Ald. Callahan moved to suspend
the rules for the purpose of allowing
anyone present in the council cham-

Mr. Reilly, et al, addressed the
council relative to the condition of
the gutters on the improvements of
Ungs and Pfohl streets. On motion
of Ald. Wallis the city engineer was
instructed to have gutters and street
on the improvements of Ungs and
Pfohl streets repaired.
Petition of C. T. Bush, asking the
city council to cancel the sidewalk
assessment against east 1 -2 of lot 30,
Mt. Pleasant Addition, presented and
read. On motion of Ald. Wallis the
petition was referred to the city at-
torney to report back to the city
council.
Petition of G. L. Korman, et al,
asking the city council to improve
Rosaline avenue from Leibnitz street
to Klingenberg Terrace, presented and
read. On motion of Ald. Frith the
petition was referred to the street
committee.
Petition of A. R. Waite, asking the
city council for permission to install
a gasoline tank under the sidewalk on
11th and Clay streets, presented and
read. On motion of Ald. Leist the
prayer of the petitioner was granted,
he to sign the waiver and agreement
drawn up by the city attorney.
Petition of George Schneider, et al,
asking the city council to examine the
condition of the street on Klingen-
berg Terrace from Klein street to
Rosaline street, presented and read.
On motion of Ald. Frith the petition
was referred to the street committee.
Petition of Mrs. Maud Hogan, ask-
ing the city council to cancel her
taxes for the year 1916, presented
and read. On motion of Ald. Pla-
mondon the petition was referred to
the committee of the whole to view
the grounds.
Petition of Mrs. M. Zogg, et al, pro-
testing against the improving of Jan-
sen avenue, presented and read. On
motion of Ald. Frith the petition was
referred to the committee of the
whole.
Communication of Mrs. E. M. Pot-
ter, relative to injuries sustained by
falling on an icy street on February
27, 1917, presented and read. On
motion of Ald. Leist the communica-
tion was referred to the committee of
the whole and Mrs. Potter notified to
be present.
Petition of Miss Rose Kearney, ask-
ing the city council to reduce her
taxes to twenty dollars, the same as
the past two years, presented and
read. On motion of Ald. Plamondon
the prayer of the petitioner was grant-
ed and the city treasurer instructed
accordingly.
Petition of the Western Union Tele-
graph company, asking the city coun-
cil to approve of the sale of the Iowa
Telephone company of conduit to the

To Whom it May Concern:
You and each of you are hereby
notified that it is the intention of the
City Council of the City of Dubuque,
Iowa, to construct an eight -inch tile
pipe sanitary sewer in Seventh Street
Extension, from the end of the pres-
ent sewer in said street, to a point
about three hundred feet east.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engi-
neer that said improvement will re-
- quire:
300 lineal feet of eight -inch tile
pipe.
2 manholes.
Making a total estimated cost to
the legally assessable property own-
ers of $380.00.
Any person having objection to said
improvement is hereby notified to ap-
pear before the City Council at • its
next regular session to be held
Thursday, Seutember 6, 1917, or to
file with the City Recorder their ob-
jection in writing on or before Sep-
tember 6, 1917.

Improving Ungs street, from Seminary
street to -the north line of the inter-
section of Ungs street and Pfohl
.street, and from intersection of Ungs
street and Pfohl street to the end of
said Ungs street, Kenety & Son, con-
tractors.
Amount of Special Assessment
$1,708.83, same to be assessed against
the property legally subject to assess-
ment upon and along said street.
And that there is a plat and sched
ule on file in the office of the City Re-
-showing the street in which said im-
provement was made and the separ-
ate lots and parcels of ground or
specified portions thereof subject to
assessment for such improvement, the
name of the owner thereof as far as
practicable and the amount to be as-
sessed against each lot or parcel of

motion of Ald. Wallis the petition was

On motion of Ald. Strobel the bonds
of Rellihan & Mullen and Wilkin L.
Mauer for excavating in streets and
alleys, were referred to the city at-
torney.
On motion of Add. Frith the follow-
ing claims against Thos. Lee for the
improving of Nevada street were re-
ferred to the city auditor to hold
money due those parties for the con-

