1917 October Council ProceedingsCITY COUNCIL. (Official.) Special session, October 2, 1917. Council met at 9:25 p. m. Mayor Saul in the chair. Present — Aldermen Callahan, Frith, Leist, McLaughlin, Plamondon, Stro- bel, Wallis. Ald Callahan moved to appoint Cyril D. Lagen Recorder Pro Tem. Carried. Mayor Saul stated that this meeting is called for the purpose of appoint- ing a City Carpenter and acting on any other business that might proper- ly come before a regular session of the City Council. Ald.Strobel nominated Bart Cain as City Carpenter, Ald. Wallis nominated Mike Mel - choir, Ald. Leist moved to adjourn. Lost by the following vote: Yeas —Aids. Frith, Leist, Wallis. Nays —Aids. Callahan, McLaughlin, Plamondon, Strobel. Vote resulted as follows: For Bart Cain —Aids. Callahan, Leist, McLaughlin, Plamondon, Stro- bel. For Mike Melchoir —Aids. Frith, Wallis. On motion of Ald. Wallis the petition was referred to the committee of the whole to view the grounds. Petition of A. M. Pond, asking the city council to reduce the taxes on the property located at the corner of 11th street and Locust street, present- ed and read.. On motion of Ald. Leist the petition was referred to the com- mittee of the whole to view the grounds. Petition of R. J. Love, asking the city council to remit the taxes on Lot 25 in O'Neills' Sub. No. 3, for the year 1916, presented and read. On motion of Ald. Strobel the petition was re- ferred to the committee of the whole. Petition of Susan Crotty, asking the city council to lower the assessment on City Lot 37 of S. M. Langworthys Addition, presented and read. On motion of Ald. Leist the petition was referred to the committee of the whole to view the grounds. Petition 'of Mary M. Langdon, et al, asking the city council to install an electric street light at Cooper's barn on West Fifth street at the turn of said street, presented and read. On motion of Ald. McLaughlin the pray- er of petitioners was granted and the city electrician instructed accordingly. Communication of the Mississippi Valley Waterways association, asking the city council to appropriate the sum of $250.00 as their share toward the cost of meeting the expenses of the association, presented and read. On motion of Ald. Strobel the com- munication was referred to the com- mittee of the whole. Original notice of George A. Eul- berg vs. John Trexler, ffosephine Trex- ler, his wife, Dubuque county and City of Dubuque, relative to a certain real estate mcptgage covering the south middle 1 -5 of out lot Number 453, pre- sented and read. On motion of Ald. Strobel the notice was referred to the city attorney. City Recorder Shea presented and read the notice, certified to by the publishers, of the city council's inten- tion to construct an eight -inch tile pipe sanitary sewer in West Sixteenth street from the manhole at Montrose Terrace to the alley first west of Fair- view Place. On motion of Ald. Wallis the notice was received and filed. Therefore, Be it Resolved by the City Council of the City of Dubuque, That to provide for the cost of im- proving Seventeenth street from the alley between Clay street and White street to the westerly rail of the Chi- cago Great Western Railroad Com- pany's tracks, the mayor be and he is hereby required to execute and de- liver to the city recorder, to be by him registered and countersigned, fifty -seven bonds for Two Hundred and Fifty Dollars each and one for One Hundred and Forty -two and 67- 100 dollars, numbered 5357 to 5414, inclusive, dated November 3rd, 1917, payable on or before seven years after the date thereof, and bearing interest at the rate of five per cent per annum, payable semi - annually. Your committee on streets would respectfully report that we have ex- amined the improvement of the Bee Branch sewer from Twenty- eighth street north and would respectfully recommend that the same be accept- ed, N. Your bathing beach committee would respectfully report that we Regular Session, October 4, 1917 383 have completed the season of 1917 and would respectfully submit our report for your approval, we would also recommend that the city engi- neer be instructed to investigate and see whether or not Tenth avenue can be continued through to the river, also that the harbor master be in- structed to visit the beach daily and keep all house boats from landing on the city property. Wallis offered the following: Be it Revolved by the City Council of the City of Dubuque, That the res- olution heretofore adopted providing for the issuance of bonds to pay for the improving of Pickett street from Cornell street to Henion street be and they are hereby rescinded. Wallis offered the folowing: Be it Resolved by the City Council of the City of Dubuque, That a sani- tary sewer of eight -inch tile pipe be constructed in West Sixteenth from the manhole at Montrose Terrace to the alley first west of Fairview Place, according• to the plans and specifica- tions of said sewer prepared by the city engineer and now on file in the office of the city recorder, and be it further Resolved, that said sewer shall be completed on or before the first day of 'December, 1917, and shall be paid for at the time and in the manner prescribed by Chapter XXXIV of the Revised Ordinances , of 1901 of the City of Dubuque for the payment of the cost of constructing sewers. The proposals for doing such work will be acted upon by the council on the 18th day of October, 1917, and the city re- corder is hereby ordered to give ten days notice by publication asking for proposals as provided by ordinance. To the Honorable Mayor and City. Council of the City of Dubuque: Gentlemen: The case of James H. Hahn vs. City of Dubuque, Law No. 19145, was called for trial at the present term of the District Court. This was a personal injury action for which damages were sought to the extent of Ten Thousand ($10,000.00) Dollars. On Jan. llth, 1917, the plaintiff fell on Johnson avenue near Eagle Point avenue and sustained a broken hip. The claim was baaed upon the fact that the sidewalk at that point was permitted to be dang- erous because of accumulations of ice and snow thereon. When the case was called for trial the plaintiff sub- mitted a proposition of settlement to the undersigned which appealed to us as being fair and reasonable. The proposition was that the city pay the plaintiff the sum of Two Hundred Thirty -five ($235.00) Dollars, where- upon the plaintiff would dismiss his suit and pay all costs made in court. In view of all the circumstances it was deemed advisable by the under- signed to effect a settlement of the case for the above amount. We, therefore, recommend that our action in effecting this settlement be approved by you and that a warrant be drawn in favor of Walter Koerner, attorney for the plaintiff, in the sum of Two Hundred Thirty -five ($235.00) Dollars and the treasurer be instruct- ed accordingly.
