Petition of Fielden & Bonz asking
the City Council to grant them per-
mission to install a gasoline filling
station in front of their place of busi-
ness 3197 Couler Avenue. Presented
and read. On motion of Ald. Frith the
prayer of the petition was granted,
they to sign waiver and agreement
drawn up by the City Attorney.
Petition of Peed Bros. asking the
City Council to grant them permission
to install a gasoline filling station in
front of their garage at 445 White
street. Presented and read. On mo-
tion of Ald. Strobel the prayer of their
petition was granted, they to sign wai-
ver and agreement drawn up - by the
City Attorney.
Petition of Wm. Vollenweider ask-
ing the City Council to cancel the spe-
cial assessment against Lot 9 Marsh's
Add. for the construction of a cement
sidewalk in 1915 claiming he had the
walk built himself. Presented and
read. On motion of Ald. Hird the
petition was referred to the Sidewalk
Inspector to report later to the Com-
mittee of the Whole.
Communciation of the Legislative
Committee of System Federation of
Labor, asking the City Council to in-
form them as to what action they in-
tend to take on their petition filed two
months ago calling for a Special Elec-
tion to vote for a Municipal Electric
Light and Power Plant. Presented
and read. On motion of Ald. Strobel
the Communication was referred to
the Committee of the Whole.
Petition of George Oakley asking
the City Council to have a grade estab-
lished on Green street as he wishes to -
biuld a house on said street. Present-
ed and read. On motion of Ald. Hird
the prayer of the petition was granted
and the City Engineer instructed ac-
cordingly.
Petition of John G. Becker asking
the City Council to reduce the special
assessment on Lots 28 and 29 L. H.
Langworthys Sub. for the improve-
ment of Madison street, claiming pro-
perty is on the bluff many feet above
the improvement, and there is no ac-
cess from the property to Madison
street. Presented and read. Ald.
Hird moved to suspend the rules for
the purpose of allowing Mr. Becker
to address the Council. Carried by
the following vote.

Nays: None.
Mr. Becker addressed the Council
relative to his petition.

Petition of property owners on West
Second street asking the City Council
to have the alley between West Second
street and West Third street, from
College avenue to Walsh Street ma-
cadamized. Presented and read. On
motion of Ald. Plamondon the petition
was referred to the Second Ward Ald-
erman.
Petition by citizens asking the City
Council to construct a sanitary sewer
in Seminary street from Harold street
to Woodworth street then in Wood-
worth street to Leibnitz street to
Hempstead street and thence to Kauf-
man avenue. Presened and read. On
motion of Ald. Frith the prayer of the
petition was granted and the proper,
resolutions ordered drawn.
Petition by residents on Leibnitz
street asking the City Council to con-
struct a sanitary .sewer 111 Leibnitz
street from Clifford street to Schroe-
der avenue. Presented and read. On
Motion of Ald. Frith the prayer of the
petition was granted, and the proper
resolutions ordered drawn.
Petition by various business firms
in the lower end of the city asking the
City Council to have a few barrels of
oil placed on the waters in the lower
Main street sloughs. Presented and
read. On motion of Ald.. Andresen the
prayer of the petition was granted and
the Sanitary Officer instructed accord-
ingly.
Petition of Wm. Horrabin, General
Contractor of Iowa City, Iowa asking
the City Council to grant him permis-
sion to sublet to James F. Lee of Dubu-
que such portions of his contract for
the improvement of Main street from
13th to Jones as he may see fit. Pre-
sented and read. Ald Frith moved to
,grant the prayer of the petition. Car-
ried by the following vote.

Petition of the Dubuque Commercial
Club asking the City Council to con-
tribute the sum of $200.00 for the free
public fireworks display on the eve-
ning of July 4th. at the Athelitic Field.
Presented and read. On montion of
Ald. Leist the prayer of the petition
was granted and a warrant ordered
drawn to cover same.
Petition of Voelker Realty Co., ask-
ing the City Council to approve a plat
of Audubon Add. submited by them, as
they wish to proceed with the erection
of houses. Presented and read. On
motion of Ald. Frith the petition and
plat were referred to the Commitee
of the Whole to view the grounds. •
Petition of B. J. Scheer, Christ
Kuehnle and John Oswald asking the
City Council to reimburse them for
damage done by fire to their property
on Angella street. Presented and read.
On motion of Ald. Frith the petition
was received and filed.
Notice of suit of Ida E. Rosencrans
in the sum of $1,000.00 for injuries sus-
tained by falling on sidewalk on Booth
street. Presented and read. On
motion of Ald. Hird the notice was re-
ferred to the City Attorney.
On motion of Ald. Leist the follow-
ing bonds were referred to the City
Attorney. Excavation bonds of A. L.
Hammel; M. Hill, Linehan & Molo,
Rellihan & Mullen, Chas Pape & Son,
Bond of John A. Holland, Deputy City
Treasurer; Bond of Louis Kolfenbach
assistant City Treasurer; and Bond of -