Joos, et al, relative to the grading of

the waiver and agreement was refer-
red back to the city engineer to have
the balance of property owners sign
the same.
Original notice of suit of E. L.
Reinecke vs. City of Dubuque, in the
sum of $500.00, for personal injuries
sustained and damage to automobile
in striking an obstruction in street at
1275 Bluff street, presented and read.
On motion of Ald. Strobel the notice
was referred to the city attorney.
City Recorder Shea presented and
read the notice, certified to by the
publishers, of the city council's in-
tention to improve Klingenberg Ter-
race from North Main street to Klein
street, also the written remonstrance
of F. M. Kuirt, et al. On motion of
Ald. Frith the•notice was received and
filed and the remonstrance referred
to the committee of the whole.
City Recorder Shea presented and
read the notice, certified to by the
publishers, of the city council's in-
tention to construct an eight -inch tile
pipe sanitary sewer in Seventh Street
Extension, from the end of the pres-

City Engineer McNulty presented
Profile No. 961, showing the grade of
Seventh street, from the east curb
line of Wall street to a point 250 feet
east. On motion of Ald. McLaughlin
the profile was -adopted and the ordi-
nance committee instructed to draft
an ordinance covering the same.
City Engineer McNulty presented
Profile No. 962, showing the change
in grade of Heeb street, from Kauf-
man avenue to Station 11+35, also
waivers required for same. On mo-
tion of Ald. Wallis the waiver was
made a matter of record and the pro-
file was adopted and the ordinance
committee instructed to draft an or-
dinance covering the same.
Ald. Wallis offered the following:
Whereas, The contract heretofore
entered into by the City of Dubuque
for the improving of Ungs street,
hereinafter described has been com-
pleted, and the city engineer has com-
puted that the cost and expense of
said improvement amount to $1,708.83.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of im-
proving Ungs street from Seminary
street to the north line of the inter-
section of Ungs street and Pfohl
street, and from the intersection of
Ungs street and Pfohl street to the
end of said street, the mayor be and
he is hereby required to execute and
deliver to the city recorder, to be by
him registered and countersigned, six
bonds for Two Hundred and Fifty
Dollars each and one for Two Hun-
dred and Eight and 83 -100 Dollars,
numbered 5156 to 5162, inclusive,
dated October 6th, 1917, payable on
or before seven years after the date
thereof, and bearing interest at the
rate of five per cent peia annum, pay-
able semi - annually.

That to provide for the cost of im-
proving Pfohl street from Ungs street
to the end of said Pfohl street, the
mayor be and he is hereby required to
execute and deliver to the city re-
corder, to be by him registered and
countersigned, four bonds for Two
Hundred and Fifty Dollars each and
one for Ninety -three and 79 -100 Dol-
lars, numbered 5220 to 5224, inclusive,
dated October 6th, 1917, payable on
or before seven years after the date
thereof, and bearing interest at the

