Ald. Singrin moved that the Coun-
cil Proceedings for the month of No-
vember, 1914, be approved as printed.
Carried.
Ald. McIntosh moved to suspend the
rule for the purpose of allowing the
interested parties living on Rhomberg
Avenue to address the Council in re-
lation to the Special Assessment to
be levied for the improvement of
Rhomberg Avenue.
Carried by the following vote:

tosh, McLaughlin, Singrin, Wallis.
Nays —None.

Mr. B. A. Ruegnitz and Rev. Philip
addressed the Council '_n relation to
a reduction on the Special Assess-
ment for the improvement of Rhom-
berg Avenue. Ald. Clancy entered
and took his seat at 8:55 p. m. Ald.
Clancy moved that the matter of
granting a reduction on the Special
Assessment for the improvement of
Rhomberg Avenue be referred to the
Committee of the Whole and notify
the interested parties to be present.

Petition of John D. Denison, Jr.,
asking the City Council to accept the
sum of $20.00 in full settlement for
the tax levied December 9th, 1895, for
a certain improvement against Lot
7, Julia L. Langworthy's Add., pre-
sented and read. On motion of Ald.
Clancy the petition was referred to
the City Treasurer to report back to
the Committee of the Whole.
Petition of Sylvester J. Patch, ask-
ing the City Council to reconsider
their action in receiving and filing the
protests of property owners on the as-
sessment for the improvement of Villa
Street, presented and read. On motion
of Ald. Clancy the petition was re-
ferred to the Committee of the Whole.
Petition of Abe Urbacn by W. Koer-
ner, his attorney, asking that part of
the assessment levied on Grandview
Park Add., Block 3, Lot 16, be can-
celled, presented and read. On mo-
tion of Ald. Wallis the petition was
referred to the Committee of the
Whole to view the grounds.
Petition of Emil Apel making appli-
cation as driver of the new auto ambu-
lance, presented and read. On motion
of Ald. McIntosh the petition was re-
ferred to the Committee of the Whole.
Petition of Mrs. Elizabeth Heacock
asking the City Council to accept the
SUM of $50.00 as full payment of the
assessment levied against lot 196,
Union, add., for the improvement of
Mountain Lane, presented and read.
On motion of Ald. Clancy the petition
was referred to the Committee of the
Whole.
Petition of Charles T. Thomas ask-
ing the City Council to place the same
valuation on lot 13, Weland's sub., as
it has been in former years, presented
and read. On motion of Ald. Heim the
petition was referred to the Commit-
tee of the Whole.
Petition of J. M. Kenety asking the
City Council to reconsider their action
in receiving and filing a remonstrance
against the special, assessment for the
improvement of Angella street against
lots 13 and 14 in Quigley's out -lot 909,
presented and read. On motion of
Ald. Singrin the petition was referred
to the Committee of the Whole to
view grounds.
Petition of E. A. Buettell complain-
ing that the City of Dubuque cleaned
the snow from the sidewalks on the
morning of December 30th, 1914, both
in front and on the side of his home
on Alpine street and Langworth ave-
nue before the time allowed by ordi-
dance and asking the charge for doing
same be cancelled, presented and read.
On motion of Ald. McLaughlin the
petition was referred to the Commit-
tee of the Whole.
Communication of Union Electruc
Co. together with a list of all the
street lights now installed in the city,
giving their location, presented and
read. On motion of Ald. Wallis the
communication and list were made a
matter of record.
Bond of City Assessor Fred J. Hel-
ler in the sum of $5,000.00, presented
and read. On motion of Ald. Clancy
the bond was referred to the City At-
torney.
Bond of Thos. R. Lee in the sum of
$1,000.00 for the construction of
permanent sidewalks, presented and
read. On motion of Ald. Clancy the
bond was referred to the City Attor-
ney.
Communication of C. H. Reynolds
stating that the bonds of Mullen Bros.
and W. J. Nesler expiring January 1st,
1915, have been renewed, presented
and read. On motion of Ald. Clancy
the communication was referred to the
City Attorney.
Original notice of suit of Hannah
R. Haggerty, plaintiff, vs. City of Du-
buque, defendant, in the sum of $10,-
000.00 caused by falling on a defective
sidewalk, presented and read. On mo-
tion of Ald. Clancy the notice of suit
was referred to the City Attorney.
Notice of Michael McCune, a day
laborer in the employ of the city of
Dubuque, stating that while at work
in the quarry on Hill St. that he dis-
located his right wrist and asking that
the City Council be answerable to Dr.
I. S. Bigelow for furnishing medical
and surgical supplies not to exceed
the amount provided by law, presented
and read. On motion of Ald. Wallis
the prayer of the petitioner was grant-
ed.
Ald. McLaughlin moved that all fur-
ther negotiations of the claim of Mich-
ael McCune against the city of Du-
buque be left in the hands of the City
Attorney. Carried.

