Petition of Dubuque Moose Lodge,
asking the City Council for•permission
to use the Armory Hall for the pur-
pose of holding a dance on •Tuesday
evening, February 12th, presented and
read. Al. McLaughlin moved to grant
the prayer of the petition. Lost by

Petition of James L: Mullin et al.,
'asking the City Council to grant them
a 'one -third reduction en their special
assessment for the improvement of
'West Third street on aec'ount of said
street being a waterway, presented
and , read. Ald. Callahan 'moved to
grant the prayer of 'the petitioners.
'Ald. Frith amended 'Ald: Callahan's
motion t'o refer the petition to the
Committee of the Whole. Lost by the
following vote: Yeas —Alds. Frith,
Wallis. Nays -Aids. Callahan, Leist,
McLaughlin, 'Plamondon, Strobel.
Ald. Wallis moved to take from the
Committee of the Whole the petition
of,the property owners on Seventeenth
street, asking,the City Council to grant
them a reduction on their special as-
sessment 'for: the improvement of said
street on account of the same being a
waterway, and act on both petitions.
Carried by the following vote: Yeas —
Alds. Callahan, Frith, Leist, McLaugh-
lin, Plamaudon, Strobel, Wallis. Nays
— None. Ald. Strobel moved to grant
the property owners abutting the im-
provements on West Third street and
Seventeenth street a reduction of 30
per cent on their special assessments
providing that they all sign an agree-
ment to be drawn up by the City At-
torney, dismissing all , suits and costs
of same against the City of Dubu'uge

for the improvements of said streets

• Petition of John C. Burke, care -taker
of the First ward scales, asking the
City Council to place his name on the
payroll as his receipts are too small
for living expenses, presented - ' and
read. On motion of Ald. Callahan,
the City Auditor was instructed to
place the name of John C. Burke on
the officers' payroll, his salary to be
$10.00 •per month. •
Petition of Frederick O'Donnell,
asking the City Council to allow him
a soldier exemption on his home on
Grandview avenue, presented and read.
On motion of Ald. Wallis, the prayer
of the petitioner was granted and tho
City Treasurer instructed accordingly.
Petition of the Iowa Telephone Co.,
asking •the City Council to release
their bond covering the liabilities on
the Rhomherg avenue job, presented
and read. On motion of Ald. Strobel,
the petition was referred to the Com-
mittee of the Whole.
Petition of J. J. Nagle, asking • the
City Council to sell to him that portion
of Camp street 'which lies easterly of
the 'east line of Water street, presented
and read. On motion of Ald Wallis,
the City Recorder was instructed to
notify Mr: Nagle that the City Coun-
cil has not the power to sell said
street to the detriment of other prop-
erty. '
Communication of Standard Oil Co.,
advising that they accepted the ordin-
ance granting them the right to in-
stall pipe lines from their plant to the
Mississippi 'river, presented and "read.
On motion of Ald. Strobel,' the 'com-
munication was made a matter of
record. ' ' • -
Petition of The .Young Women's
Christian Association, asking the City
Council to exempt their taxes for the
year 1917 on account of their proper-
ty being used for benevolent purposes,
presented and read. On motion of
Ald. Frith, the petition was referred
to the Committee of the Whole.
Petition of• N. F. Friedlein, 'D. C.,
asking the City Council to exempt his
property from city taxes on account
'of his property being used solely for
agricultural purposes, 'presented' and
read. On motion of Alt). 'Leist, the
petition was referred to the Commit-
"tee of the Whole to view the grounds.
Petition of the Federal Deposit &
Trust Co:, asking the City Council to
allow Mrs.' Wheat an exemption as a
soldier's widow in the sum of
$1,500.00 on Lot 30, Langworthy's
Add., presented and read. On motion
of Ald Leist, the prayer of the pe-
titioner was granted and the City
Treasurer instructed accordingly.

from $400.00 to $100.00 for the year

of Ald. Strobel, the prayer of the pe-
tioner was granted and the City Treas-
urer instructed accordingly.
Petition of Nicholas Grommersch,
by Frantzen & Bonso'n, his attorneys,
asking, the City Council to refund to
him the sum of -$7.00 as excess taxes
paid on Lot 1 of the Sub. of.Mineral
Lot 346 for the year 1917, presented
and read. On motion of Ald. Strobel,
the petition was received and filed.
Petition of Eagle Point Bathing
Beach Commission, asking the City
Council to make an appropriation
sufficient to properly provide for the
care of the beach during the season
of 1918 and also asking the City
Council to open t street from Rhom-
berg Avenue down to the Bathing
Beach, presented and read. On mo-
tion of Ald. Frith, the petition was
referred to the Appropriation Com-
mittee.
Petition of Fabian Beckett, asking
the City Council for permission to use
the Armory Hall on the night of April
5th, 1918, for the purpose of holding
a dance for the 'benefit of the next
body of young men called to Camp
Dodge from Dubuque and 'Dubuque
County, presented and read. Ald.
Frith moved to suspend the rules for
the purpose of allowing Mr. Beckett
to address the Council. Carried by

