Ald. Frith moved that the Council
Proceedings for the month of January
be approved as printed. Carried.
Ald. Wallis moved to suspend the
'rules for the purpose of allowing Rev
Gorman to address the Council.

Rev. Gorman addressed the Council
in reference to the waterway on West
Fourteenth Street.
Ald. Saul moved that the matter in
reference to the waterway on West
Fourteenth Street be referred to the
,Committee of the Whole to view the
grounds and notify City Engineer to
be present to draw up plans. Carried.
Petition of W. E. Fox et al, relative
to the improvement of Louisa Street,
also the remonstrance of J. Pilmaier.
et al, presented and read. On motion
of Ald. Wallis petition and remon-
strance were referred to the Commit-
tee of the Whole to view the grounds
as soon as possible.

being an honorably discharged soldier

Saul, the prayer of the petitioner was
granted.
Petition of Mrs. M. Clark, relative
to having her assessment canceled on
Lots 177, 178, 179, 180 and 181 in
Finley's Add. presented and read. On
motion of Ald. Frith, the petition was
referred to the Delinquent Tax Com-
mittee.
Petition of Theodore Kemps, rela-
tive to correcting the assessment on
the north 34 feet of Lot 72 and all
of Lot 2 of 71, presented and read.

Petition of J. Osel, relative to can-
celing the assessment levied against

Report of J. H. Spencer et al, com-
mittee having in charge the purchase
of Lot 1 A, of Cooley's Sub., for the
improving of the approach of Mont-
rose Terrace, relative to having a
warrant drawn in the sum of $500.00
for the purchase of said lot, present-
ed and read. On motion of Ald. Wal-
lis, the report of the committee was
approved and a warrant in the sum
of $500.00 was ordered drawn in fa-
vor of Mayor Lyons to purchase said
lot.

warrant No. 6560, and cashed by the
A. Y. McDonald Mfg. Co. I ask
your honorable body to cancel war-
rant No. 5374 to correct warrant ac-

