1915 May Council ProceedingsCITY COUNCIL (Official.) Special Session, May 1st, 1915. Council met at 2:40 p. m. Mayor Saul in the chair. Present — Aldermen Heim, McIn- tosh, McLaughlin, Singrin. Absent — Aldermen, Callahan, Clan- cy, Wallis. Mayer Saul stated that this meet- ing is called for the purpose o fre- ceiving the report of the City Engi- neer on the contract for the storm water sewer in Fifth Avenue and act- ing on any other business that might properly come before a regular ses- sion of the City Council. Ald. McIntosh moved that the Coun- cil reconsider their action on award- ing the contract to C. B. McNamara & Co. for the construction of a Lock Joint storm water sewer in Fifth Avenue. Carried. Ald. McIntosh moved that the con- tract for constructing a square box storm water sewer in Fifth Avenue be awarded to C. B. McNamara & Co., they being the lowest bidders and their bond placed at 1 -4 the amount of the contract, the amount to be ex- pended on this work not to exceed the appropriation. Carried. Ald. McIntosh moved to refer all matters for the improvement of North Main street to the Commit- tee of the Whole to view the grounds with power. Carried. Petition of the First Baptist Church relative to vacating the five foot strip on 11th. street from Bluff to the stone wall for the erection of a church and also the written remonstrance of F. J. Piekenbrock et al presented and read. Ald. McLaughlin moved to sus- pend the rules for the purpose of al- lowing the interested parties to ad- dress the council. Carried by the following vote: Yeas —Aids. Callahan, Clancy, Heim, McIntosh, McLaughlin, Singrin, Wallis. Nays—None. Messrs Adams et al addressed the council. Ald. City Recorder Shea presented and read the notice certified to by the publisher's, of the city council's in- tention to improve West Third street from the westerly curb line of Burch Street to the westerly lot line of Al- pine street also the written remon- strance of Lester C. Bissell et al. Aid. McLaughlin moved to suspend the rules for the purpose of allowing the interested parities to address the Council. Co. asking the City Council to instruct the City Treasurer to accept the taxes for the year 1912 on Lots 417, 418 and 419 together with the improvements and personal property owned or used by them on a valuation of $5,700 accord- ing to the ordinance adopted March 5, 1907, presented and read. On mo- tion of Ald. Wallis the petition was referred to the City Attorney to re- port at the next meeting of the City Council. Petition of Kretschmer Mnfg. Co. asking for the City Council to instruct tho City Treasurer to accept the taxes for the years 1913 and 1914 on Lots 417, 418 and 419 together with the improvements and personal property owned or used by them on a valua- tion of $5,000 according to the ordi- nance adopted February 1st, 1912, pre- sented and read. 'teynolds stating that while in the employ of the City that he suffered an injury to his left eye and asking the City to pay the cost of the •physi.ian, surgeon and hospital expense to the extent as re- quired by law presented and read. Hille et al ask- ing the City Council to construct a sanitary sewer in the east side of Washington Street between 22nd. and 24th. streets presented and read. On motion of Ald. Petition of Dubuque Lodge No. 355, Loyal Order of Moose asking the City Council to grant then permission to hold an open air carnival at Olinger Park during the week of May 31st. 1915 and asking that no license fee be charged by the city and also to be given permission to use half of the streets adjacent to said Olinger Park presented and read. Vogel asking that city council for permission to erect a small shed to keep his automobile in at 1058 Locust street presented and read. On motion of Ald. Petition of Emil Feigner et al, ask- ing the city council to make the neces- sary repairs of concrete pavement in the alley connecting West 15Ith. street and Fairview Place presented and read. Milligan et al ask- ing that city council to extend the water main to the corner of West 17th street and Catherine street and place a hydrant on same for fire protection presented and read. Ald. McCauley et al, asking the City Council to install an electric light on Rowan street be- tween East Grandview avenue and Southern avenue, presented and read. On motion of Ald. Petition of the Dubuque Motor Boat club and aunch owners, asking the City Council to install an electric light on the south side of First street extension, presented and read. On motion of Ald. Petition of Berg & Kress, asking the City Council for permission to build an approach to be used as a driveway leading into their yard at the corner of Elm street and Eagle Point avenue, presented and read. Assist- ant Engineer, asking the City Council for permission to extend the Illinois Central track on Water street straight out across First street extension into harbor far enough to place car and use barge together and transfer coal either by chute or shoveling, pre- sented and read. Petition of the Dubuque Park board, calling the attention c . the Council to paying the light bills formerly paid by them before the tenth of the month in order to receive the 5 per cent discount, presented and read. Gentlemen: - Very recently a case of the City of Des Moines vs. Iowa Telephone com- pany was decided by a jury in t1 3 Dis- trict Court of Polk county by which a verdict was returned in a very large amount in favor of the city. The ac- tion was brought for the use of the city's streets, alle avenues and highways, with the poles, wires, ca- bles and conduits of the Iowa Tele- phone company, the action being based upon the theory that the tele- phone company was using the streets, etc., without lawful right or authority, not having a franchise, and that the city should be compensated for such use. The identical situation exists in Dubuque. It is true that here we have submitted to the court the ques- tion of whether or rot the telephone company must first secure a franchise a.