing with new cement curb with new cement curb where neces- sary, resetting old stone curb where necessary, and by paving said portion of said street with either brick block on a concrete foundation, or with cre- osote wood block on a concrete foun- dation or with sheet asphalt on a con- crete foundation, asphalt or pitch fill- er to be used if the street is paved with brick block or creosote wood black, the same in accordance with the plans and specifications for such improvement prepared by the City En- gineer and now on file in the office of the City Recorder, and be it further Resolved, That said improvement shall be completed on or before the First day of September, 1919, and shall be paid for in the manner prescribed by Chapter XXXII. as amended of the Revised Ordinance of the City of Du- buque for the payment of the cost of street improvements. The proposals for doing said work shall be acted upon by the Council on the Fifth day of June, 1919, and the City Recorder is hereby ordered to give ten days' notice by publication asking for proposals as provided by ordinancfie. An ordinance amending an ordin- ance granting to the Union Electric Company, a corporation of Dubuque, Iowa, its successors and assigns, the right to maintain and operate street railway lines heretofore constructed, along certain streets in the City of Dubuque under rights granted to the Dubuque street railway Company, to David H. Ogden, William L. Allen, and Thomas 0, Swiny, and to the Un- ion Electric Company, and granting to said Union Electric Company, its suc- cessors or assigns, the right to con- struct, maintain and operate lines of street railway, upon and along cer- tain other streets in said city, and to regulate the construction, maintain - ance and operation of such street railway ". Passed by the City Council March 6, 1902, by' changing the first par- agraph of section 18 thereof. Be it ordained by the City Council of the City of Dubuque; - Sec. 1. That an ordinance granting to the Union Electric Company, a corporation of Dubuque, Iowa its suc- cessors and assigns, the right to maintain and operate street railway lines heretofore construed, along certain streets in the City of Dubuque under rights . granted to the Dubuque street railway Company; to David H Ogden William L Allen, and Thomas O. Swiney, and to the Union Electric Company, and granting to said Union Electric Company, its successors or assigns, the right to construct, main- tain and operate lines of the street railway, upon and along certain other streets in said city and to regulate the construction, maintainance and operation of such street railway, said ordinance having been passed by the City Council of the City of Dubuque, March 6, 1902, be and the same is hereby amended by repealing the first paragraph of section 18 thereof and substituting the following, so that the first paragraph of section 18 shall hereafter read as follows. Section 18. The rate of fare to be charged each adult passenger for a continuous trip in one general direc- tion within the city limits shall be 6 1 -4 cents, when said fare is paid for by a ticket and which tickets shall be sold by the company at the rate of 4 for 25 cents, and the com- pany shall keep such books contain- ing such tickets for sale at its prin- cipal office in the City of Dubuque and also provide its conductors with these books to be sold to passengers upon the street cars; provided, however, that when a ticket is not used by a passenger the company shall be per- mitted to charge for each adult cash fare 7 cents. The fare for children under twelve years of age shall be three cents. Section 2. This ordinance shall be in force and affect after its passage by the City Council and publication in the official newspaper of the City of Dubuque as provided by law. Adopted May 20th. 1919.