UNION ELECTRIC COMPANY, A
CORPORATION OF DUBUQUE,
IOWA. ITS SUCCESSORS AND AS-
SIGNS, THE RIGHT TO ERECT,
MAINTAIN AND OPERATE A
CERTAIN LINE OF STREET
RAILWAY TO CONNECT WITH
ITS PRESENT LINES, SUCH LINE
TO BE CONSTRUCTED, MAIN-
TAINED AND OPERATED UPON
THE STREETS OF THE CITY OF
D U B U Q U E, IOWA, HEREIN-
AFTER SET OUT AND PROVID-
ING FOR SUBMISSION OF SAME
TO THE VOTE OF THE ELECT-
ORS OF SAID CITY.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That there is hereby grant-
ed to the Union Electric Company, a
corporation organized under the laws
of the state of Iowa, its successors and
assigns, for the term of twenty -five
years from the adoption hereof and its
acceptance by said company, the right
and authority to lay a single or double
track for street railway purposes, with
the necessary switches and turn -outs,
hereinafter to be determined and
agreed upon, along and upon the fol-
lowing streets, to -wit: Commencing
at the intersection of Thirteenth and
Main streets, thence west along the
center line of Thirteenth street to Lo-
cust street, thence north along the
center line of Locust street to Six-
teenth street, thence north and west-
erly along the center line of West
Locust street to Arch street, thence
westerly along the center line of Arch
street to St. Ambrose street, thence
south along the center line of St. Am-
brose street to Asbury street, thence
southeasterly along the center line of
Asbury street to a connection with the
end of the present track now on Delhi
street, with the right to operate cars
thereon, subject to and in accordance
with the following restrictions and
conditions.
Section 2. For the purpose of con-
structing and maintaining and oper-
ating said street railway line, said
Union Electric Company, its succcess-
ors and assigns, shall have the right
and authority to go upon said streets
and parts of streets and make such
excavations therein as may be neces-
sary for the construction, comtletion,
operation and maintenance of said
railway line, and shall have the fur-
ther right and authority to make track
and overhead wire connections at in-
tersections and with car barns and
power house, and to construct all
necessary side- tracks, turn -outs and
switches, and shall also have the right -
to erect, construct and maintain such
overhead wires and poles as may be
necessary to conduct electrical power -
over said wires from the power station
to and along said line of railway.
Section 3. Said Union Electric
Company shall, after making such ex-
cavations in said streets as may be
necessary for the proper construction.
of said track and within a reasonable
time, restore and leave them in as
good condition as they were when
such work was begun, and shall re-
move any refuse, debris, or other en-
cumbrance resulting from said work.
Said company shall also repair all .
damages which may be done to said
streets by the construction or main-
tenance of said track during the life
of the franchise hereby granted.
Before commencing any construc-
tion or repairs under authority of Sec-
tion 2, or this section, which may in
any way affect the streets, alleys or
public places of the city, said Union
Electric Company, its successors a.nd
assigns shall in writing apply to the
Mayor of the city, stating the nature
of the work, the time and place where
the same is proposed to be done, and
thereupon the Mayor shall permit or
refuse to permit • the work to be done -
by issuing a written statement of his.
decision to the said Union Electric
Company, its successors or assigns.
Section 4. The said street railway
line shall be constructed upon the es-
tablished grade of the streets which•
are now improved, and upon the
grades which shall he established
when the streets at present unim-
proved shall be improved by the City
of Dubuque, such improvement to be
complete before said track shall be
constructed thereon. The tracks, poles
and other structures shall be raised or
lowered from time to time without ex-
pense to the city to correspond with
changes that may be made in the
grade of said streets. The gauge of
said railway track shall be that known
as the standard guage. to -wit: four -
feet, eight and one -half inches, and
the center line of the space between
the tracks or rails of said line shall
coincide as nearly as practicable with
the center line of said streets and
parts of streets whereon said track -
or tracks are located.
Section 5. Said Union Electric
Company, its successors or assigns,
shall repair all damages that may be-
done to said streets by the construc-
tion or maintenance of said railway,
shall also keep the space between
said railway tracks and one foot on
• each side thereof, in good repair at
all times, provided that in the case
of double track, when the distance
between the centers of said track is
more than ten feet, the rule requiring
a foot on each side shall prevail. The
City Council shall have the right to
determine the necessity for repairs,
and whenever said company, its suc-
cessors or assigns, shall refuse or ne-
glect to shake the same within a rea-
sonable time after being notified
thereof in writing, the City Council
shall have the right to make such
repairs at the expense of said Union
Electric Company, its successors or
assigns.
Section 6. Said Union - Electric
Company, its succes ,sors or assigns,
shall, whenever practicable, have the
right to use any telephone, telegraph
or fire alarm poles or posts owned or
controlled by the city, now set or
which may herafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the city shall have the
right to use any poles or posts which
may be set by said company along
said line, when the posts and wires
put thereon are used solely for the
benefit and use of the said City of
Dubuque; in either case there shall be
no compensation for such use.
Section 7. Said Union Electric
Company, its successors or assigns,
shall be liable to any person injured
by reason of its negligence in the con -
truction, maintenance or operation of
said street railway, and should any
action be commenced or prosecuted
against the City of Dubuque, upon
any claim for damages based upon
any act or negligence of said com-
pany, said Union Electric Company,
its successors or assigns,. shall upon
being notified of such suit, defend the
same; and should any judgment be
rendered against the city in any such
action, said company shall fully pay
and fully discharge the same.
Section 8. The tracks of said rail-
way shall not be elevated above the
surface of the street, and shall be so
laid that carriages and vehicles can
easily, and with the least obstruction
possible, cross the same.. During the
winter, in the event of heavy snow,
said Union Electric Company, its suc-
cessors, or assigns, shall not obstruct
said streets by the removal of snow
from its tracks, but shall remove any
excess of snow which may be necessary
to render said street passable for vehi-
cles. Any excess of snow thrown from
said street railway tracks, and which
Is not removed within ten hours there-
after, may be removed by the city at
the expense of said- Union Electric
Company, its successors or assigns.
Section 9. The cars of said railway
shall begin running not later than six

