City Engineer Gus Psihoyos is recommending acceptance of the public improvements
project and the construction contract for the North Fork Catfish Creek Stormwater and
Sanitary Sewer Improvements Project — Phase I, as completed by Anstoetter
Construction Co., in the final contract amount of $719,884.12, which is a 7.92%
decrease from the original contract amount of $781,801.00. The main reason for the
decreased cost is that the contractor as able to install the sanitary sewer without
$36,700 worth of sheet piling.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvements project
and the construction contract for the North Fork Catfish Creek Stormwater and Sanitary
Sewer Improvements Project — Phase I.
BACKGROUND
The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project —
Phase I involved the replacement of 3,970 feet of 12 -inch diameter clay sewer with 24-
inch diameter ductile iron sewer along the North Fork Catfish Creek from the University
Avenue Extension to just north of Kensington.
DISCUSSION
The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project —
Phase I was completed by Anstoetter Construction Co. of Farley, Iowa, in the final
contract amount of $719,884.12, which is a 7.92% decrease from the original contract
amount of $781,801.00. The main reason for the decreased cost is that the contractor
was able to install the sanitary sewer without $36,700 worth of sheet piling.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $719,884.12 to Anstoetter Construction, Inc. for the North
Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project — Phase I.
BUDGET IMPACT
The summary of costs for the North Fork Catfish Creek Stormwater and Sanitary Sewer
Improvements Project — Phase I is as follows:

The project will be funded from the Fiscal Year 2007, 2008, and 2009 appropriations for
the NF Caffish Creek Interceptor Upgrade — University Avenue to the NW Arterial
(CIP #7101802) in the amount of $1,904,250.
Sanitary sewer improvements associated with all three phases of the North Fork Caffish
Creek Stormwater and Sanitary Sewer Improvements Project are eligible for the FEMA
Hazard Mitigation Grant Program funds. The City borrowed the balance of funds
through the State Revolving Loan Fund (SRF) program and was awarded ARRA
stimulus funds through the SRF program in the form of a forgivable loan. The funding
source breakdown for all three phases of North Fork Catfish Creek Stormwater and
Sanitary Sewer Improvements Project is outlined below:

ACCEPTING THE NORTH FORK CATFISH CREEK STORMWATER AND SANITARY
SEWER IMPROVEMENTS PROJECT — PHASE I AND AUTHORIZING THE
PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the North Fork Catfish Creek
Stormwater and Sanitary Sewer Improvements Project — Phase I (the Project) has been
completed and the City Engineer has examined the work and filed a certificate stating
that the Project has been completed according to the terms of the Public Improvement
Contract and that the City Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Catfish Interceptor Reconstruction and North Fork Sanitary Sewer Improvements
appropriations for the contract amount of $719,884.12 Tess any retained percentage
provided for therein as provided in Iowa Code chapter 573, and to pay such retainage
only in accordance with the provisions of Iowa Code chapter 573.