Gentlemen: A decree in foreclos-
ure was entered by the District Court
of Dubuque County, Iowa, at the pres-
ent term thereof 'in the case of George
A. Eulberg vs. John Trexler and Jose-
phine Trexler, his wife, City of Du-
buque. County of Dubuque, Ed. W.
Burch, Catherine Shannon and Du-
buque Industrial Corporation, equity ,
No. 19315.
This Action was a foreclosure of a
mortgage which the • plaintiff held
against the defendants, - John Trexler
and Josephine Trexler, his wife. The
city was made a party to the suit
because of the fact that said John
Trexler was delinquent in his taxes
regular and special, and the lien of
the city was given priority under the
decree, a copy of which is hereto at-
tached and made a part of this re-
port and is to be used as a guide to
the city treasurer, whose records can
be corrected accordingly.

of the City of Dubuque:
Gentlemen: The undersigned com-
mittee on claims and city attorney re-
spectfully recommend a settlement in
the following cases for the respective
amounts stated herein:
Law Number 18957. Charles Krum-
bach vs. City of Dubuque, for the sum
of Two Hundred and Sixty Dollars
and cost
Law Number 18958. R. W. Kem-
ler, et al, vs. City of Dubuque, for the
sum of Two Hundred and Fifty Dol-
lars and cost.
Law Number 18955, John Philips
vs. City of Dubuque, for the sum of
One Hundred and Twenty -five Dollars
and cost.
These actions all were brought by
the respective plaintiffs to recover
damages which resulted from the
overflowing of a defective storm sew-
er on September 5, 1916, said sewer
being located on Alpine street. Dur-
ing a rain storm the water overflowed
and destroyed , a large retaining' wall
which was built at the rear . , plain-
tiffs' lots. The case of Krubach vs.
the city was tried in the District court
in the March term, 1917, and resulted
in a verdict against the city in the
sum of Two Hundred and Sixty Dol-
lars ($260): The remaining two
cases are still pending but they in
velve the same set of facts , as the
Krumbach case and we feel that a
verdict would be returned against the
city if they were tried. In view of
these facts we do not feel that it
would be advisable to try the remain
ing cases and thereby create a large
amount of costs and face the danger
of verdicts in greater amounts than
the cases can be settled for. The
settlements herein proposed are less
than the actual damages which were
sustained and we feel that it would be
to the advantage of the city to settle
the cases upon the above terms rather
than to try them. -
We, ' therefore. ' recommend that
warrants be drawn in favor of ,Ken -
line and Roedell in the ' following
amounts:
For the Krumbach case, in th'e sum
of. Two Hundred and Sixty Dollars
($260).
For the Kemler case, in the sum' of
Two Hundred and Fifty Dollars
($250).
For the Philips case, in the sum of
One Hundred and Twenty -five Dollars
($125).
That a warrant be drawn in favor
of C. D. Harrington in the sum of
Ninety-seven Dollars and Fifty cents
($97.50), to cover the costs in these
cases, and that the treasurer be in-
structed accordingly.

Gentlemen: Have investiagted at-
tached petition by Mr. Geo. Beier, rel-
ative to sewer assessment against his
lot for sewer constructed in Windsor
avenue in 1916 and we recommend
that same be received and filed as said
assessment is correct. Mr. Beier owns
a corner lot with a frontage on Wind-
sor avenue of 137.3 feet and his as-
sessment that he refers to on Lincoln
avenue was for a sewer frontage of
52.4 feet.

Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That Roshek Bros.
Company, a Corporation organized
under the laws of the State of Iowa,
with its principal place of business at
Dubuque, Iowa, its successors and as-
signs, be and are hereby authorized
to erect and maintain for a period of
fifteen years an enclosed bridge or
arch approximately sixty feet in
length and twelve feet wide, extend-
ing from the building now occupied
by said Roshek Bros. Company, sit-
uated on lots fifty -six (56), fifty -
seven (57) and the north twenty -
three (23) feet of lot fifty -eight,
(58), in the City of Dubuque to the
Wallis Building (so- called), situated
on lots one hundred and forty -one
(141), one hundred and forty -two
(142) and one hundred and forty -
three-A (143 -A), in the City of Du-
buque, and over. and across the alley
extending from Seventh to Eighth
Streets, between Main and Locust
Streets in the City of Dubuque, Iowa,
the said bridge or arch to be not less
than eighteen feet from the grade of
the alley to the underside of the
crown of the bridge or arch and on
condition that said Roshek Bros.
Company, its successors and assigns
shall ever hereafter hold said City
Special Session,
armless from all damages that may
rise or be incurred by reason of the
grant of the privileges hereby made.
Section 2. This ordinance shall
take effect and be in force from and
after its passage and publication one
time in the Telegraph - Herald and
Times- Journal official newspapers of
said City.

deemed necessary and advisable to
improve Jansen avenue, from Fifth

grade, curb and gutter with combina-
tion cement curb and gutter and to
macadamize said portion of said street
and to assess the cost of said grading,
curb and guttering and macadamizing
against the property legally subject
to assessment.

