Sand 10/07/03 09/26/03 Vehicle Damage This is a claim in which the claimant alleges that his vehicle sustained blacktop and fresh oil on its sides and fenders after ddving on Goethe Street, Windsor Avenue and Davis Street. Claimant states that there were no signs posted indicating streets were recently blacktopped. According to the report of Mike Koch, Public Works Director, this claim relates to the 2003 Asphalt Paving Project that is being done by River City Paving. The contract called for the standard form of contracts and bonds with the City, which require the contractor to hold the City harmless from any claims of damage resulting from the work. It is therefore the recommendation of Mike Koch to refer this claim to River City Paving for its consideration. The Legal Department concurs with this recommendation. The contract called for the standard form of contracts and bonds with the City, which require the contractor to hold the City harmless from any claims of damage resulting from the work. Therefore, it is the recommendation of the City Engineering Division that this claim for damages be forwarded to River City Paving, Division of Mathy Construction, for further consideration/processing.
