Acceptance of Public Improvements in Cedar Ridge Farm Place No. 4
Public Works Director Mike Koch is recommending acceptance of the public
improvements that the developer, Nemmers Cedar Ridge Farm Limited Partnership,
has recently completed in Cedar Ridge Farm Place No. 4, except the stormwater
detention facilities. Maintenance of said improvements shall be the responsibility of the
contractor, Connolly Construction, and the owner, Cedar Ridge Farm Limited
Partnership, for a period of two years from the date of acceptance.
The stormwater detention facilities will be accepted after 80% of the lots are developed
and erosion control measures have been installed on the remaining 20% of the lots.
The owner and the contractor will be responsible for the detention facilities until
accepted by the City.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Acceptance of Public Improvements in Cedar Ridge Farm Place
No. 4
INTRODUCTION
The enclosed material prOvides for City Council acceptance of the public
improvements which the developer, Nemmers Cedar Ridge Farm Limited
Partnership, has recently completed in Cedar Ridge Farm Place No. 4.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 350-01, the
developer of Cedar Ridge Farm Place No. 4 was required to install certain
improvements including street paving, storm sewer, sanitary sewer, watermain,
street lighting, and stormwater detention facilities and to dedicate the
improvements to the City upon completion. The developer of Cedar Ridge Farm
Place No. 4 has recently completed the improvements and has formally
requested the City's acceptance of the public improvements which have been
installed.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
On August 7, 2003, Nemmers Cedar Ridge Farm Limited Partnership requested
City's acceptance of the improvements in Cedar Ridge Farm Place No. 4. Upon
inspection by the City, it has been determined that all of the public improvements
required by Resolution No. 350-01, except stormwater detention facilities, have
been completed in accordance with plans approved by the City Council and in
conformance with City specifications.
The stormwater detention facilities will be accepted after 80 percent (80%) of the
lots are developed and erosion control measures have been installed on the
remaining 20 percent (20%) of the lots. The owner and the contractor will be
responsible for the detention facilities until accepted by the City.
RECOMMENDATION
I would therefore recommend that the City Council accept the improvements
except the stormwater detention facilities. Maintenance of said improvements
shall be the responsibility of the contractor, Connolly Construction, and owner,
Nemmers Cedar Ridge Farm Limited Partnership, for a period of two years from
the date of acceptance by the City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

ACCEPTING IMPROVEMENTS IN CEDAR RIDGE FARM PLACE NO. 4
Whereas, pursuant to Resolution No. 350-01, certain improvements
including street paving, storm sewer, sanitary sewer, watermain, and street
lighting were installed by the developer of Cedar Ridge Farm Place No. 4.
Whereas, the improvements have been completed except for stormwater
detention facilities, and the City Manager has examined the work and has filed a
certificate stating that the same has been completed in accordance with the
plans approved by the City Council and in conformance with City specifications,
and has recommended that the improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvements in Cedar Ridge Farm Place No. 4 be and the same
is hereby accepted, except for the stormwater detention facilities.
Section 2. That maintenance of said improvements shall be the
responsibility of the contractor and the owner for a period of two years from this
date.