- a condition precedent to the enjoy- ment of the right to occupy our streets, etc., and as yet has not been decided by said court. That being true it will not be possible or prac- ticable to institute proceedings in the nature of the Les Moines case at once, but as I expect the District Court here will in the near future decide upon the case submitted him, the City Attorney's • office seeks permission from your Honorable Body to prepare and file a suit for money owing and due on account of the use of the city's streets by the telephone company, just as soon as we shall deem such action prudent and advisable. This Ordinance has been prepared by me with the intention to compel the telephone and telegraph com- panies to pay for the privilege which they are enjoying in our streets, al- leys, etc., by occupying the same with their poles and other apparatus. At the present time these companies have have no franchise and until such a time as they make application for and are granted a proper franchise the City of Dubuque should be paid a reasonable rental charge for the privileges and rights enjoyed. Be it Ordained by the City Council of the City of Dubuque: Section 1. That it shall be unlaw- ful for any person, firm or corpora- tion to excavate any street, alley or public place in the City of Dubuque without first making a cash deposit with the City Treasurer to insure the replacing of the said street, alley or public place in as good condition as before the excavation. Section 2. The amount of cash de- posit required for various pavements shall be as follows for every fifty feet of excavation or fraction thereof: Brick, asphalt, concrete, creosoted wood block, or stone blocks, fifty dol- lars ($50.00). M a c a d a m, twenty -five dollars ($25.00). Section 3. Each cash deposit made as required herein with the City Treasurer shall be retained by him until he is ordered by the City Coun- cil to return same to the depositor. Petition of the Illinois Central Rail- road Co. asking to be granted per- mission to lay an additional track in Iowa street east of the easterly track which it now has in said street and parallel thereto, 14 feet from center to center thereof, to a point 62 feet north of the north line of First street where it shall converge with the ter- minate in the track known as Freight House Track, and giving in exchange for the use of public travel and traf- fic thereon that part of its ground ly- ing west between the freight house and the alley from First street to Jones street presented and read. On motion of Ald. McIntosh the pe- tition was referred to the committee o' the whole and notify the represen- tatives of the Illinois Central Railroad Co. and the Sioux City Railroad Co. to be present. Ald. McLaughlin moved to take from the Committee of the Whole the matter of appointing a riarbor Mas- ter and act on same before the coun- cil. Carried Ald. McLaughlin nominated John F. Stemm. Ald. Wallis nominated Charles McCarthy. Ald. Mclntosn moved that the council vote on said appoint- ment by ballot. Carried. John F. Stemm received four votes. Charles McCarthy received three votes. Ald. AN ORDINANCE PROHIBITING THE EXCAVATION OF STREETS, ALLEYS AND PUBLIC PLACES IN THE CITY OF DUBUQUE EX- CEPT UNDER CERTAIN CONDI- TIONS. Be it Ordained by the City Council of the City of Dubuque: Section 1. That it shall be unlaw- ful for any person, firm or corpora- tion to excavate any street, alley or public place in the City of Dubuque without first making a cash deposit with the City Treasurer to insure the replacing of the said street, alley or public place in as good condition as before the excavation. Section 2. The amount of cash de- posit required for various pavements shall be as follows for every fifty feet of excavation or fraction thereof: Brick, asphalt, concrete, creosoted wood block, or stone blocks, fifty dol- lars ($50.00). M a c a d a m, twenty -five dollars ($25.00). Section 3. Each cash deposit made as required herein with the City Treasurer shall be retained by him until he is ordered by the City Coun- cil to return same to the depositor. The City Recorder shall keep an ac- curate account of all deposits re- ceived and returned, which account shall set forth the name of the de- positor, the date and the location and length of the excavation covered by the deposit. Section 4. If, in the opinion of the City Council, the Street Committee, the Mayor or the Street Commission- er, any street, alley or public place has been left, after an excavation has been replaced, in a condition not as good as before excavation, said City Council, Street Committee, Mayor or Street Commissioner may cause repairs to be mane to bring the excavated places to as good condition as before excavation and may pay for the expense of such work out of the deposit made by the party making said excavation. Section 5. Nothing in this ordi- nance shall be taken or construed as superseding or repealing any ordi- nances or parts of ordinances hereto- fore adopted dealing with excava- tions, but this ordinance shall be con- sidered supplementary to such ordi- nances or parts of ordinances hereto- fore adopted.
