Enclosed is a copy of a Stipulation of Settlement of a tax assessment appeal, which is
required to be served upon each of you, pursuant to Iowa Code Section 441.44.
The property that is the subject of this appeal is an apartment building located at 1607
Wingate Drive, Dubuque, Iowa, legally described as Lot 2 in "Wingate Place #2", in the
City of Dubuque, according to the recorded plats thereof, with an assessed valuation of
$928,200 as of January 1, 2003.
Sodarock Properties, L.L.C. also appealed the tax assessment for two other apartment
buildings located at 1577 Wingate Drive and 3600 Pennsylvania Avenue. Pursuant to

this Stipulation, those two appeals will be dismissed and the tax assessment will remain
as determined by the Board of Review.
City Assessor Rick Engeiken determined, based upon information provided to him by
Sodarock Properties, LL.C., that the assessed value of the property at 1607 Wingate
Ddve should be reduced from its assessed value of $928,200 to the value in the
Stipulation of Settlement of $835,340, a reduction of $92,860.
The proposed settlement will be presented to the Court after fourteen days from the
date indicated on the attached Notice of Voluntary Settlement. If there are any
objections to the proposed settlement, they should be made known to the Court prior to
that time.

STIPULATION OF SETTLEMENT
Appellant, Sodarock Properties, L.L.C. and Appellee, Board of Review of the City
of Dubuque, Iowa, state to the Court that the pending litigation with regard to the tax
assessment for the following-described property:
Lot 2 in ~Wingate Place #2", in the City of Dubuque, according to the
recorded plats thereof.
Has been settled and agreed upon as follows:
Land $52,920
Building $782,420
Total $835,340
The parties further agree that the stipulated value includes any equalization order
by the Department of Revenue for 2003.
It is further agreed that upon entry of a Court Order confirming the above
settlement, the above pending litigation shall be dismissed with prejudice, and the Court
costs shall be paid by the Appellant.