Council:
Gentlemen: On November 5, 1914,
your Honorable Body instructed the
City Treasurer to "allow all property
owners for the assessment (on October
30, 1914,) of the improvement of Julien
Avenue from Bluff Street to lot 49
Corriell's Sub., the. amount paid by
them for the brick guttering levied in
1909 ". On October 30, 1914, previous
to the above action. Mr. S. P. Rider
paid the full amount of the assessment
levied on October 30, 1914, and as he
had also paid the full amount of the
assessment levied on October 19, 1909
•amounting to $30.42, I would recom-
mend that a warrant be drawn on the
special bonded assessment fund in fa-
vor of S. P. Rider in the sum of $30.42.

City Electrician Hipman reported as

Gentlemen: I herewith submit my
report of defective lights for month
of December, 1914. I find the report
of the police department that the total

hours that 15 lamps failed to burn
would equal 1 lamp burning for one
month, or $5.62.
Ald. Callahan moved that the City
Auditor be instructed to deduct $5.62
from the Union Electric Company's
bill. Carried.

Gentlemen: Your City Assessor to
whom was referred the attached peti-
tion of Schroeder - Kleine Grocer Co.
asking the City Council to cancel the
taxes of $32,000.00 monies and credits
assessed against them and on account
of it being an erroneous assessment
would respectfully reccommend that
the prayer of the petitioners be grant-
ed and the City Treasurer instructed
accordingly.

Dubuque, Iowa, ,Tan. 4, 1915
To the Honorable Mayor and Council
of the. City of Dubuque:
Gentlemen: Hereto attached please
find statement of costs in the case of
Elizabeth Pier and others against the
City of Dubuque, adjudgment for
which was rendered by the District
Court of Dubuque County on May 31st,
1912. The attached fee bill shows the
total amount of costs to be Forty -three
and 40 -100 ($43.40) dollars, which is
correct. The fee bill also has the O.
K. of George T. Lyon, then City At-
torney. This case was tried in 1912
and judgment rendered against the
city for costs, which costs should be
paid. I, therefore, respectfully recom-
mend that a warrant be drawn in favor
of C. D. Harrington covering the
amount of costs stated and that the
Treasurer be instructed accordingly.

port of the City Attorney was approv-

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: The claim of Mrs.
Catherine McCune filed with your
Honorable Body and referred to me
for report is hereby returned. I beg
to state that the face of the claim re-
veals the fact that Mrs. McCune fell
on the 12th day of Feb., 1912, and sus-
tained personal injuries for which the
sum of Five Thousand ($5000.00)
Dollars is asked.
Tne law covering claims of this char-
acter is very clear and specific and
provides that when a personal injury
is sustained through the neglect of the
city, a claim therefor must be present-
ed to the City Council within thirty
days from the happening of such acci-
dent. In this case more than two
years has elapsed and since the law
provides that no recovery can be had
when the claim is not filed within the
time above stated, it is my duty to
report that in this case I find no legal
liability. My recommendation there-
for is that same be received and
filed, unless your Honorable Body may
deem it advisable to make some other
disposition of the matter.

of the City Attorney was approved.
Alderman Wallis offered the follow-
ing:
Whereas, The contract heretofore
entered into by the City of
Dubuque for the construction of a
sanitary sewer as hereinafter describ-
ed has been completed, and the City
Engineer has computed that the cost
and expense of said improvement
amount to $655.00.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sanitary sewer in 24th
street from the present manhole at
the intersection of Prince and San-
ford street westerly to the alley be-
tween Washington and Elm streets
thence northerly in said alley to 25th
street the Mayor be and he is hereby
required to execute and deliver to the
City Recorder, to be by him registered
and countersigned two bonds for two
hundred and fifty dollars each and
one for One hundred and fifty five
dollars numbered 3660 to 3662 in-
clusive, dated Jan. 7, 1915 payable on
or before' seven yaers after the date
thereof, and bearing interest at the
rate of five per cent per annum, pay-
able semi- annually.
Ald. Wallis moved the adoption of

