Kennedy Road Description:Final Plat Kopp's John F. Kennedy Addition No. 2 Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the lot layout and noting that the submitted plat facilitates sale of the property. Staff reviewed the final plat and the structures located on the proposed lots and indicated that Lot 2 and Lot 4 do not have frontage on a street. There were no public comments. The Zoning Advisory Commission discussed the request, noting that Lot 2 is actually under the existing commercial building. The Commission did require that Lot 4 be designated as non-buildable lot because it is vacant but has no frontage. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, subject to Lot 4 being designated as non-buildable. A simple majority vote is needed for the City Council to approve the request. Kdtz, Associate Planner 7Z,?. ~', SUBJECT: Final Plat Kopp's JFK Addition No. 2 in the City of Dubuque INTRODUCTION The submitted fina! plat subdivides an existing parcel of land into four lots to facilitate the sale of the building located at 1670 John F. Kennedy Road. DISCUSSION The submitted final plat of Kopp's JFK Addition No. 2 subdivides existing property into four new parcels. Lot 1 is the existing Steve's Ace Hardware building. Lot 3 is the new commercial structure that was built several years ago by Lyle Kopp. Lot 2 actually lies underneath the new structure, and Lot 4 is existing property that does not have frontage on John F. Kennedy Road, but would be utilized as part of Lot 3. The submitted subdivision plat is in substantial compliance with the City of Dubuque Subdivision Regulations, except that Lot 2 does not have frontage on a public or private street, and has 3,975 square feet, where 5,000 square foot is required. The submitted plat does not adversely impact adjacent property and primarily serves to facilitate the sale of the subject property. RECOMMENDATION Planning staff recommends that the Zoning Advisory Commission approve the final plat of Kopp's JFK Addition No. 2 as it is in substantial compliance with the City of Dubuque Subdivision Regulations subject to waiving the lot frontage and lot area requirements for Lot 2. Whereas, there has been filed with the City Clerk a Final Plat of Kopp's JFK addition No. 2; and Whereas, said plat provides Lots 2 and 4 with 0 feet of lot frontage, where 50 feet of lot frontage is required; and Whereas, said Final Plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said Final Plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lots 2 and 4 with 0 feet of tot frontage, where 50 feet of lot frontage ~s required. Section 2. That the Final Plat of Kopp's JFK Addition No. 2 is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
