Sale of City Property - Medical Associates Subdivision
A request has been received from Oak Park Place of Dubuque, LLC, the developer of
Lot 10 of Medical Associates Subdivision, to pumhase Lots 1,2 and 3 of Medical
Associates Subdivision No. 3. Public Works Director Mike Koch recommends the sale
of said lots and that the purchase price be established at the cost of surveying, platting,
title search, publication and filing fees. It is further recommended that a public hearing
be set for November 3, 2003.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Sale of City Property - Medical Associates Subdivision
INTRODUCTION
This is in response to a request from Oak Park Place of Dubuque, LLC, the
developer of Lot 10 of Medical Associates Subdivision, for the purchase of Lots
1,2, and 3 of Medical Associates Subdivision No. 3.
DISCUSSION
The attached plat of Medical Associates Subdivision No. 3 shows the proposed
areas to be disposed of. The abutting properties are owned by Oak Park Place
of Dubuque, LLC.
These three lots are a small part of a larger 29-acre pamel that was dedicated to
the City in 1997 for a park or greenway between the Canadian National Railroad
and the Medical Associates Subdivision. A reconfiguration of the proposed
development on the abutting Lot 10 of Medical Associates Subdivision required
0.98 acres to be acquired off of the 29-acre parcel given to the City. The new lot
line will more closely follow the top of the steep hill and not encroach into the
developable area.
The purchase price of the property has been agreed to at the cost of surveying,
platting, title search, publication, and filing fees.
RECOMMENDATION
The City has no plans for the utilization of Lots 1,2, and 3 of Medical Associates
Subdivision No. 3 to be disposed of.
I recommend that the areas indicated by Lots 1, 2, and 3 of Medical Associates
Subdivision No. 3 be disposed of, and that a public hearing be set for the
disposition of the City's interest in the subject area on November 3, 2003. I
further recommend that the purchase price be established at the cost of
surveying, platting, title search, publication, and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the disposal of the property through adoption of
the enclosed resolutions.

Dear Honorable Mayor and City Council Members,
Alternative Continuum of Care plans to proceed with development of Oak Park Place
(Lot 10 of Medical Associates Subdivision) as a senior residential living center, which
was approved by the zoning board in July of 2001.
The approved plan moved our original proposed site access point from Matjorie Circle to
Aggie Street, which enters the site and a point that is approximately 30 feet lower in
elevation. This has presented us with significant challenges related to grading and
alignment of streets and drives within the development.
We are requesting acquisition of adjacent property (three small pie shaped pieces) located
in the Medical Associates Green Belt. These small parcels are located at the top of the
bluff and are inaccessible from the greenbelt area. Use of this property would allow us to
better align the entrance drive with Aggie Street, would allow us to better place the
various structures on the site, and would allow us to significantly reduce the grade of
streets within the development.

RESOLUTION NO. 401-03
RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOTS 1, 2,
AND 3 OF MEDICAL ASSOCIATES SUBDIVISION NO. 3 IN THE CITY OF
DUBUQUE, IOWA
Whereas, Oak Park Place of Dubuque, LLC, has requested the vacating of Lots
1, 2, and 3 of Medical Associates Subdivision No. 3 in the City of Dubuque, Iowa; and
Whereas, IIW Engineers & Surveyors, PC has prepared and submitted to the
City Council a plat showing the subdivision of Lot 11 of Medical Associates No. 2 and
resubdivided into Medical Associates Subdivision No. 3 creating Lots 1, 2, and 3 of
Medical Associates Subdivision No. 3 in the City of Dubuque, iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that Lots
1, 2, and 3 of Medical Associates Subdivision No. 3 are no longer required for public
use, and sale of said lots known as Lots 1, 2, and 3 of Medical Associates Subdivision
No. 3 in the City of Dubuque, Dubuque County, Iowa should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CiTY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lots
1, 2, and 3 of Medical Associates Subdivision No. 3 in the City of Dubuque, iowa.
Section 2. That the conveyance of Lots 1, 2, and 3 of Medical Associates
Subdivision No. 3 in the City of Dubuque, Iowa to Oak Park Place of Dubuque, LLC, be
contingent upon the payment of surveying, platting, title search, publication and filing
fees.
Section 3. That the City Clerk be and is hereby authorized and directed to
cause a notice of intent to dispose of said real estate to be published in the manner as
prescribed by law.

Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on this __ day of ,2003,
the City Council of the City of Dubuque, Iowa met on the day of
,2003, at 6:30 p.m. in the Public Library Auditorium, 360 West 11
Street, Dubuque, Dubuque County, Iowa to consider the proposal for the sale of
real estate described as:
Lots 1, 2, and 3 of Medical Associates Subdivision No. 3 in the City of
Dubuque, Dubuque County, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and
all objections, oral or written to the proposal to sell such real estate, except for
easement as noted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as
Lots 1, 2, and 3 of Medical Associates Subdivision No. 3 in the City of Dubuque,
Iowa to Oak Park Place of Dubuque, LLC, be and the same is hereby approved for
the cost of surveying, platting, title search, publication, and filing fees.
Conveyance shall be by Quit Claim Deed.
Section 2. That the Mayor be authorized and directed to execute a Quit
Claim Deed, and the City Clerk be and is hereby authorized and directed to
deliver said deed of conveyance to Oak Park Place of Dubuque, LLC, upon receipt
of the purchase price in full.
Section 3. That the City Clerk be and is hereby authorized and directed
to record a certified copy of this resolution in the offices of the City Assessor,
Dubuque County Recorder and Dubuque County Auditor.
