Van Milligen, City Manager Medical Associates - Acceptance of Quit Claim In 1996 Medical Associates Realty, L.P. platted Medical Associates Subdivision No. 2. The area between the existing railroad and the buildable area of the site was numbered Lot 11 on said plat and was intended to be dedicated to the City of Dubuque for a greenway or park. It has been discovered that the dedication of Lot 11 was inadvertently omitted from the owner's consent on the final plat. Public Works Director Mike Koch recommends acceptance of a Quit Claim Deed for Lot 11 of Medical Associates Subdivision No. 2. I concur with the recommendation and respectfully request Mayor and City Council approval. Koch, Public Works Director ;~,~'//~ Medical Associates - Acceptance of Quit Claim INTRODUCTION Enclosed is a resolution accepting a Quit Claim Deed for property adjacent to Medical Associates Clinic east of the Northwest Arterial and north of the Canadian National/Illinois Central Railroad platted as Lot 11 of Medical Associates Subdivision No. 2. BACKGROUND In 1996 Medical Associates Realty, L.P. platted Medical Associates Subdivision No. 2. The area between the existing railroad and the buildable area of the site was numbered Lot 11 on said plat and was intended to be dedicated to the City of Dubuque for a greenway or park. The plat was approved by Resolution No. 379-96 and recorded as Instrument No. 3247-97. The City Council Resolution noted the acceptance of the dedication of Lot 11 as part of the plat approval. However, upon further examination, it was discovered that the dedication of Lot 11 was inadvertently omitted from the owner's consent on the final plat. In order to clarify the offer to dedicate and the ownership of Lot 11 of Medical Associates Subdivision No. 2, Medical Associates Realty, L.P. has prepared and executed a Quit Claim Deed to the City of Dubuque for said Lot 11. RECOMMENDATION Lot 11 of Medical Associates Subdivision No. 2 should be accepted by the City Council. I would recommend adoption of the enclosed resolution accepting the Quit Claim Deed. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the Quit Claim Deed from Medical Associates Realty, L.P. Prepared by Ronald J. Turner RESOLUTION NO. 323-03 A RESOLUTION ACCEPTING A CONVEYANCE OF PROPERTY LOT 11 OF MEDICAL ASSOCIATES SUBDIVISION NO. 2 IN THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA Whereas, Medical Associates Realty, L.P. agreed to dedicate Lot 11 of Medical Associates Subdivision No. 2 in the City of Dubuque, as shown on the Final Plat of Medical Associates Subdivision No. 2 thereof; and Whereas, Medical Associates Realty, L.P. has executed a conveyance of said property in the form of a Quit Claim Deed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of, accepts and consents to the Quit Claim Deed from Medical Associates Realty, L.P., copies of which are attached hereto, as required by Iowa Code Section 569.7. Section 2. The Mayor is hereby authorized and directed to execute and acknowledge on behalf of the City of Dubuque any instruments in connection herewith. 2003.
