Board relative to the City Council fix-

Petition of Wm. O. Buesch, Agent

report of defective lights for month
of January, 1915. I find the report
of the police department that the total
hours that 64 lamps failed to burn
would equal 1 -2 lamp burning for ohe
month, or $2.80.
Ald. Callahan moved that the City
Auditor be instructed to deduct $2.80
from the Union Electric Company's
bill. Carried.

Total
Wolfe vs. City of Dubuque, for ten
thousand ($10,000.00) dollars, for per-
sonal injuries sustained by falling on
a sidewalk on Eleventh Street, im-
mediately west of the alley on the
north side, between Main and Iowa
Streets. I beg to report that I have
Made arrangements to settle said
claim, for the sum of one hundred
($100.00) dollars. Attached hereto is
release properly signed by said claim-
ant, Mary Wolfe. I, therefore, recom-
mend to your honorable body, that a
warrant be drawn in favor of said
Mary Wolfe, for one hundred ($100.00)
dollars, in full settlement of said
claim.

Gentlemen: -I have investigated
the claim of Bridget Hughes vs. City
of Dubuque for personal injuries sus-
tained. I find that there is no liabil-
ity on the part of the City. I there-
fore recommend that said petition be
received aad filed.

On motion of Ald. Heim the report
of the Assistant City Attorney was

To the Honorable Mayor and Council
of the City of Dubuque.
Gentlemen: -The case of Mary L.
Molo and M. C. Lenehan vs. City of
Dubuque, and others, asking for the
cancellation of a certain special as-
sessment for the improvement of
Main Street between Jones Street in
the City of Dubuque and Charter
Street in Dubuque Harbor Company's
Addition to said city, and to set aside
certain bonds which were delivered to
the Treasurer to be sold covering
said improvement, was noticed for
trial at the present January Term of
the District Court.
The facts in the case show that the
above improvement was made during
the year 1893; that a certain series
of bonds were ordered to pay for said
improvement and charged against the
lots belonging to the plaintiffs; that
certain of these bonds placed in the
hands of the. City Treasurer were re-
called without any payment having
been made therefor; That the plain-
tiffs, the owners of said lots at the
time of the special assessment, nor
these plaintiffs, ever consented in
writing or otherwise to the postpone-

ment of the collection of said special
assessment, or to the issuance of
bonds or certificates representing the
amount of said assessment, or made
any agreement with said City Council
with reference tnereto, or with refer-
ence to the time of the collection
thereof, or to the issuance of said
bonds, payable in seven installments
or otherwise; that no effort was ever
made to enforce the collection of said
special assessment by the sale of said
lots upon which the assessment was
a lien; that the special assessment
for said improvement, having stood
upon the books of the Treasurer
since 1893, have become outlawed
and uncollectable.
In view of the foregoing facts we
deemed it advisable to effect as sub-
stantial a settlement as was possible
under the circumstances. Wherefore
the plaintiffs, in order to avoid
further litigation, have agreed to offer
in settlement of the special assess-
ment heretofore levied the sum of
Two I{undred ($200.00) Dollars,
which amount to be in full satisfac-
tion and discharge of the lien created
in the manner aforesaid.
We, therefore, recommend that the
City of Dubuque accept the sum of
Two Hundred ($200.00) Dollars in full
satisfaction of the above special as-
sessment and that the City's Treasur-
er upon payment to him made of said
amount by the plaintiffs, cancel said
assessment and that your honorable
body instruct him accordingly.

producers have filed with this com-
mission their pledge in writing that
within a reasonable time they will' •
make such changes and improvements
in their furnace equipment as may
be necessary to avoid a violation of
the Smoke Ordinance adopted by you
September 3, 1914. The commission,
being satisfied of the good faith of
these parties, recommends that no
proceedings be taken against them
for a violation of said ordinance dur-
ing the period from now until July
1, 1915.

read the notice, certified to by the
publisher's, of the City Council's in-
tention to levy special assessment for
the removing of snow and ice from
sidewalks, for cutting weeds and for
removing dirt and rubbish by the City
during the months of February, April,
June, July, August, September, No-
vember and December, 1914. On mo-
tion of Ald. Wallis the notice was re-
ceived and filed.
Ald. Wallis moved that the resolu-
tion for the special assessment to be
levied by the City Council for the re-
moving of snow and ice from side-
walks, for cutting weeds and for re-
moving dirt and rubbish by the City
during the months of February, April,
June, July, August, September, , No-
vember and December, 1914, be re-
ferred to the Committee of the Whole.