ORDINANCE PROVIDING FOR
THE ISSUING OF PERMITS FOR
MAKING EXCAVATIONS. DIS-
TURBANCES AND USE OF PUB-
LIC STREETS, ALLEYS, AVE-
NUES AND HIGHWAYS IN THE
CITY OF DUBUQUE, IOWA, AND
REGULATING THE MANNER OF
MAKING SUCH EXCAVATION
AND PREVENTING OBSTRUC-
TIONS TO PUBLIC TRAVEL AND.
PROVIDING A PENALTY FOR
THE VIOLATION HEREOF.
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. That section 4 of the
ordinance entitled An Ordinance
providing for the 'ssuing of permits
for making excavations, disturbances
and use of public streets, alleys, ave-
nues and highways in the City of Du -,
buque, Iowa, and regulating the man-
ner of making such excavation and
preventing obstructions to public
travel and providing a penalty for the
violation hereof," be, and the same is
hereby repealed and the following'
enacted in lieu thereof:
The fees and charges for re- filling
trenches and replacing pavements
shall be as follows:
(a) Each permit issued from the
City Engineer for trenching and ex-
cavating in public streets, alleys, ave-
nues and public places shall be $1.00,
payable in advance, which money,
when collected, shall be kept in a sep-
arate fund by the Treasurer, to be
paid out upon warrants drawn
against such fund.
(b) For filling and tamping
trenches a charge shall be made at
the rate of 45 cents per cubic yard of
trench filled.
(c) For replacing concrete pave-
ment base a charge of $1.00 per
square yard of said base placed.
(d) For relaying brick pavement
on sand cushion a charge of 50 cents
per square yard.
(e) For relaying asphalt pave-
ment a charge of $3.75 per square
yard.
(f) For relaying single course
concrete pavement $1.25 per square
yard.
(g) For relaying two - course con-
crete pavement $1.50 per square yard.
(h) For cement grout filler in
brick pavement a charge of 10 cents
per square yard.
(i) For pitch or asphaltum filler
a charge of 30 cents per square yard
shall be added.
(j) For Telford or macadam pave-
ment a charge of 90 cents per square
yard shall be made.
(k) For relaying tar or asphalt
macadam pavements a charge of
$1.10 per square yard shall be made.
(1) For relaying creosoted wood
block pavement a charge of $1.75
shall be made per square yard.
(m) For relaying Bitulithic pave-
ment a charge of $3.75 per square
yard shall be made.
Section 2. This ordinance shall be
in force and effect from and after its
passage by the City Council and pub-
lication in the official newspapers- as
provided by law.

tary sewer of eight -inch tile pipe be
constructed in Seventh Street Exten-
sion from the end of the present sew-
er in said street to a point about three
hundred feet east, according to the
plans and specifications of said sewer
prepared by the city engineer and
now on file in the office of the city re-
corder, and be it further
Resolved, that said sewer shall be
completed on or before the 1st day of
November, 1917, and shall be paid
for at the time and in the manner
prescribed by Chapter XXXIV of the
Revised Ordinances of 1901 of the
City of Dubuque for the payment of
the cost of constructing sewers. The
proposals for doing such work will be
acted upon by the council on the 4th
day of October, 1917, and the city re-
corder is hereby ordered to give ten
days notice by publication asking for
proposals as provided by ordinance.

STIPULATION AND AGREEMENT.
WHEREAS, a special assessment
has been levied by the City of Du-
buque to pay for the improvement of
Julien avenue upon Lot One (1) of
Mineral Lot 174, Dr. William Slattery,
owner, said assessment amounting to
Five Hundred Fifty -six and 95 -100
($556.95) Dollars; and
WHEREAS, since the street assess-
ment above referred to was levied the
owner of said lot has had the same
sub divided into two lots, described as
Lot One of One of Mineral Lot 174
and Lot Two of One of Mineral Lot
174, Slattery's Sub- division of the
City of Dubuque; and
WHEREAS, lot Two of One of Slat -
tery's Sub- division has been sold by
the owner to St. Clair Ede, and said
St. Clair Ede is desirous of paying his
portion of the assessment as repre-
sented by the area of the lot which
he owns, in order that his title may
be clear; and
WHEREAS, it has been found that
the lot which the said St. Clair Ede
owns would be assessed according to
area in the sum of Three Hundred
Four and 38 -100 ($304.38) Dollars;
now
THEREFORE, the City Council of
the City of Dubuque does hereby
agree to permit said St. Clair Ede to
pay such assessment as Lot Two of
One of Slattery's Sub - division bears to
Lot One of Mineral Lot 174, the same
being Three Hundred Four and 38 -100
($304.38) Dollars together with the
interest which has accumulated there -
one to date, providing the original
owner does hereby agree to waive any
and all rights which he may have at
Law or in Equity to object to the pay-
ment of the remaining assessment up-
on Lot One of Mineral Lot 174 be-
cause this division of the assessment
is made or for any other purpose
whatsoever.
The signing of this instrument shall
be deemed an acceptance by William
P. Slattery of the conditions hereof,
and shall be understood to mean that
he binds himself, his heirs, executors
and assigns never to raise any objec-
tion or question the validity of the re-
maining portion of said assessments
for the ,street.

agrees to vacate the same upon the
compliance by the Standard Oil com-
pany of the Stipulation herein con-
tained.