A. M., and shall cease not earlier than
eleven thirty P. M., and shall run, in
each direction, at intervals of not
more than twenty minutes. Operation
on Sundays may begin one hour later.
Section 10. The provisions of an
ordinance passed by the City Council
of Dubuque March 6, 1902, approved
March 13. 1902, and accepted on said
March 13, 1902, are hereby applicable
to and a part of this ordinance so far
as the same are contained in the fol-
lowing sections of said ordinance, to --
wit. Section 4, relating to paving and
macadamizing; Section 12, relating to.
other electric lines crossing or using
tracks; Section 13, relating to cars, .
trailers, lights and crossings; Section
15, relating to poles and posts; Sec-
tion 17, relating to special assess-
ments; Section 18, relating to fares
and transfers; and Section 19. relat-
ing to transportation of policemen and
firemen.
Section 11. The new lines of rail-
way herein authorized to be construct-
ed, shall be completed and in opera-
tion within one year from the date of
the passage of this ordinance on such
streets as are now graded and im-
proved, and on those not at present
graded and improved, within one year
from the time said streets are graded
and improved. If not so completed
and in operation, the City Council
may, at its option, declare a forfeiture
of all rights and privileges granted
said Union Electric Company under
this ordinance.
Said Union Electric Company, its
successors or assigns,' shall maintain
and operate, in accordance with the
provisions of this franchise, such
lines as are provided for herein, and
shall operate same with adequate
equipment and provide adequate and
reasonable service on said lines; and'
said; Union Electric Cothpany, its suc-
cessors.or assigns, shall not abandon
any part of said lines unless permitted
so to do by the City Council.
If said company shall abandon any
part of the lines herein provided for,
or shall fail to operate said lines in
accordance with this ordinance, the
City Council may, at its option, de-
clare a forfeiture of all rights and
privileges granted said Union Electric
Company under this ordinance. Pro-
vided, however, that failure to operate
because of strikes, fires, or other
causes beyond the control of said
company, shall not work such a for-
feiture.
Section 12. This ordinance shall
take effect and be in force on and af-
ter its passage and approval and ac-
ceptance in writing by the grantee, or
its assigns, and its publication in the
Telegraph - Herald and Times- Jourhal,
the official papers of the City of Du-
buque, provided that it receive a fav-

That the Chicago, Milwaukee & St.
Paul Railroad Company and the Chi-
cago Great Western. Railroad Com-
pany be and are hereby ordered to

ed said railroad companies the no-
tice provided for in Section 3, Chap-
ter XLVI. of the revised' ordinance
of 1901. The said gates to be placed
in said crossing in accordance with

used, and an estimate of the entire
cost thereof, and the amount and cost
of such improvement, and the amount
assessable upon any railway or street
railway company, the amount and
cost thereof, to be paid by the City,,
if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to or abutting'
upon such improvement per front foot,
and to file such plat and estimate in
the office of the City Recorder ; that
after the filing of said plat and esti-
mate in his office, the City Recorder
shall publish in three consecutive
issues of a newspaper published in
this city, a • notice stating that such
plat and estimates are on file, the lo-
cation and nature of the improve-
ment, kind of material to be used, and
an estimate of its cost, and the time

AN ORDINANCE for the vacation
of all of Fourth street from the east-
erly line of Bell Street to the levee,
and all of Fifth Street from the west-
erly line of Tower Street, and all of
Tower Street from the northerly line
of alley in Block K in Booth's Ad-
dition, northerly to a point forty (40)
feet southerly from the northerly line
extended of Lot Five (5) in Block 0 in
said Booth's Addition, in the City of
Dubuque.
WHEREAS, a petition has been pre-
sented by Fischer & Co., Incorporated,
for the vacation of certain streets and
parts of streets in the City of Du-
buque; and,
WHEREAS, it appears that there is
no objection on the part of any one
interested in the property benefitted
by said streets to the granting of said
petition; and,
WHEREAS, it appears that the va-
cation of said streets will be of great
commercial advantage to the City of
Dubuque and there appears no valid
objection to said vacation and the use
of land so vacated to the owners of
the abutting property on said streets.
THEREFORE BE IT ORDAINED
by the City Council of the City of
Dubuque:
Section 1. That all of Fourth Street,
from the easterly line of Bell Street
to the levee, and all of Fifth Street

