This memorandum is to seek your approval and execution of Amendment No. 1 to the July
19, 2010 Agreement for Construction - Related Services between the City of Dubuque and
Strand Associates, Inc. (Strand) for the Water Pollution Control Plant (WPCP) Upgrade
Project (Project). This Amendment provides for the redesign of the ultraviolet (UV) system
that is used in the process of cleaning waste water.
When Strand originally designed the ultraviolet system, it utilized a UV system manufactured
by Siemens.
In accordance with the plans and specifications, the awarded contractor can recommend an
alternate manufacturer to the UV system. Thus, Miron Construction, Inc., the prime
contractor, recommended that the UV system be provided by Ozonia, a worldwide
manufacturer of ozone generation and UV technology for industrial and municipal water
treatment.
The City, as well as Strand, has reviewed the impact to the Project and approved Ozonia as
the alternate UV system manufacturer. Ozonia's system is cost - comparable and can provide
the necessary system reliability and technical support.

BUDGET IMPACT
In order to implement the Ozonia solution, redesign services of $8,000 performed by Strand
will be paid by the City. Miron, however, will compensate the City via deductive change
order in the amount of $28,000 -- $20,000 for the plan /specification change; and $8,000 for
reimbursement of the Strand redesign services.
The net result will be a $20,000 savings for the City.
This procedure follows the requirements of the WPCP contract documents as they apply to
equipment alternate substitutions.
ACTION TO BE TAKEN
The execution of Amendment No. 1 to the July 19, 2010 Strand Associates agreement is
requested.
