Duggan and Members of the City Council DATE: August 29, 2003 RE: Claim Against the City By Brent Garbett Claimant Date of Claim Date of Loss Nature of Claim Brent Garbett 08/27/03 08/26/03 Vehicle Damage This is a claim in which claimant alleges that that as he was ddving onto Bluff Street from West 17th Street, wet paint from the street markings splattered onto his vehicle. According to the report of Mike Koch, Public Works Director, this claim relates to the 2003 Pavement Marking Program that is being done by Selco, Inc. The contract called for the standard form of contracts and bonds with the City, which require the contractor to hold the City harmless from any claims of damage resulting from the work. It is therefore the recommendation of Mike Koch to refer this claim to Selco, Inc. The Legal Department concurs with this recommendation.