nue, from Fifth avenue to the end of
said Jansen avenue, and the kind or
kinds of material or materials to be
used, and an estimate of the entire

of such improvement, and the amount
assessable upon any railway or street
railway company, the amount and
cost thereof to be paid by the city,
if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to such im-
provement as contemplated by Chap-
ter 76 of the Laws of the Thirty -fifth
General Assembly of the State of
Iowa and acts amended thereby, and
to file such plat and estimate in the
office of the city recorder; that after
the filing of said plat and estimate in
his office, the city recorder shall pub-
lish in three consecutive issues of a
newspaper published in this city, a
notice stating that such plat and esti-
mates are on file, the location ana
nature of the improvement, kind or
kinds of material or materials to be
used, and an estimate of its cost, and
the time before which objections
thereto can be filed, and the time
fixed for hearing, which time shall
not be less than five days after the
last publication of such notice, and
after such publication shall have been
made, the city recorder shall, at the
next regular session of the city coun-
cil, notify the council thereof in writ-
ing, with a printed copy of such no-
tice accompanying the same. Ald.

Gentlemen: At the session of your
Honorable Body held on February 7,
1918, you adopted a motion • that
"Property owners on the improve-
ments of West Third street and Sev-
enteenth street be granted a thirty
per cent reduction on their assess-
ments," etc. The assessment for West
Third street was levied on September
6, 1917, and that for Seventeenth
street on October 4, 1917, and as the
interest charge against those who
have failed to pay and who now wish
to pay on the 30 per cent basis ap-
pears to be some item to them, and
as your action in reference to these
reductions contained nothing in re-
gard to interest charges, I respectfully
request your Honorable Body to in-
struct me from what date I am to
collect interest on these improve-
ments. If, in the opinion of your
Honorable Body, interest should ac-
crue on these improvements subse-
quent to your action of February 7,
1918, I would then recommend that
warrants be drawn on the Special
Bonded Interest Fund in favor of the
following property owners in the
sums indicated, the same having been
the amount of interest charged by me
and paid by the said property owners
prior to your action of Feb. 7, 1918:

Mayor Saul stated that this meet-
ing is called for the purpose of can=
vassing the vote cast at the Primary
Election held February 25th, 1918,
and acting on any other business that
might properly come before a regular
meeting of the 'City Council.
Ald. McLaughlin moved that the
Mayor appoint a committee of three
Aldermen to canvass the vote of the
Primary Election and report back to
the Council. Carried.
Mayor Saul appointed the following
committee: Aldermen Plamondon,
Leist and Frith.
Ald. Frith moved that the Judges
and Clerks of Election of the Third
Precinct of the Third Ward be noti-
fied to be present at the Council meet-
ing to be held at 7:30 p. m. to com-
plete entering the returns in their
poll hooks. Carried.
Aldermen Wallis, Strobel and 'Cal-

REGARDING THE SAME.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That Roshek Bros.
Company, a Corporation organized
under the laws of the State of Iowa„
with its principal place of business at
Dubuque, Iowa, its successors and as-
signs, be and are hereby authorized
to erect and maintain for a period of
fifteen years an enclosed bridge or
arch approximately sixty feet in
length and twelve feet wide, extend-
ing from the building now occupied
by said Roshek Bros. Company, sit-
uated on lots fifty -six (56), '.fifty -
seven (57) and the north twenty -
three (23) feet of lot fifty -eight
(58), in the City of Dubuque to the
Wallis Building (so- called), situated
on lots one hundred and forty -one
(141), one hundred and forty -two
(142) and one hundred and forty -
three-A (143 -A),, in the City of Du-
buque, and over and across the alley
extending from Seventh to Eighth
Streets, between Main and Locust
Streets in the City of Dubuque, Iowa,
the said bridge or arch to be not less
than eighteen feet from the grade of
the alley to the underside of the
crown of the bridge or arch and on
condition that said Roshek ,Bros.
Company, its successors and assigns
shall ever hereafter hold said City
harmless from all damages that may
arise or be incurred by reason of the
grant of the privileges hereby made.
Section 2. This ordinance shall
take effect and be in force from and
after its passage and publication one
time in the Telegraph- Herald and
Times - Journal official newspapers of
said City.

NOTICE OF THE CITY COUNCIL'S
INTENTION TO IMPROVE JAN -
SEN AVENUE, FROM FIFTH
AVENTJE TO THE END OF SAID
JANSEN AVENUE.
To Whom It May Concern:
You and each of you are hereby
notified that it is the intention of the
City Council of the City of Dubuque,
Iowa, to improve Jansen Avenue,
from Fifth Avenue to the end of said
Jansen Avenue.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engi-
neer that said improvement will re-
quire:
1,300 lineal feet of cement curb
and gutter.
100 square feet of cement gutter.
1,880 square yards of macadam.
Making a total estimated cost to
the legally assessable property own-
ers of $3,00.00.
Any' person having objection to
said improvement is hereby notified
to appear before the City Council at
its next regular session, to be held
Thursday, March 7, 1918, or to file
with the City Recorder their objec-
tion in writing on or before March
7, 1918.