WHEREAS, to afford adequate
street facilities for said neighbor-
hood the said Fischer Investment
Company has conveyed to the City
of Dubuque for street purposes a
strip of ground forty feet in width
through Block 0 in Booth's Addition
from the levee to Tower Street, be-
ing Lot Five (5), and the northerly
18 feet in width of Lot 4, both in
Block 0 in said Booth's Addition,
-and.
WHEREAS, by direction of the
City Council of the City of Dubuque,
the City Engineer has made a plat of
and showing said portion of said
street proposed to be vacated, and
filed same in his office subject to pub-
lic inspection, and due notice has
been given to all abutting property
owners and ten days' notice of said
proposed vacation has been publish-
ed in the official papers of the city
and the proposed action has been
submitted to the City Council at two
regular sessions,
AND WHEREAS, it appears that
there is no objection on the part of
any one interested in the property
benefited by said streets to the grant-
ing of said petition,
AND WHEREAS, it appears that
the vacation of said streets will be of
great commercial advantage to the
City of Dubuque, and there appears
no valid objection to said vacation
and granting the use of land so va-
cated to the owners of the abutting
property on said streets;
THEREFORE, BE IT ORDAINED
By the City Council of the City of
Dubuque:
Section 1. That all of Fourth
.Street from the easterly line of Bell
Street to the levee, and all of Fifth
Street from the westerly line of Tow-
er Street to the levee, and all of
Tower Street from the northerly line
of alley in Block K in Booth's Addi-
tion, northerly to a point forty (40)
feet southerly from the northerly
line extended of Lot Five (5) in
Block 0 in said Booth's Addition, all
of said property being in Booth's Ad-
dition to the City of Dubuque, Iowa,
be and the same is hereby vacated
and the use thereof granted to the
Fischer Investment Company and
Fischer & Company, Incorporated,
being the abutters on said streets and
parts of streets so vacated for use in
connection with the ice, fuel and
:storage business subject to the con-
ditions hereinafter named, provided
that if. at any time the said Fischer
Investment Company and Fischer &
Company, Incorporated, or either, or
both of said companies, their suc-
cessors or assigns or lessees, shall
cease to use said property for the
conduct of said business or for manu-
facturing or commercial purposes,
then the land now vacated shall re-
vert back to the City of Dubuque, and
this Ordinance shall be, inoperative,
the same as though it had never been
adopted.
Section 2. This Ordinance is based
on the condition that the terms of
the acceptance hereof endorsed here-
on be duly signed by the said Fischer
Investment Company and Fischer &
Company, Incorporated.
Section 3. —This Ordinance shall be
in force and take effect from and
after its passage by the City Council
and its publication in the Telegraph -
Herald and Times - Journal, official
newspapers.

to prepare a plat showing generally
- the location, nature and extent of the
proposed improvement on Wilson
Avenue from the northerly line of
West Eighth Street to the southerly
line of Julien Avenue, and the kind
of material to be used, and an esti-
mate of the entire cost thereof, and
the ..mount and cost of such improve-
ment, and the amount assessable up-
on any railway or street railway, the
amount and cost thereof, to be paid
by the city, if any, and the cost there-
of and amount assessable upon each
lot or parcel of land adjacent to or
abutting upon such improvement per
front foot, and to file such plat and
estimate in the office of the City Re-
corder; that after the filing of aid
plat and estimate in. his office, the
City Recorder shall publish in three
consecutive issues of a newspaper
published in this city, a notice stat-
ing that such plat and estimates are
on file, the location and nature of the
improvement, kind of material to be
used, and an estimate of its cost, and
the time before which objections
thereto can be filed, and the time fix -
ed for hearing, which time shall not be
- less than five days after the last pub -
cation of such notice, and after such
such notice, and after such publica-
publication shall have been made, the
City Recorder shall, at the nevt regu-
lar session of the City Council, notify
the Council thereof in writing, with a
printed copy of such notice accom-

