To the Honorable Mayor and City Council: Gentlemen: —At a recent meeting of your Honorable Body I Was in- structed to give you a written opinion on the question of the erection of a City Hall. I find that the law provides cities, including cities under special charter, shall have the power to erect a city hall and to purchase the ground therefor. And for the purpose of paying for the construction of such building and the purchase price of such ground, the city has the power to levy upon all the property subject to taxation within the corporate limits an additional tax not to exceed two mills on the dollar, for a period of no more than twenty years. Any city desiring to construct such a building or to purchase ground there- fore may issue bonds in anticipation of the special tax authorized. Such bonds shall be known as the City Hall Bonds, and shall be issued and sold in accordance with the provis- ions of Chapter 12, of Title 5, of the Code of Iowa, and acts amendatory thereto. In issuing such bonds the City Council may cause portions of said bonds to become due at different definite periods, but none of such bonds so issued shall be due and pay- able in less than five nor more than twenty years from date. In issuing such bonds the city may become in- debted in an amount which added to all other indebtedness shall not ex- ceed two per cent. of the actual value of the taxable property as determined by the 1a'st State and County tax list. While the council is given the power in the selection and purchase of a suitable location, and may levy taxes or issue bonds in payment, therefore the approval 'Of the majority of voters voting thereon is necessary before any building may be 'erected, and Without such approval the coun- cil has no authority to levy taxes or issue bonds to meet the cost of the erection of said City Hall. The Council may provide that the question be submitted to a vote at a general city election or at one specially called for that purpose. No- tice of such election shall be given by publication in two newspapers published in said city, once each week for not less than four consecu- tive weeks, and the election shall be held not less than five nor more than twenty days after the last publica- tion of such notice. The question to be submitted shall be in the follow- ing form: Shall the City of Dubuque erect a City Hall at the cost of not exceeding Dollars? Respectfully submitted, M. D. Cooney, Assistant City Attorney. On motion of Ald. McLaughlin the report of Assistant City Attorney Cooney was made a matter of record. To the Honorable Mayor and City Council: Gentlemen: I return herewith the renewal bonds of John Trexler, George Ragatz and Matt Stafford, Police and Fire Commissioners, for a period of one year beginning July 1, 1915, and expiring July 1st, 1916. Dubuque, Iowa, A 19, 1915. To the Honorable Mayor and Council of the City of Dubuque. Gentlemen: — Please find hereto at- tached an Ordinance amending our present traffic ordinance. This ordi- nance has been prepared by me with the view to prevent for all time in the future what has become a nui- sance, namely the parking of ve- hicles upon Main Street. This cus- tom should be stopped at once as ve- hicles parked cn the most congested street in the City become serious ob- struction to travel and the free use of such streets is impaired thereby, which, if permitted to continue will undoubtedly be the cause of acci- dents. With this in mind I have drafted this Amendment to the orig- inal Ordinance which I request that your Honorable Body take up for con- sideration at the earliest moment and, if agreeable, put the same into effect. Respectfully submitted, M. H. CZIZEK, Jity Attorney. On motion of Aid. McLaughlin the report of the City Attorney was ap- proved. Dubuque, Iowa, Aug. 18, 1915. To the Honorable Mayor and Council of the City of Dubuque. Gentlemen:— Recent occurrences have impressed me with the fact it would be advisable for the City Coun- cil to pass an Ordinance as amenda- tory to our present Ordinance relat- ing to the regulation of various busi- nesses and occupations, which amend went should cover the business of taxicabs and automobiles engaged in carrying passengers for hire within the City of Dubuque. It is true that in a good many instances persons are engaged in this occupation who, in the event of a suit brought for dam- ages to persons and property through the negligent and careless operation of such vehicles, no recovery could be had. In order to remedy this con- dition I have prepared an Ordinance amending our previous ordinance upon this subject by which a bond will be required of all persons en- gaged in the above indicated occupa- tion, which bond is in addition to the regular license fee demanded by the City. I would recommend that this Ordinance, which is hereto attached, be referred to your Committee of the Whole for the purpose of minute dis- cussion, and if agreeable and advis- able, then that the same be passed at the earliest opportunity. Respectfully submitted, M. H. CZIZEK, City Attorney. On motion of Ald. McLaughlin the report of the City Attorney was ap- proved and the ordinance referred to the Committee of the Whole. Dubuque, Iowa, Aug. 19, 1915. To the Honorable Mayor and Council of the City of Dubuque. Gentlemen: —At a recent meeting of your Honorable Body there was re- ferred to me the petition of Mary L. Bunting and asking for a report thereon. I respectfully state that I have made an examination of the facts upon which said petition is based and, so far as I can learn, the same are true as states. I would therefor, rec- ommend the granting of the prayer of the petition and the Treasurer in- structed accordingly. Respectfully submitted, M. H. CZIZEK, City Attorney. On motion of Ald. Clancy the re- port of the City Attorney was ap- proved. AN ORDINANCE.
