City Engineer Gus Psihoyos is recommending acceptance of the public improvements
project and the construction contract for the North Fork Catfish Creek Stormwater and
Sanitary Sewer Improvements Project — Phase III, as completed by Portzen
Construction, Inc., in the final contract amount of $1,626,471.56, which is a 2.5%
increase from the original contract amount of $1,587,080.25. The main reason for the
increase was due to the rock/soil conditions found under the box culvert constructed at
Key Way Drive. Conditions required the placement of concrete to fill the void between
rock and the bottom of the culvert.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvements project
and the construction contract for the North Fork Catfish Creek Stormwater and Sanitary
Sewer Improvements Project — Phase III.
BACKGROUND
The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project —
Phase III involved the replacement of just over 4,700 feet of 12 -inch diameter clay sanitary
sewer from Keystone Drive to the Northwest Arterial (IA32) with a combination of 24 -inch
and 18 -inch diameter ductile iron sanitary sewer.
Phase III also included stormwater management improvements outlined in the Drainage
Basin Master Plan: replacement of the Key Way culverts (CIP 7201662); an additional
culvert at Rosemont Street (CIP 7201911); and creek improvements to improve flow and
stabilize the creek banks from Key Way to the Northwest Arterial (CIP 7201807 & CIP
7202018).
DISCUSSION
The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project —
Phase III was completed by Portzen Construction, Inc. of Dubuque, Iowa, in the final
contract amount of $1,626,471.56, which is a 2.5% increase from the original contract
amount of $1,587,080.25. The main reason for the increase was due to the rock/soil
conditions found under the box culvert constructed at Key Way Drive. Conditions required
the placement of concrete to fill the void between rock and the bottom of the culvert.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment of
the contract amount of $1,626,471.56 to Portzen Construction, Inc. for the North Fork
Catfish Creek Stormwater and Sanitary Sewer Improvements Project — Phase III.

The sanitary sewer portion of the project will be funded from the Fiscal Year 2007, 2008,
and 2009 appropriations for the North Fork Catfish Creek Interceptor Upgrade — University
Avenue to the Northwest Arterial (CIP #7101802) in the amount of $1,904,250. The
stormwater improvements will be funded from Fiscal Year 2006 and 2007 appropriations
for Key Way Channel and Culvert Improvements (CIP# 7201662), the Fiscal Year 2007
and 2008 appropriations for Key Way to Rosemont Channel Improvements
(CIP #7201807), the Fiscal Year 2008 appropriation for Rosemont Culvert Improvements
(CIP #7201911); and the Fiscal Year 2009 appropriation for Rosemont to NW Arterial
Channel Improvements (CIP #7202018).
Sanitary sewer improvements associated with all three phases of the North Fork Catfish
Creek Stormwater and Sanitary Sewer Improvements Project are eligible for the FEMA
Hazard Mitigation Grant Program funds. The City borrowed the balance of funds through
the State Revolving Loan Fund (SRF) program and was awarded ARRA stimulus funds
through the SRF program in the form of a forgivable loan. The funding source breakdown
for all three phases of North Fork Catfish Creek Stormwater and Sanitary Sewer
Improvements Project is outlined below:

I respectfully request that the City Council adopt the attached resolutions accepting the
improvements and authorizing the payment of the contract amount of $1,626,471.56 to
Portzen Construction, Inc. for the North Fork Catfish Creek Stormwater and Sanitary
Sewer Improvements Project — Phase III.

SEWER IMPROVEMENTS PROJECT — PHASE III AND AUTHORIZING THE
PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the North Fork Catfish Creek
Stormwater and Sanitary Sewer Improvements Project — Phase III (the Project) has
been completed and the City Engineer has examined the work and filed a certificate
stating that the Project has been completed according to the terms of the Public
Improvement Contract and that the City Engineer recommends that the Project be
accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Catfish Interceptor Reconstruction, North Fork Sanitary Sewer Improvements, Key
Way Channel and Culvert Improvements, Key Way to Rosemont Channel
Improvements, Rosemont Culvert Improvements, Rosemont to NW Arterial Channel
Improvements appropriations for the contract amount $1,626,471.56 less any retained
percentage provided for therein as provided in Iowa Code chapter 573, and to pay such
retainage only in accordance with the provisions of Iowa Code chapter 573.
