INTRODUCTION
The enclosed resolution provides for the award of the construction contract for the Port
of Dubuque Logging Properties - Building Demolition and Site Clearance Project.
BACKGROUND
The Demolition and Site Clearance Project includes: the complete demolition of
existing structures; the excavation, removal, clean-up, and disposal of all building
materials from the former Miller Logging and the Dubuque Hardwoods properties; and
the disconnection and abandonment of both City and public utilities to the site.
To comply with DNR and federal regulations and to reduce the potential liability of the
City, the contractor will be required to dispose of all solid waste demolition materials at
the Dubuque Metropolitan Area Solid Waste Agency Landfill. The City, however, shall
incur all associated landfill solid waste disposal costs that are estimated at $50,000 to
$75,000.
The contractor is responsible for providing an off-site disposal area and transport all
solid fill, salvageable or scrap materials to the off-site disposal location. The City will
not incur any landfill disposal charges for solid fill, salvageable or scrap materials.
BID RESULTS
Sealed bids were received on the project on August 7, 2003. WC Stewart Construction
Company of Dubuque, Iowa submitted the Iow bid in the amount of $69,000. This
amount is 31% under the engineer's estimate.

Whereas, sealed proposals have been submitted by contractors for the
Port of Dubuque Logging Properties - Building Demolition and Site Clearance
Project pursuant to Resolution No._5~?-P.~ and notice to bidders published in a
newspaper published in the City of Dubuque, Iowa on the 25th day of July, 2003.
Whereas, said sealed proposals were opened and read on the 7th day of
August, 2003, and it has been determined that the bid of WC Stewart
Construction Company of Dubuque, Iowa, in the amount of $69,000.00 was the
lowest bid for the furnishings of all labor and materials and performing the work
as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to WC Stewart
Construction Company and the Manager be and is hereby directed to execute a
contract on behalf of the City of Dubuque for the complete performance of the
work, subject to HUD authorization and the release of Federal Economic
Development initiative Grant Funds.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.

Demolition and Site Clearance Project. WC Stewart Construction Company submitted

However, the City has not received release of funds from HUD because of ongoing
review by the State Historic Preservation Office. Release of the grant funds may be
delayed until mid-September.
Because of the delay in receiving the release of funds from HUD, the City is not
authorized to execute a contract until that time.
Public Works Director Mike Koch recommends that the public hearing be held and the
plans and specifications approved, but the award of the contract to WC Stewart
Construction Company be deferred until the September 2, 2003 Council meeting. This
is allowed under the project specifications, which require the contractor to guarantee the
bid through September 7, 2003.

Because of the delay n receiving the release of funds from HUD sometime in about mid-
September, the City is not authorized to execute a contract until that time. At the September 2.
2003 Council meeting, City staff should have more information on the anticipated date of the
HUD release of funds.
Two options exist with regard to the award of this contract. The first would be a conditional
award with a voluntary extension of the bid guarantee from the contractor beyond the normal
30-day period, or by September 2, HUD may have already released the funds and the award
would be straightened with no contingencies. Knowing this release date at the time of the
award will allow the City to make a more informed award of this contract.
RECOMMENDATION
I recommend that the award of this contract to WC Stewart Construction Company be deferred
until the September 2, 2003 Council meeting. This is allowed under the project specifications.
which require the contractor to guarantee the bid through September 7. 2003.
The public hearing and the adoption of the final plans and specifications were set for August 18.
2003 when the project was initiated. It is, therefore, necessary that the public hearing proceed
as planned and that the project plans and specifications are given final approval at this meeting.
ACTION TO BE TAKEN
The City Council is requested to hold the public hearing or the project and to adoo[ the
Resolution Approwng the Final Plans and Soecifications.

INTRODUCTION
The enclosed resolutions authorize the public bidding procedures for the Port of
Dubuque Logging Properties Building Demolition and Site Clearance Project.
BACKGROUND
On July 1. 2003, the City completed the land acquisition of both the Miller
Logging and the Dubuque Hardwoods properties. Miller .ogglng and the
Dubuque Hardwoods operations have been relocated and have since completely
vacated the property.
Prior to the grand opening for the Conference and Education Center ant to clean
up the 5TM Street entry corridor into the Port of Dubuque, the City intends to raze
all existing building structures and clear the site of the former logging properties.
DISCUSSION
The :~emolition and Site Clearance Project shall include the complete demolition
of existing structures, which includes the excavation of building foundations and
the removal, clean-up, and disposal of all building materials from the fo'mer
Miller Logging and the Dubuque Hardwoods properties. The project shall also
include the disconnection and abandonment of both City and public utilities to the
site.
Based upon both DNR and federal solid waste landfill regulations, all 'naterials
with foam. cork, insulation attached which cannot be separated, all timber and
wood building materials, roofing materials and rail*oad ties, are classified as solid
waste and are required to be disposed at a permitted landfill. To comply with
DNR and federal regulations and to reduce the potential liability of the City, the
contractor will be required to dispose of alt solid waste demolition materials at the
Dubuque Metropolitan Area Solid Waste Agency Landfill.
In an attempt to encourage competitive lump sum bid proposals and eliminate
the contractor's cost, profit plus an unknown contingency factor to cover landfill
disposal charges, the City shall incur all landfill solid waste disposal costs
associated with the project. Based upon review of building materials on-site.
staff has estimated that the landfill disposal charges could range from $50,000 to
$75,OOO.

ORDE RING BIDS
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the Port of Dubuque Logging Properties - Building Demolition and
Site Clearance Project is hereby ordered to be advertised for bids for
construction.
BE IT FURTHER RESOLVED. that the amount of the security to
accompany eacn bid shall be in an amount which shall conform to the provisions
of the Notice To Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements herein provided, to be published m a
newspaper having general circulation in the City of Dubuque. iowa. which notice
shall not be less than four days nor more than forty-five days prior To the receipt
of said bids at 2:00 pm. on the 7TM day of August, 2003. Bids shall be opened
and read by the City Clerk at said time and will be submitted to the Council for
final action at 6:30 p.m. on the 18TM day of August, 2003.
