To the Honorable Mayor and Council of the City of Dubuque: Gentlemen: —The case of Allen Snyder vs. City of Dubuque was called for trial on October 14th. At that time it was found that the witnesses who were most material to the suc- cessful progress of the defense, did not appear. Very earnest attempts were made by the City Attorney's of- fice to secure their presence at the trial or their evidence, but to no avail. After the jury had been partly im- panelled and when the regular panel had been exhausted it was deemed ad- visable under all the circumstances to affect as good a settlement as possi- ble. The plaintiff, after much manipu- lation agreed to accept One Hundred and Twenty -five ($125.00) Dollars in full of his claim. Feeling that this was a satisfactory adjustment we agreed to settle on that basis. I would therefore recommend that the case be settled upon that amount and the Treasurer instructed to draw a warrant in favor of Allen Snyder. . Sincerely yours, M. H. CZIZEK, City Attorney. On motion of Ald. McLaughlin the report of the City Attorney was ap- proved and a warrant in the sum or $125.00 be ordered drawn on the City Treasurer to cover the claim.