Whereas the City Council of the
City of Dubuque, at its meeting held
on the 11th day of November, 1912,
fixed and determined on the levy for
all city purposes at Fourteen and
One -half mills, which action on the
part of said Council was subsequently
vetoed by the mayor and said resolu-
tion fixing said levy was thereupon, at
the meeting of said Council held on
the 15th clay of November, 1912, passed
over said veto; and
Whereas the levy so fixed and de-
termined was based on the assessed
valuation of property at its actual
value, and said levy, based on 25 per
cent of the actual valuation would be
equivalent to Fifty -eight (58) mills on
the dollar;
Therefore, be it resolved that this
council certify, and they do hereby
certify, to the treasurer of Dubuque
county the said aggregate total levy
of Fifty -eight (58) mills on the doI-
lar for all city purposes in compliance
with the provisions of Section Seven
of Chapter Sixty -three of the Acts of
the Thirty - fourth General Assembly,
and that the City Recorder be in-
structed to properly certify the action
now taken by this council to said
county treasurer.

proposition is now pending before the
City Council of the City of Dubuque,
for vaction of an alley and streets
across land in which you claim an in-
terest, as follows: That part of 4th
St. lying east of Bell St., that part of
5th St. lying east of Tower St., Tower
St. from alley between 5th and 6th
Sts. southerly to the alley between
3rd and 4th Sts., a plat of which vaca-
tion has been filed in the office of the
City Engineer of said City, and you
are notified that a session of the said
City Council to be holden at the City
Hall of said City, on the 20th day of
March, it will be determined whether
said proposed vacation will be made,
and you are hereby notified to appear
before said Council at said session and
show cause, if any you have, why pro-
posed improvement should not be
made.

Be it Resolved by the City Council
of the City of Dubuque, That from and
after 20 days after the passage and
publication hereof as required by or-
dinance, and for a period of ten years
thereafter, no person, firm or cor-
poration shall excavate in or tear up
the surface of the alley between Main
and Locust Streets from Second to
Seventeenth Streets, or of the alley
between Main and Iowa Streets from
Second to Fifteenth Streets.
Any person violating the provision
of this resolution shall be subject to
a fine of $100.00 for each offense, and
the City Recorder is hereby instructed
to cause to be published notice of the
adoption hereof within twenty -four
hours after its passage.
Resolved further, that the provi-
sions hereof shall be held not to ap-
ply in the case of contracts which
have been let for the brick paving of
said alleys,

City Council to improve Arch Street
from the east line of the alley first
east of St. Ambrose Street, westerly
to St. Ambrose Street.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that said improvement will require:
1,200 lineal feet cement curb and
gutter.
4,800 square yards Telford maca-
dam.
100 cubic yards earth filling,

MAINTAIN AND OPERATE A
CERTAIN LINE OF E'PREET
RAILWAY TO CONNECT WITH
ITS PRESENT LINES, SUCH LINE
TO BE CONSTRUCTED, MAIN-
TAINED AND OPERATED UPON
THE STREETS OF THE CITY OF
DUBUQUE, IOWA, HEREIN-
AFTER SET OUT AND PROVID-
ING FOR SUBMISSION OF SAME
TO THE VOTE OF THE ELECT-