Return of service notices of the re-
solutions of the City Council's inten-
tions to improve Main street from
Thirteenth street to Jones street, ser-
ved on the Dubuque Electric Company,
presented and read. On motion of Ald.
Frith the notices were male a matter
of record.
City Engineer Cullen presented pro-
file No. 980 showing the grade of the
Alley between Locust street and Bluff
street from Seventh street to Eighth
street. On motion of Ald. McLaugh-
lin the profile was adopted and the
Ordinance Committee instructed to
draft an ordinance covering the same.
City Engineer Cullen presented pro-
file No. 979 showing the grade of the
alley between West Second street and
West Third street from College ave-
nue to Walsh street. On motion of
Ald. McLaughlin the profile was adopt-
ed and the Ordinance Committee in-
structed to draft an Ordinance cover-
ing the same.

The petition of J. H. Rhomberg ,by
J. B. Kunz, his agent, relative to the
special assessment amounting to
$59.93 which was levied on lot 225 in
Davis farm addition in the City of
Dubuque for the improving of White
street on January 17, 1895, in which
petition it is claimed that said assess-
ment is outlawed and the petitioner
offers to pay in full of the assessment
the sum of $25.00, has been referred
to me for report.
I beg to advise you that it is my re-
commendation that said petition be
received and filed.

Czizek covering a period of two years
from June 18th. 1917 to the date of
the last report up to and covering this
report. Presented. On motion of
Ald. Leist the report was referred to

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: The petition of the
First Baptist church relative to the
cancellation of taxes assessed :,gainst
lots one and two of lot 756, A McDan-
iel's sub. been referred to me for re-
port. This petition requests tha can
cellation of the taxes upon the grcunci
that said property during the years
for which the taxes'ar" levied, namely,
1916, 1917 and 1918 was owned by the
First Baptist church and ua d for
church purposes. I find from an in-
vestigation of the facts that this prop-
erty was and is owned by the First
Baptist church during the years for
which exemption is claimed- and that
no other use has been made of the
property than preparing the same foi
a church building and I am sut'e that
the intention of the owners of the
property has always been to devote the
same to no other purpose than church
purposes. In view of these circum-
stances I feel that the exemption
prayed for should be granted and 1
would recommend that the prayer of
the petition be granted and the prop-
er officers instructed accordingly.
The petition of Stanley H. Meyer
asking for a soldier exemption on his
homestead, lot 24, Oxfort Heights ad-
dition, has also been referred to me
for report. I understand from the
petition and from the examination I
have made of the facts that Stanley
Meyer enlisted in the military service
on January 12, 1918, and was dis-
charged January 27, 1919. When the
taxes became due upon his home-
stead and before they became de-
linquent, the father of the petitioner,
not knowing anything about the sot-

dier's exemption law and fearing the
property night be sold for delinquent
taxes, paid the taxes upon his son's
property and the son now is asking
for a refund of those taxes since ne
reimbursed the father for his outlay.
I believe that it was clearly the in-
tention of the legislature to grant sol-
diers some reward for their services
and one of the things intended was to
protect a soldier's homestead while he
was in the army. In this ease the
father was ignorant of the law, paid
his son's taxes in order to protect his
property and I am convinced that as
a matter of equity and right this son,
who in the first instance was entitled
to the exemption, should now be re-
turned to him the money which was
paid out in taxes for the year 1918. I
would therefore recommend that the
prayer of this petition be granted and
that the treasurer be instructed to re-
fund to Stanley Meyer the amount or
taxes paid by his father on his behalf
for the year 1918.
You also referred to me the petition
of Mrs. Anna Russell relative to the
refund of $19.45 interest which she
claimed to have paid upon. accrued
taxes. In view of the facts set out in
this petition I do not believe that you
would have the right to grant the peti-
tion and would therefore recommend
that the same be received and filed.