WHEREAS, the Standard Oil com-
pany has filed its petition with the
city council of the City of Dubuque
requesting it to vacate Camp street
from South Main street to the Mil-
waukee railroad track, in order that
said company may use the land so va-
cated upon which to build improve-

WHEREAS, this street in its pres-
ent condition is very low and filled
with Water and it is the intention of
said company to fill up said street so
that the same can be built upon; now
THEREFORE, the city council of

North street, from the end of the
present improvement to Louisa street,
O'Farrell Contracting Co., contract-
ors.
Seventeenth street, from the alley
between Clay street and White street,
to the Chicago Great Western Rail-
way company's tracks, Geo. Korman,

The sidewalks on Lemon street,
abutting Lot 1, Fairmont Park Addi-
tion; Lots 43 and 44 of G. R. West's

CURB LINE OF WALL STREET,

Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance es-
tablishing a grade on Seventh Street
Extension from the east curb line of
Wall Street 250 feet east oe and the
same is hereby establisned and adopt-
ed as shown by the profile of said'
street and grade, prepared by the City
Engineer, being profile No. 9e1, B. M.
door sill on the southeast corner of
Seventh Street and Jackson Street,
elevation 20.55.
Said grade begins at the east curb
line of Wall Street, which is station 0,
north curb elevation 20.00, south curb
elevation 20.00; thence to station

That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engineer

ORDINANCE 'PROVIDING FOR
THE ISSUJING OF PERMITS FOR
MAKING EXCAVATIONS. DIS-
TURBANCES AND USE OF P1JB-
LIC STREETS, ALLEYS, AVE-
NUES AND HIGHWAYS IN THE
CITY OF DUBUQUE, IOWA, AND
.REGULATING THE MANNER OF
MAKING SUCH EXCAVATION
AND PREVENTING OBSTRUC-
TIONS TO PUBLIC TRAVEL AND
PROVIDING A PENALTY FOR
THE VIOLATION HEREOF.
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. That section 4 of the
ordinance entitled "An Ordinance
providing for the Issuing of permits
for making excavations, disturbances
and use of public streets; alleys, ave-
nues and highways in the City of Du-
buque, Iowa, and regulating the man-
ner of making such excavation and
preventing obstructions to public
travel and providing a penalty for the
violation hereof," be, and the same is

hereby repealed and the following
enacted in lieu thereof:
The fees and charges for re- filling
trenches and replacing pavements
shall be as follows:
(a) Each permit issued from the
City Engineer for trenching and ex-
cavating in public streets, alleys, ave-
nues and public places shall be $1.00,
payable in advance, which money,
when collected, shall be kept in a sep-
arate fund by the Treasurer, to be
paid out upon warrants drawn
against such fund.
(b) For filling and tamping
trenches a charge shall be made• at
the rate of 45 cents per cubic yard of
trench filled.
(c) For replacing concrete pave-
ment base a charge of $1.00 per
square yard of said base placed.
(d) For relaying brick pavement
on sand cushion a charge of 50 cents
per square yard.
(e) For relaying asphalt pave-
ment a charge of $3.75 per square
yard.
(f) For relaying single course
concrete pavement $1.25 per square
yard.
(g) For relaying two - course con-
crete pavement $1.50 per square yard.
(h) For cement grout filler in
brick pavement a charge of 10 cents
per square yard.
(i) For pitch or asphaltum filler
a charge of 30 cents per square yard
shall be added.
(j) For Telford or macadam pave-
ment a charge of 90 cents per square
yard shall be made.
(k) For relaying tar or asphalt
macadam • pavements a charge of
$1.10 per square yard shall be made.
(1) For relaying creosoted wood
block pavement a charge of $1.75
shall be made per square yard.
(m) For relaying Bitulithic pave-
ment a charge of $3.75 per square
yard shall be made.
Section 2. This ordinance shall be
in force and effect from and after its
passage by the City Council and pub-
lication in the official newspapers as
provided by law.

nue 1135 feet south be and the same
is hereby changed and established as
shown by the profile of said street
and grade, prepared by the City En-