Be it Ordained by the City Council
of the Cita' of Dubuque:
Section 1. That there is hereby grant-
ed to the Union Electric Company, a
corporation organized under the laws
of the state of Iowa, its successors and
assigns, for the term of twenty -five
years from the adoption hereof and its
acceptance by said company. the right
and authority to lay a single or double
track for street railway purposes, with
the necessary switches and turn -outs,
hereinafter to be determined and
agreed upon, along and upon the fol-
lowing streets, to-wit: Commencing
at the intersection of Thirteenth and
Main streets, thence west along the
center line of Thirteenth street to Lo-
cust street, thence north along the
center line of Locust street to Six-
teenth street, thence north and west-
erly along the center line of West
Locust street to Arch street, thence
westerly along the center line of Arch
street to St. Ambrose street, thence
south along the center line of St. Am-
brose street to Asbury street, thence
southeasterly along the center line of
Asbury street to a connection with the
end of the present track no w on Delh
street, with the right, to operate cars
thereon, subject to and in accordance
w ith the following restrictions and
coo.
Section 2. For the purpose of con-
struc m a ating said strand eet inta railway ng lineand o , said
Union Electric Company, its succcess-
ors and assigns, shall have the right
and authority to go upon said streets
and parts of streets and make such
excavations therein as may be neces-
sary for the construction, completion,
operation and maintenance of said
railway line, and shall have the fur-
ther right and authority to make track
and overhead wire connections at in-
tersections and with car barns and
polder house, and to construct all
necessary side - tracks, turn -outs and
switches, and shall also have the right
to erect, construct and maintain such
overhead wires and poles as may be
necessary to conduct electrical power
offer said wires from the power station
to and along said line of railway.
Section 3. Said Union Electric
Company shall, after making such ex-
cavations in said streets as may be
necessary for the 'proper construction
of said track and within a reasonable
time, restore and leave them in as
good condition as they were when
such work was begun, and shall re-
move any refuse, debris, or other en-
cumbrance resulting from said work.
Said company shall also repair all
damages which may be done to said
streets by the construction or main-
tenance of said track during the life
of the franchise hereby granted.
Before commencing any construc-
tion or repairs under authority of Sec-
tion 2, or this section, which may in
any way affect the streets, alleys or
public places of the city, said Union
Electric Company, its successors and
assigns shall in writing apply to the
Mayor of the city, stating the nature
of the work, the tine and plaee Where
the same is proposed to be done, and
thereupon the Mayor shall permit or
refuse to perriiit' the work to be done
by issuing a written statement of his
decision to the said Union Electric ,
Company, its successors or assigns.
Section 4. The said street railway
litie shall lid consti•dcted upon the es-
tablished grade of the streets which
are now improved, and upon the
grades which shall be established
when the streets at present unim-
proved' shall be improved by the City
of Dubuque, such improvement to be
complete before said track shall be
constructed thereon. The tracks, poles
and other structures shall be raised or
lowered from time to time without ex-
pense to the city to correspond with
changes that may be made in the'
grade of said streets. The gauge of
said railway track shall he that known

as the standard guage. to -wit: four
feet, eight and one -half inches, and
the center line of the space between
the tracks or rails of said line shall
coincide as nearly as practicable with
the center line of said streets and
parts of streets whereon said track
or tracks are located.
Section 5. Said Union Electric
Company, its successors or assigns,
shall repair all damages that may be
done to said streets by the construc-
tion or niaintenance of said railway,
shall also keep the space between
said railway tracks and one foot on
each side thereof, in good repair at
all times, provided that in the case
of double track, when the distance
between the centers of said track is
more than ten feet, the rule requiring
a foot on each side shall prevail. The
City Council shall have the right to
determine the necessity for repairs,
and whenever said company, its suc-
cessors or assigns, shall refuse or ne-
glect to Make the same within a rea-
sonable time after being notified
thereof in writing, the City Council
shall have the right to make such
repairs at the expense of said Union
Electric Company, its successors or
assigns.
Section 6. Said Union Electric
Company, its successors or assigns,
shall, whenever practicable, have the
right to use any telephone, telegraph
or fire alarm poles or posts owned or
controlled by the city, now set or
which may herafter be set along the
line of the track for which franchise
is hereby granted. And, whenever
practicable, the city shall have the
right to use any poles or posts which
may be set by said company along
said line, when the post's and wires
put thereon are used solely for the
benefit and use of the said City of
Dubuque; in either case there shall be
no compensation for such use.
Section 7. Said Union Electric
Company, its successors or assigns,
shall be liable to any person injured
by reason of its negligence in the con -
truction, maintenance or operation of
said street railway, and should any
action be eemnlenced or prosecuted
against the City of Dubuque, upon
any claim for damages based upon
any act or negligence of said com-
pany,, said Union Electric Company,
its successors or assigns, sTiall upon
being notified of such suit, defend the
same; and should any judgment be
rendered against' the city in any such
action, said .company, shall fully pay
and fully discharge the same.
Section S: The tracks of said rail-
way shall not h'e elevated above the
surface of the street, and shall be so
laid that carriages and vehicles can
easily, arid with the least obstruction
possible, cross the sam"'e. During the