To the Honorable May and Council of
the City of Dubuque:
Gentlemen: The claim of James R.
McConnell for damages on account of
personal injuries sustained on March
4 resulting in a broken collar bone for
which claim is made in the sum of
$5,000.00 has been referred to us for
examination and report. We beg to
advise you that we have effected a set-
tlement with this claimant in the sum
of $125.00 in consideration of which
he releases the city of all further lia-
bility.
Also the case of Mary Meekan et al,
against the City of Dubuque, wherein
damages are claimed on account of
water flowing over the - curbing and
doing damagc.•s to the property of the
plaintiffs in which- action the sum of
$3,000.00 is claimed, the City Attorney
has effected a settlement with the
plaintiffs in the sum of $300.00 which
we believe to be a fair and equitable
adjustment of the case. There are cir-
cumstances surrounding this case
which we are advised would make it
impossible to try the case and in view

of such circumstances we believe that
this settlement should be approved.
We therefore respectfully recom-
mend that this settlement receive your
approval and that warrants be drawn
in favor of James R. McConnell in
the sum of $125.00 and a warrant in
the sum of $300.00 in favor of Kenline
& Roedell, attorneys for Mary Meekan
et al, and the Treasurer asurer - be instructed
accordingly.

for bids for cleaning around the Mar-

Ald. Frith read the communcation
of the Key City Gas Co., relative to
extending gas mains to the Bathing
Beach as follows:
1 The Bathing Beach Committee
to provide any permit for the work
that may have to be obtained from the
City of Dubuque, and to provide us
with a valid and permanent right of
way for the gas pipe extention.
(2) Upon the completion of the ex-
tention, the Bathing Beach Committee
to pay us the sum of three hundred
fifty dollars ($350.00).
, (3) The Key City Gas Company, at
the end of each year, for a period of
three and one -half (3 years from
the time of laying and receiving pay-
ment of the extention, to refund to the
Bathing eBach Committee, or its
assigns, out of any moneys that may
be collected by the Key City Gas
Company from the Bathing Beach
Committee or its assigns for gas sup-
plied through the aforenamed gas
main extention, the sum of such sales
of gas and such collections therefore
during the said period of three and
one -half years, the total of such re-
funds not to exceed, however, the sum
charged and collected by the Gas Com-
pany from the Bathing Beach Commit-

Grace street be improved by grading,
curb and gutter with combination ce-

portion of said street with tar -maca-

provement prepared by the City En-
gineer and now on file in the office
of the City Recorder, and be it further
Resolved, that said improvement

be paid for in the manner prescribed

he shall be empowered to suspend that
person from the City payroll. This

strip from each of the lots abutting
said alley, making said portion of said
alley in accordance with the plans of •
said widening prepared by the City
Engineer and now on file in his of-
fice.
Therefore, Be it resolved by the

that the City Recorder be and he is
hereby instructed to issue a venire
to the Chief of Police and to furnish
him with the names of the owners of
property as furnished him by the City
Engineer, and commanding him to
summon a jury of twelve freeholders,
citizens of said city and not directly
interested to appear at a time and
place therein stated, which time shall
be not less than five days from the
date thereof, and that the Chief of Po-
lice shall give the persons named as

four foot brick block gutters on a con-
crete foundation, grout filler to be
used and by macadamizing said street
between the gutters the same in ac-
cordance with the plans and specifi-

ed by the City Engineer and now on

On motion of Ald. Frith the City
Engineer was instructed to take a
survey for a sewer in Dock street to
the end of the street.
Ald. Hird moved that a 100 C. P.
light be placed at the bottom of the
steps on Bluff street between four-
teenth street and Fifteenth street Car-
ried. .
On motion of Ald. McLaughlin the
City Engineer was instructed co notify
all property owners on Grandview ave-
nue to make all connections with gas,
sewer and water mains before said
street is improved.
On motion of Ald. Frith the City
Engineer was instructed to notify all
property owners on Lincoln avenue to
make all connections with gas, sewer
ad water mains before said street Is
improved.
Ald. Frith" moved that a light be
placed at the intersection of Sanford
street and Washington street. Carried.

Mayor Saul stated that this meet-
ing was called for the purpose of tak-
ing up the proposition of Edith Law-
son, relative to a part payment for
her property that will be taken for
the opening of Louisa street.
Alderman Strobel moved that J. W.
Lawlor, Committee Clerk, be Recorder
pro tem. 'Carried.
Alderman Hird stated that their are
two warrants one for $500.00 and an-
other for $300.00 now drawn in favor
of the mayor for the opening of
Louisa street and that there is a fur-
ther appropriation for $200.000 for the
same purpose, he also stated that
there is a mortgage on said property
for $550.00 held by C. H. Reynolds and
he moved that the warrant for $500.00
be turned over to C. H. Reynolds by
the mayor and that another for $50.00
be drawn in favor of C. H. Reynolds
from the appropriation for the opening
of said street and that a warrant for
the balance of the appropriation
$150.00 be drawn in favor of the May-
or. Carried.