said street the same width as those
parts at present laid out and opened,

ed to issue a venire to the Chief of
Police and to furnish him with the

Whereas, it is deemed necessary and
advisable to open Platt St. from the
present street to the alley first east of
Cardiff street, taking in part of Lilt
19 of Out Lot 724, part of Mineral
Lot 732, and part of lots 3 and 5 of
Mineral Lot 72, making said portion of
said street the same as those parts
already laid out and opened, accord-
ing to the plans of said opening pre-
pared by the city engineer and now
on file in his office; therefore,
Be it Resolved by the City Council
of the City of Dubuque, That the City
Recorder be and he is hereby instruct-
ed to issue a venire to the Chief of
Police, commanding him to summon a
jury of twelve freeholders, citizens of
said city not directly interested, and
having the qualifications required by
ordinance, for the purpose of assess-
ing any damages which may be sus-
tained by the reason of opening said
street by any owners of property pro-
posed to be taken for such improve-
ment.
All the proceedings under this reso-
lution to be taken in accordance with
the chapter and provisions of chapter
XXXI of the revised ordinance of the
City of Dubuque of 1901.

Be it Resolved by the City Council
of the City of Dubuque, That in ac-
cordance with the provisions of Sec-
tion 7 of Chapter, 63 of the Laws of
the Thirty - fourth General Assembly, it
is hereby determined that inasmuch as
the tax levy for the present year has
been fixed to fourteen mills which levy
is based on the assessment on actual
values on a one hundred per cent
basis, it is hereby determined that
the equivalent thereof based upon a
twenty -five per cent (25 per cent) valu-
ation would be fifty -six (56) mills.
It is hereby ordered that the City
Recorder shall certify said aggregate
value of 65 mills to the County Treas-
urer of Dubuque County, Iowa, for the
purpose of computing the proportion
of the taxes due the city of Dubuque
under said act.

Mayor Saul stated that this meeting
is called for the purpose of taking up
the matter of the damage caused to
Mr. Thilken's automobile by Colliding
with the Chief of the Vire Depart-
ment's automobile and acting on any
other business that might properly
come before a regular session of the
City Council.
Ald. Clancy moved that the City At-
torney be given power to settle the
claim of Mr. Thilken in the sum of
$200.00 for damages to his automobile
caused by colliding with the Chief of
the Fire Department's automobile,

Your special committee to whom
was referred the matter of drawing
up a set of rules governing the use
of the city ambulance, would respect-
fully report as follows:
1. The driver shall remain at the
fire engine house both night and day
while on duty.
2. He shall have one day and one
night off each week.
3. His salary shall be $70.00 per
month,
4. He shall be under the supervis-
ion of the Chief of Police.
5. He shall answer all calls both
night and day.
6. The ambulance shall be absolute-
ly free to all, and the driver shall ac-
cept no fees or donations whatever.

authorized to enter into a contract
with the Dubuque Baseball and
Amusement Association for the pur-
chase of their property on the follow-
ing basis: Total consideration $17,-
500.00, of which $3,000.00 is to be paid
on or before March 1, 1915, the bal-
ance in annual installments of ap-
proximately $3,000.00 per annum, in-
terest on the unpaid balance at 5 per
cent, payable annually.

Mayor Saul stated that this meet-
ing is called for the purpose of adopt-
ing resolutions for the issuance of
bonds and acting on any other busi-
ness that might properly come before
a regular session of the City Council.

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen:— Michael McCune, while
employed by the City of Dubuque as
a quarryman, sustained an injury,
which injury consisted in breaking
one of the small bones in the right
wrist. By reason of such injury,
which occurred more than a month
ago, said McCune has become incapac-
itated from doing any work whatso-
ever and will continue in that condi-
tion for some future time. That as
he was an employe of the city, the
city, under the Employers' Compen-
sation Law, is liable to him for his
injury. In order that said injury
might be compensated, I deemed it
advisable to affect a settlement with
said McCune. The settlement agreed
upon is Seventy -fiye ($75.00) Dollars,
exclusive of his doctor bill, which
amount is in full satisfaction of all
claims and right of action against the
city.
I have also secured from said Mc-
Cune his written release and satisfac-
tion in full, which release is hereto
attached and made a part of this re-
port. It is my recommendation that
this settlement be sanctioned by the
Council and the Treasurer instructed
to draw a warrant in favor of said
Michael McCune for the sum of Sev-
enty -five ($75.00) Dollars.

portion of said street the same as
those parts already laid out and op-
ened, according to the plans of said
opening prepared by the City Engi-
neer and now on file in his office,

Recorder be and he is hereby instruct-
ed to issue a venire to the Chief of
Police, commanding to summon a
jury of twelve free - holders, citizens
of said City, not directly interested,

sessing any damages which may be
sustained by the opening of said
street by any owners of property pro-
posed to be taken for such improve-
ment.
All the proceedings under this reso-
lution to be taken in accordance with
the chapter and provision of Chapter
XXXI of the Revised Ordinance of the
City of Dubuque, of 1901.

