Leisure Services Manager Marie Ware is recommending acceptance of the Trail Project
at the Bergfeld Recreation Area including the parking lot off Pennsylvania Avenue, as
completed by Drew Cook and Sons Excavating, in the final contract amount of
$444,582, which was $52,494 over the bid amount. The increase was due to change
orders that included more stone base to stabilize trail and serve as French drains for
seepage; adding a photo sensor to control light fixtures; payment for actual on quantity
items; moving drive to parking lot; and additional rock and drainage for the parking lot.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to recommend that the City Council accept the
Trail Project at the Bergfeld Recreation Area (Industrial Site Development — N. Siegert)
including the parking lot off Pennsylvania Avenue.
DISCUSSION
The Trail Project at the Bergfeld Recreation Area has been completed by Drew Cook
and Sons Excavating in the final contract amount of $444,582. A summary of the
project costs is as follows:

The change orders included more stone base to stabilize trail and serve as French
drains for seepage; adding a photo sensor to control light fixtures; payment for actuals
on quantity items; moving drive to parking lot; and additional rock and drainage for
parking lot. Additional engineering charges related to design of moving the parking lot
driveway west, redesign of parking related to this move as well as addition of
construction staking and inspection services not included in original contract.
The action requested is that the City Council adopt the attached resolution accepting
the improvement and setting the final cost.

RESOLUTION NO. 416-10
ACCEPTING THE TRAIL PROJECT AT THE BERGFELD RECREATION AREA AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Trail Project at the Bergfeld
Recreation Area (the Project) has been completed and the City Engineer has examined
the work and filed a certificate stating that the Project has been completed according to
the terms of the Public Improvement Contract and that the City Engineer recommends
that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved . and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor
from the Trail Project at the Bergfeld Recreation Area, CIF' #360 -1943 appropriation for
the contract amount of $444,582 any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