Staner the lowest bidder for the im-
provement of Rosaline street from the
north property line of Leibnitz street
to the north property line of Klingen-
berg Terrace. Also N. J. Staner the
lowest bidder for the improvement of
Ida street from the south property line
of Delhi street to the North property
line of Grace street. On motion of
Aid. Leist .the contract for improving
Rosaline street and Ida street was
awarded to N. J. Staner, he being the
lowest bidder for both improvements.
Petition by residents and owners of
property located on Auburn avenue
asking the City Council to improve
Audubon avenue from the present im-
provement and Willow and Rosedale

Gentlemen: I• return herewith' pe*i-
tion of Howard W. Higley and Henry
Parker Higley. In said petition they
ask for a refund of their taxes for the
year 1918 they having been in the
military service and the taxes having
been paid by Presley Fawkes not
knowing that petitioners were entitled
to exemption.
I feel that as a matter of equity that
the taxes so paid should be refunded
to them. I therefore recommend that
two-thirds (2-3) of the taxes on Lot
3 of Freemont avenue, sub - division,
for 1918, be refunded petitioners, How-
ard W. Higley and Henry Parker Hig-
ley, each owning a 1 -3 (one -chid) in-
terest therein. Amount to be refund-
ed is $24.76.

ter 76 of the Laws of the Thirty -fifth

consecutive issues of a newspaper pub

street from the westerly line of Lot 2
of 2 of Mineral Lot 193, to Woodwroth
street and in Woodworth street from
Seminary street to Leibnitz street, in
Leibnitz street from Woodworth street
to Hempstead street and in Hemp-
stead street from Leibnitz street to
Kaufmann Avenue, showing the loca-
tions and general nature of such im-
provement. the extent thereof, the size
and kind of material to be used, and
to prepare an estimate of the cost
thereof, and the amount assessable
upon each lot or parcel of land ad-
jacent to or abutting thereon per front
feet or square feet in area, and to file
such plat, specifications and estimate
in the office of City Recorder.
That after such plat is so filed, the
City ,Recorder shall cause to be pub-
lished in three consecutive issues of
the official paper of the City of Du-
buque, stating that such plat is on file,
and generally the nature of the sewer,
its location, size and kinds of material
to be used,• and the estimate of its
cost, and fixing the time before which
objections can be filed, which time
shall not be less -than five days after
th last publication of said notice, and
after the completion of the publication
of such notice, he shall at its next ses-
sion, notify the Council thereof in
writing with a printed copy of such

RULES AND INSTRUCTIONS OF
BOARD OF HEALTH.
The following rules and instruc-
tions must be immediately complied
with by all persons, firms and cor-
porations in the City of Dubuque:
1., Garbage cans, made of air -tight
and leak -proof galvanized iron or
heavy tin, having a tight lid or cover,
and being of sufficient size-to hold the
garbage for each family, must be im-
mediately Installed and placed where
the collector- can see it and pick it
up 2. Alleys and yards must be clean-
ed. of dirt, manure and sources of
filth which att "qt flies and breed dis-
eases.
3. All vaults and out - closets which
are within 200 feet of a sanitary
sewer must be discontinued and con-
nections immediately made with such
sewer. All other vaults or cess -pools
must be maintained in a clean and
sanitary condition and so as not to
cause stench or annoyance to any
neighborhood.
4. Stables and barns, chicken
houses and sheds. must be kept ab-
solutely clean and free from filth.
5. Wash or slop water must not be
thrown into any yard, street or alley.
6. Stagnant pools of water must
not be permitted to stand upon any
lot. Every owner of land must see
to it that his lot As properly drained
or filled.
7. All contagious diseases must be
immediately reported and all rules re-
lating to quarantine must be strictly
observed.
Dubuque had a most disastrous ex-
perience last year, having suffered
severely from two epidemics, infan-
tile paralysis and influenza. This
year the Board of Health is deter-
mined to take every precaution, so
far as it lies within its power, to pre-
vent a recurrence of disease in this
city. The simple rules laid down
above will be enforced, no matter,
whom they affect. The life and
health of our citizens are at stake.
Co- operation with the Health Depart-
ment will produce immediate results,
and co- oneration is solicited. Let it
be the duty of every person not only
to keep his own premises clean but
see to it that the premises of his
neighbor is also kept clean. Report.
any 'case of violation to the Health
Department and it will be attended
to. Periodical inspection of alleys
and premises will be made by the
board. Any person, firm or corpora-
tion violating any of the rules of the
Board, of Health will be immediately
prosecuted and fined in a sum not to
exceed One Hundred ($100.00) Dol.
lars, or imprisoned not more than 30
days. Five days' time from the date
hereof is hereby given to "clean up."
After that time no excuse will be ac-
cepted. These rules will be insisted
upon during the entire summer.