Ald. Wallis moved that the Street
Commissioner be instructed to pre-
pare a bill and present the same to
the Union Electric Co. for the removal
of snow and ice caused by the re-
moval of same from their tracks the
above work having been done by the
City. Carried

Mayor Saul stated that this meet-
ing is called for the purpose of act-
ing on the matter of settling of the
claims of C. B. McNamara & Co. for
the improvements of West Locust and
Arch Streets and any other business
that might properly come before a
regular meeting of the City Council.
Ald. McLaughlin moved to suspend
the rules for the purpose of allowing
Mr. McNamara & Co. to address the
Coucil.
Carried by the following vote:
Yeas —Alds. Callahan, Clancy, Heim,
McIntish, McLaughlin, Singrin, Wal-
lis.
Nays —None.
Mr. C. B. McNamara addressed the
Council relative to his claims for the
improvement of West Locust and
Arch Streets. Ald. Clancy moved that
the City of Dubuque accept the prop-
osition of the C. B. McNamara & Co.
to the effect that the contract price
for the improvements of West Lo-
cust Street and Arch Street be paid
less $450.00 with interest on the whole
amount remaining unpaid, to date.
Said C. B. McNamara & Co. to dis-
miss the action now pending in the
District Court for the collection of
the amount still unpaid and pay the
costs of said suit, it being expressly
understood that this settlement be in
full of all rights of action and claim
which said C. B. McNamara & Co.
may have against said City on ac-
count of said improvements. Carried.
Petition of J. Reuter, et al, asking
the City Council to install two elec-
tric street lights on Burden Avenue
one to be placed between Windsor
and Straus Avenues and the other
between Groveland and Godey Ave-
nues presented and read. On motion
of Ald. McIntosh the prayer of the
petitioners was granted and the City
Electrician instructed accordingly.

Ald. Clancy moved that the matter
of procuring money to pay the con-
tractor, Jas. F. Lee, for the improve-
ment of Rhomberg Avenue be left in
the hands of the Mayor and. Finance
Committee with power. Carried.
Communication of the Mayor of Ot-
tumwa asking the City Council to en-
dorse the passage of the bill known as
Senate File No. 8 governing the fran-
chises of Telephone Companies in the
State of Iowa and communicating the
same to our Representatives and Sen-
ator at Des Moines, Iowa, presented
and read. On motion of Ald. Wallis
the communication was referred to the
City Attorney to secure a copy of
said bill.

Whereas, J. F. Cosgrove, the owner
of Lots 1, 2, 3 and 4 abutting on the
alleyl in Union Addition did petition
the City Council asking for the vaca-
tion of said alley, and
Whereas, said petition was referred
to the Committee of the Whole who
on January 21, 1915, reported favor-
ably upon it, and recommended the
vacation as prayed for, and
Whereas, it is now deemed advisable
to complete the proceeding necessary
for such vacation; therefore
Be it Resolved by the City Council

proposed improvement of the alley

between Eagle Point Avenue and Re-
gent Street; and the kind or kinds of
material or materials to be used, and
an estimate of the entire cost there-
of, and the amount and cost of such
improvement, and the amount assess-
able upon any railway or street rail-
way company, the amount and cost
thereof to be paid by the city, if any.
and the cost thereof and amount, as
sessable upon each lot or parcel of
land adjacent to such improvement
as contemplated by Chapter 76 of the
Laws of the Thirty -fifth General As-

recorder shall publish in three con-
secutive issues of a newspaper pub-

cost, and the time before which ob-
jections thereto can be filed, and the
time fixed for hearing, which time
shall not be less than five days after
the last publication of such uotice,
and after such publication shall have
been made, the city recorder shall, at

Council, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.