Petition of F. G. Hohnecker, rela-
tive to improving Eagle Street from
Viola Street to Althauser Avenue,
presented and read. On motion of
Ald. Andresen petition was referred

winter, in the event of heavy snow,
said Union Electric Company, its suc-
cessors, or assigns, shall not obstruct
said streets by the removal of snow
from its tracks, but shall remove any
excess of snow which may be necessary
to render said street passable for vehi-
cles. Any excess of snow thrown from
said street railway tracks, and which
is not removed within ten hours there-
after, may be removed by the city at
the expense of said Union Electric
Company, its successors or assigns.
Section 9. The cars of said railway
shall begin running not later than six
A. M., and shall cease not earlier than
eleven thirty P. M., and shall run, in
each direction, at intervals of not
more than twenty minutes. Operation
on Sundays may begin one hour later.
Section 10. The provisions of an
ordinance passed by the City Council
of Dubuque March 6, 1902, approved
March 13, 1902, and accepted on said
March 13, 1902, are hereby applicable
to and a part of this ordinance so far
as the same are contained in the fol-
lowing sections of said ordinance, to-
wit. Section 4, relating to paving and
macadamizing; Section 12, relating to
other electric lines crossing or using
tracks; Section 13, relating to cars,
trailers, lights and crossings; Section
15, relating to poles and posts; Sec-
tion 17, relating to special assess-
ments; Section 18, relating to fares
and transfers; and Section 19, relat-
ing to transportation of policemen and
firemen.
Section 11. The new lines of rail-
way herein authorized to be construct-
ed, shall be completed and in opera-
tion within one year from the date of
the passage of this ordinance on such
streets as are now graded and im-
proved, and on those not at present
graded and improved, within one year
from the time said streets are graded
and improved. If not so completed
and in operation, the City Council
may, at its option, declare a forfeiture
of all rights and privileges granted
said Union Electric Company under
this ordinance.
Said Union Electric Company, its
successors or assigns, shall maintain
and operate, in accordance with the
provisions of this franchise, such
lines as are provided for herein, and
shall operate same with adequate
equipment and provide adequate and
reasonable service on said lines; and
, said Union Electric Company, its suc-
cessors or assigns, shall not abandon
any part of said lines unless permitted
so to do by the City Council.
If said company shall abandon any
part of the lines herein provided for,
or shall fail to operate said lines in
accordance with this ordinance, the
City Council may, at its option, de-
clare a forfeiture of all rights and
privileges granted said Union Electric
Official Notices
Company under this ordinance. Pro-
vided, however, that failure to operate
because of strikes, fires, or other
causes beyond the control of said
company, shall not work such a for-
feiture.
Section 12. This ordinance shall
take effect and be in force on and af-
ter its passage and approval nd ac-
ceptance in writing by the grantee, or
its assigns, and its publication in the
Telegraph- Herald and Times - Journal,
the official papers of the City of Du-
buque, provided that it receive a fav-
orable vote of a majority of the legal
electors of the City of Dubuque, Iowa,
voting on the question at the election
to be held for that purpose, and the
expense of such special election shall
be paid by the grantee or its assigns.
The question whether this franchise
shall be granted and the foregoing or-
dinance take effect shall be submitted
to the legal electors of the city of Du-
buque, Iowa, to be voted upon at a
special election to be held on the 22nd
oay of April, A. D. 1913. At such
election on this question the form of