FIVE HUNDRED DOLLARS
With interest thereon at the rate
of five per cent per annum payable
semi- annually on the lst day of Janu-
ary and the 1st day of July on the pre-
sentation and surrender of the inter-
est coupons hereto attached, as they
respectfully become due. Both prin-
cipal and interest of this bond are
payable at the office of the City Treas-
urer, at Dubuque, Iowa. This bond
is issued by the City of Dubuque, un-
der and by virtue of sections 848 and
849 of Chapter 8, Title V, of the Code
of 1897 of the State of Iowa, and in
accordance with the resolutions of
the City Council of said City passed
on the 23rd day of January, 1915. This
bond is one of a series of Thirty -Eight
bonds of like tenor, date and amount,
numbered from 3841 to 3878, both in-
clusive, and is issued for the purpose
of providing for the refunding of cer-
tain bonds issued to defray the cost
of certain improvements in, upon and
along certain streets and alleys in
said City of Dubuque, namely: Fourth
Street from Main to White Street,
Seminary Street from west line of
Cox's Addition to West Locust Street,
Prince Street from Eagle Point Ave-
nue to Sanford Avenue, alley between
Pine and Maple Streets from Fifteenth
to Sixteenth Street, alley from Sum-
mit Street to Burch Street between
Fenelon and West Third Streets, alley
from Twenty- second to Twenty -third
Street between Washington and Elm
Street, alley east of Wilson Avenue
from Wilson Avenue to West Eighth
Street, Main Street from Charter to
Jones Street, Cleveland Avenue, Alta
Vista Street, Grandview Avenue
from Delhi to South Dodge Street,
Rhomberg avenue, Windsor avenue,
Dodge street, Windsor avenue from
Lincoln to Garfield avenues, Algona
avenue from West •Fourteenth to Dex-
ter avenue, Ninth street from Main to
Locust street, Burden avenue, Apple
street, alley east of Race street,
Broadway Extension from Diagonal to
Charles street, West Fourteenth from
Delhi to Atlantic avenue, Broadway,
Auburn avenue, Decorah avenue, Del-
aware avenue, Oak street, Dubuque
avenue, Alta avenue, which cost is
payable by the abutting property ben -
efitted thereby, and is made by law
a lien on said abutting property and
payable in seven annual installments,
with interest on same deferred pay-
ment at the rate of five per cent per
annum, and it is hreby certified and
recited that all the acts, conditions
and things required to be done pre-
cedent to and in the issue of this
bond, have been properly done hap-
pened and performed in regular and
due form, as required by law and for
the payment thereof, both principal
and interest, the full faith and credit
of said City of Dubuque, is hereby
irrevocably pledged, in acocrdance
with said section 848 and 849 of chap-
ter 8 Title V of the Code of Iowa,
1897, and the resolutions of the City
Council referred to.
In witness whereof, the City of Du-
buque, by its City Council, has caused
this bond to be signed by its Mayor,
attested by its Recorder with the seal
of the City affixed this 23rd day of
January, 1915.

AND ESTABLISHING A NEW
GRADE 3 +83 TO 4+78 FROM AL-
LEY FIRST WEST OF ALTA
VISTA STREET TO NORTH
BOOTH STREET.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Martha
Street from the alley first west of
Alta Vista Street to North Booth
Street be and the same is hereby es-
tablished and adopted as shown oy
the profile of said street and grade
prepared by the City Engineer, being
Profile No. 858. B. M. Foundation of
brick house No. 164 Alta Vista Street,
elevation 291.82. Said grade begins
at alley first west of Alta Vista Street
which is Station 1+87, old elevation
279.00, new elevation 279.00, thence to
Station 3 +83, old elevation 267.40,

City Council reserved unto itself the
right to reject any and all bids, and

December, 1914, that a special assess-
ment will be levied for the expense
thereof at the Regular Meeting of the
City Council to be held February 4th,

sented and read. On motion of Ald.

for the guardian of the C. J. Young
Estate, situated on the corner of
Eleventh and White Streets, asking
permission for the rebuilding of a
wood shed on said property presented
