The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant, Mike McDonough, representing the American Red Cross, spoke in favor of the sign request, reviewing the size and hours that the existing sign is lit, the proposed size and lighting of the new sign, and the types of services offered by the American Red Cross. Rick Droesky, Lange Sign Company, also spoke in favor of the request. Staff reviewed the size and location of the proposed sign, staff research on why restrictions were included in the 1986 rezoning of property on signage, and City requirements on message center signs. There were several public comments in opposition to the request, noting concerns about lighting, property value and pedestrian and motorist safety. A petition in opposition was received and filed. The Zoning Advisory Commission discussed the request, noting that the existing sign is lit all night. The Commission discussed hours of operation and potential neighborhood impacts. The Commission discussed limiting the hours the message center portion of the sign could be operated from 7 a.m. to 7 p.m., with the upper portion lit from dusk to dawn. Service People Integrity Responsibility Innovation Teamwork The Honorable Mayor and City Council Members Page 2 Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the sign amendment request, with the conditions that the operation of the message center sign be limited to 7:00 a.m. to 7:00 p.m., and the upper portion of the sign may be lit from dusk to dawn. A simple majority vote is needed for the City Council to approve the request. A super majority vote is needed for the City Council to remove or alter the conditions. THE CITY OF DUBS E MEMORANDUM TO: Zoning Advisory Commission FROM: Guy Hemenway, Assistant Planner( October 27, 2010 SUBJECT: To amend the American Red Cross ID Institutional District to permit a 10 foot high, 44 square foot, freestanding sign with an 18.6 square foot electronic message component. INTRODUCTION In July of 1986 the City Council approved the American Red Cross' request to rezone the property at 2400 Asbury Road to ID Institutional District to accommodate the Badger Regional Blood Services Dubuque Facility. The ordinance drafted for the facility further limited the standard ID sign regulations by reducing the height and square footage for freestanding signs and by prohibiting freestanding signs from using internal illumination and intermittent lighting. DISCUSSION The Unified Development Code (UDC) Institutional District sign regulations permit freestanding signs to be up to 10 feet in height and 100 square feet in area and do not prohibit electronic message signs. These regulations were the same in the 1985 Zoning Ordinance. As part of the 1986 rezoning, the American Red Cross ID ordinance reduced the maximum sign height to 6 feet and the maximum sign area to 20 square feet. Also, the ordinance prohibited freestanding signs from using internal illumination and intermittent lighting. The Zoning Commission minutes and other materials on file for the original rezoning do not indicate why the existing bulk standards for permitted signage in the ID regulations were further restricted. It may be that the sign size and lighting was restricted in response to concerns raised by the adjacent residential property owners. The sign, as proposed, will be located along Asbury Road across the 66 foot wide right -of -way from six single - family residential properties. These residences have their front windows oriented toward the American Red Cross' facility. An electronic message sign may cast intermittent light into these windows. Text Amendment to for freestanding signs in an ID District Page 2 Other similar districts such as OS Office Service and OC Office Commercial limit freestanding signs to 10 feet in height and 32 square feet in area and have no prohibition on electronic message signs. RECOMMENDATION Staff recommends that the Commission review the request in Tight of the potential impacts the freestanding sign may have on adjacent residential properties.