Your Finance Committee to whom
(with the Mayor) was referred, with
power, the matter of arrangement to
pay the contractor for the improve-
ment of Rhomberg Avenue (the im-
provement sold) would bonds
espectfu respectfully report as fol-
lows:
$12,500.00 having been paid by prop-
erty owners subject to special assess-
ment for the Rhomberg Avenue im-
provement, that sum was turned over
to the contractor, also $18,000.00 cash
on hand in the City Treasurer. We
then borrowed the following sums of
money from the banks named, giving
notes of the City of Dubuque as secur-
ity:
$10,000.00 from First National Bank
for 30 days at 6 per cent.
$15,000.00 from First National Bank
for 60 days at 6 per cent.
$5,000.00 from Dubuque National
Bank on demand at 6 per ceiit.
$4,000.00 from Federal Deposit and
Trust Co. for 60 days at 6 per cent.
By borrowing the above sums we
were able to complete the payment
of the amount due Jas F. Lee for
Rhomberg Avenue (about $59,500.00
in all) and also to pay Wilmer Cook,
contractor for Fifth Avenue and C. B.
McNamara & Co., contractors, for
sewers in Spruce and Jefferson
Streets, the bonds for which improve-
ments have also not been sold. The
sums borrowed from the banks will
be repaid when the Treasurer has
collected sufficient city taxes, or from
the sale of the improvement bonds or
both. Also we hope the improvement
bonds for these various improvements
will be sold, in which case the treas-
ury will be reimbursed for the money
borrowed from the funds on hand.

computed that the cost and expense
of said improvement amount to $73.07,
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sidewalk on Lot 13 New-
bery and Hale's Sub. the Mayor be
and he is hereby required to execute
and deliver to the City Recorder, to
be by him registered and counter-
signed, one sidewalk certificate for
Seventy -three and 7 -100 Dollars, num-
bered 105, dated March 18, 1915, pay-
able on or before seven years after
the date thereof, and bearing inter-
est at the rate of six per cent. per
annum, payable semi - annually.

Recorder be instructed to advertise
for the purchasing a 15 -ton road roll-
er, an automobile police patrol, a
small automobile touring car and also
for the furnishing of feed for the
City horses. Carried.
Ald. McIntosh moved that the mat-
ter of granting the Union Electric Co.
the permission of changing the wood
block paving from their car tracks
on Couler avenue to brick block pav-
ing be referred to the committee of
the whole to view the grounds. Car-
ried.

Notice of Special Assessment.
Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the city
of Dubuque, Iowa, to be held Thurs-
day, February 18th, 1915, to pay for
constructing a cement sidewalk
abutting Lot 13 Newberry and Hale's
Sub., Thos. R. Lee, contractor.
Amount of Special Assessment,
$73.07, same to be assessed against
the abutting property upon and along
said Lot.
And there is a plat and schedule on
file in the office of the City Recorder
of said City of Dubuque, showing the
Lot in which said improvement was
made and the separate lots and par-
cels of ground o rspecified portions
thereof subject to assessment for
such improvement, the name of the
owner thereof as far as practicable
and the amount to be assessed against
each lot or parcel of ground, which
plat and schedule are subject to pub-
lic inspection.
And that any and all persons ob-
jecting tc said special assessment or
to said plat must file his or their ob-
jections in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil to be held February 18th, 1915, or
to appear at said session of the Coun
cil to show cause, if any you have,
why said assessment should not be
levied.

Notice to Hay and Grain Dealers.
Sealed proposals will be receive$
by the City Recorder until 8:00 p.
Thursday March 4th 1915, to furnish
the Fire, Police, and Street Depart-
ments of the City of Dubuque with
choice Upland Hay and choice Tim-
othy Hay and No. 1 White Oats, for
the term of one year from March 1915.
Such oats and hay to be delivered
in such quantities and such places as
may be ordered by the City from time
to time. All hay and oats to be weigh-
ed on the city Scales and delivered at
the expense of the Contractor . The
oats to be figured at 3 pounds to the
Bushel. Each bid must be accom-
panied by a Certified Check of $25.00
on some Dubuque Bank as a guarantee
that a contract will be entered into if
awarded. The City Council reserves
the right to reject any and all bids.
